C/O"Attorney John Serafini, Sr. 63 Federal Street Salem, MA 01970 RE: Wal-Mart- Highland Avenue, Salem On Thursday, July 24, 1997, the Planning Board of the City of Salem opened a public hearing regarding the application of Wal-Mart Stores East, Inc., under Section 7-18, Site Plan Review of the Salem Zoning Ordinance, with respect to property located at 450 Highland Avenue. The proposed project involves the take-over of the existing Rich's store by Wal-Mart. The public hearing was closed on September 18, 1997, and at a regularly scheduled meeting of the Planning Board held on September 18, 1997, the Board voted by a vote of seven (7) in favor, none opposed, to approve the application as complying with the requirements of Section 7-18, subject to the following conditions: 1. Conformance with Plan Work shall conform with set of plans entitled, "Site Improvement Plans for Wal-Mart Store No. 2640, Highland Avenue/Route 107, Salem, MA", dated July 1, 1997, revised through September 2, 1997, containing seven(7) sheets, prepared by Sain Associates, 185 Harlow Street, Suite 8, Bangor, Maine 04401. 2. Amendments Any amendments to the Site Plan or waiver of conditions contained within shall require the approval of the Planning Board. 3. Utilities Utility installation shall be reviewed.and approved by the City Engineer prior to the issuance of a Building Permit. 4. Site Lighting 1 All new site lighting shall be installed and maintained in such a wa�N�b 91 to not reflVSyt cause glare on abutting properties, or which adversely affect safe visi upto vehicles moving on nearby streets. �� 5. Landscaping The Applicant shall be responsible for the clean-up and maintenance of the existing landscape beds throughout the site. 6. Signage Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 7. Proposed Access Road The Applicant agrees to diligently pursue, with the owners of the adjacent shopping center, a mutually satisfactory plan for an access road connecting the two shopping centers. Final design plans for the construction of the proposed access road shall be reviewed and approved by the City Planner. 8. Board of Health All requirements of the Board of Health Decision shall be strictly complied with. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Building Inspector All work shall comply with the requirements of the City of Salem Building Inspector. 11. Clerk of Works The City's Clerk of Works shall be on site as deemed necessary by the City Planner. The Applicant shall be billed by the Planning Department at a rate of$20 per hour for this service. 12. Maintenance A. Refuse removal, ground maintenance and snow removal shall be the responsibility of the Applicant. B. Winter snow in excess of snow storage areas on the site shall be removed off site. 13. Advance notice.shall be provided to all abutters in writing at least 72 hours prior to the commencement of construction. Notification shall also be submitted to the Planning Department. C. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. D. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all riles, regulations and ordinances of the City of Salem. 14. , Violations Violation of any condition of this Decision may result in revocation of this permit by the Planning Board.
