The proposed site plan shows new construction of an approx. 12,900 sq.ft. office building and 30 on-site parking spaces. The Public Hearing was closed on June 15, 2006. At a regularly scheduled meeting of the Planning Board held on June 15, 2006, the Planning Board voted by a vote of eight (8) in favor (Power, Moustakis, Collins, Kavanagh, Puleo, Lombardini, Sullivan, Ready), none (0) opposed to approve the Site Plan Review application subject to the following conditions: 1. Conformance with the Plan Work shall conform to the plans entitled, "Most Corporation Corporate Offices at 469 Highland Ave Salem, Massachusetts" Sheets 1-6 and revised sheet 3, prepared by Patrowicz Land Development Engineering, 14 Brown Street, Salem, MA 01970, dated April 18, 2006 and May 23, 2006 with revisions on June 14, 2006. Revised Plans reflecting all conditions and incorporating by reference this decision must be submitted and approved by the City Planner prior to the issuance of a building permit. These plans are to show the locations of all utilities, including gas lines. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Mass Highway Approvals The applicant, his successors or assigns must receive all necessary approvals from the Massachusetts Highway Department for any and all curb cuts, as well as water and sewer connections as they apply. 4. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Exterior construction work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. Any interior work conducted during these times will not involve heavy machinery which could generate disturbing noises. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site. g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant prior to the issuance of a building permit. Included in this plan, but not limited to, shall be information regarding how the construction equipment will be stored, a description of the construction staging area and its location in relation to the site, and where the construction employees will park their vehicles. The plan and schedule shall be submitted and approved by the City Planner prior to the issuance of a Building Permit. 5. Clerk of the Works A Clerk of the Works shall be provided by the City, at the expense of the applicant, his successors or assigns, as is deemed necessary by the City Planner. 6. Drainage Plans Revised drainage plans showing the location of the new fire lane and any necessary additional drainage infrastructure must be submitted and approved by the Engineering Department prior to the issuance of a building permit. 2 7. Sewer Service The applicant agrees that if the city ever extends the city's sewer service to Wyman Road, the applicant, his successors or assigns shall obtain the necessary permits and approvals and shall connect to the city's system. They shall also discontinue and fully remove the existing sewer force main and accessory equipment. 8. Fire Lane The fire lane around the building shall either be constructed as depicted in the revised plans dated June 14, 2006, or be constructed to a width that is acceptable to the Fire Department, to be reviewed and approved by the Fire Prevention Officer prior to the issuance of a building permit. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 11. Board of Health All work shall comply with the Board of Health decision and conditions. 12. Utilities Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 13. Department of Public Services The applicant, his successors or assigns shall comply with all requirements of the Department of Public Services 14. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. c. After installation, lighting shall be reviewed and approved by the City Planner, prior to the issuance of a Certificate of Occupancy. 15. HVAC If an HVAC unit is located on the roof or site, it shall be visually screened. The method for screening the unit shall be submitted to the City Planner for review and approval prior to installation. 16. Noise Following occupancy of the building, if the Health Department receives any complaints concerning noise emanating from the air conditioner units, the applicant shall be required to 3 show that the decibel level is no higher than the pre-development level, if that is not the case, the applicant shall submit a plan for review and approval by the City Planner to make any improvements necessary. 17. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum diameter of 3 '/2" dbh (diameter breast height). c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. Any street trees removed as a result of construction shall be replaced. The location of the trees shall be approved by the City Planner prior to replanting. e. Final completed landscaping shall be subject to approval by the City Planner prior to the issuance of a Certificate of Occupancy. 18. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 19. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the Certificate of Occupancy. 20. Violations Violations of any condition contained herein shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
