CONFORMANCE WITH PLAN Workshall conform to plan entitled "Definitive Subdivision Plan - Hilton Street, Salem, Massachusetts", five sheets, dated August 12, 1994, revised September 13, 1994 prepared by Eastern Land Survey Assoc., Inc. 2. UTILITIES Utility installation shall be reviewed and approved by the City Engineer. 3. CLERK OF THE WORKS A Clerk of the Works shall be provided at the expense of the developer as is deemed necessary by the City Planner. 4. BOARD OF HEALTH The Board of Health recommendations shall be adhered to. 5. COVENANT A Covenant shall be filed with the Planning Board prior to the release of the plan to ensure completion of improvements required under the City of Salem Subdivision Regulations, and as required by this approval. Such Covenant is subject to the review and approval of the City Solicitor. 6. LANDSCAPING CCrr,, a. Trees shall be a minimum of 3 1/2" caliper, planted 30 feet on cenkq ZZ 2 y6 P", 9� Ci; b. Trees shall be the responsibility of the developer, his successors or assigns in ^;s accordance with the City of Salem Subdivision Regulations Right of Way Improvement Policy. 7. STREET LIGHTING Street lighting installation shall be reviewed and approved by the City Electrician and Massachusetts Electric. The street lighting shall be the responsibility of the developer until such time as the City accepts the street. 8. STREET NUMBERING The developer shall contact the City Assessor to determine the numbering of the to be constructed homes. 9. CONSTRUCTION PRACTICES All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 a.m. on weekdays and saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. .Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. c. . Drilling and blasting shall be limited to Monday-Friday between 8:00 a.m. and 5:00 p.m. There shall be no drilling or blasting on Saturdays, Sundays or holidays. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on roadways as they leave the site. e. A back-flow preventor shall be installed at the end of the existing Hilton Street to the satisfaction of the City of Salem Engineer. f. The developer shall be responsible to provide a functioning drainage system from the catch basin within the cul-de-sac at Hilton Street extension to the terminus at a catch basin at Calumet Street. If the existing pipe does not function to the satisfaction of the City of Salem Engineer the developer shall be responsible to replace the entire pipe with a new 12" pipe to be approved by the City Engineer. Once the pipe is functioning properly, the developer shall submit a report and a certification that the pipe is operating properly. Such certification shall be formally accepted by the City of Salem Engineer. A copy of the certification and report shall also be submitted to the Planning Board 4yd the Department of Public Works in Peabody. [C 2 46 PH CITY C, g. All construction shall be carried out in accordance with Rules aad Repiditiodg S of the Planning Board. 10. PAVING The developer is responsible to trench patch over the portion of roadway which is dug up to connect utility lines, then edge to edge overlay the entire length of Hilton Street. 11. AS-BUILT PLANS As-built plans, stamped by a Registered Professional Engineer of Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to issuance of a Certificate of Occupancy. 12 VIOLATIONS Violations of any conditions shall result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for recording or registering shall be paid by owner or applicant.
