A Public Hearing on this petition was held on February 1, 2001. The following Planning Board members were present: Carter Vinson, Acting Chairman; David Weiner, John Moustakis, Bill Cullen, Pam Lombardini, Gene Collins and Bill Luster. Notice of this meeting was sent to abutters and notice of the hearing was properly published in the Salem Evening News. The petitioner is requesting a Wireless Communication Facility Special Permit under Section 5-3, Special Permit Uses, of the City of Salem Zoning.Ordinance, to allow the installation of a digital satellite radio repeater system which includes a repeater cabinet, an omnidirectional transmit antenna and a satellite receiver dish located at 40R Highland Avenue (Fairweather Apartments), Salem, MA. An equipment room will be located on the seventh floor of the apartment building and the antenna; repeater cabinet and cables will be painted to match the structure. The Planning Board reviewed the application and plans submitted and found that the petitioner addressed the requirements of this section for the issuance of a Special Permit. On February 1, 2001, the Board closed the Public Hearing and then the Planning Board voted by a vote of seven (7) in favor, none opposed, to grant the Wireless Communication Facility Special Permit for the location stated above, in accordance with the applications (dated January 3, 200 1) and site plan last dated 8/31/00, titled"Satellite Radio, Fairweather Apartments, 41R Highland Ave./Rte 107, Salem, MA ", Sheets T-1, A-1, A-2, S-1 an E-I and drawn by GEOD Consulting, submitted and now part of the file. The Special Permit was approved with the condition that the applicant paints the antenna and repeater cabinet to match the color of the buildingand the existing roof structures. In addition, the applicant shall maintain the paint on the antenna and repeater cabinet. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed that it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for recording or registering shall be paid by the owner or applicant.
