SPECIAL PERMIT WETLANDS AND FLOOD HAZARD DISTRICT/ BUSINESS PARK DEVELOPMENT Mr. Thomas McAuliffe c/o Tinti, Quinn and Savoy 222 Essex Street Salem, MA 01970 RE: 333 Highland Avenue On Thursday, April 16, 1987, the Planning Board of the City of Salem held a public hearing regarding the application of Mr. Thomas McAuliffe for Special Permits under Sections P, Wetlands and Flood Hazard Districts, and Section Q, Business Park Development, of the Salem Zoning Ordinance, with respect to a proposal to construct a medical office building at 333 Highland Avenue. This work is proposed to take place within a wetlands area. At a regularly scheduled -meeting of the Planning Board on April 16, 1987, the Board voted by a vote of five in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Work shall conform to pian and specifications accompanying Special Permit application, dated March 31, 1987. Work shall further conform to a modification of an Order of Conditions issued for the project (#64-3-24) by the Salem Conservation Commission. This Special Permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recored and noted on the owner's certificate of title. The fee for recording or registering shall be paid by the owner or applicant. n Walter B. Power, III 6D Chairman DECISION •g7 NAY -4 ,�,} : ;6 CIT ' SPECIAL PERMIT SITE PLAN REVIEW 333 HIGHLAND AVENUE i SALEM, MA 01970 On Thursday, April 16, 1987, the Planning Board of the City of Salem held a public hearing under Section VII R, Site Plan Review, of the Salem Zoning Ordinance on the application of Thomas McAuliffe with respect to the construction of a professional office building at 333 Highland Avenue. At a regularly scheduled meeting of the Planning Board held on April 16, 1987, the Board voted, by a vote of five in favor, none opposed, to approve the application as complying with the requirements for issuance of a Special Permit, subject to the following conditions: 1 . Conformance with Plan Work shall conform to entitled "Site Plan, 333 Highland Avenue", dated March 31 , 1987. 2. Utilities Utility installation shall_be. reviewed and approved by the Director of Public Services. - 3. Landscaping Landscaping of the site shall conform to plan entitled "Site Plan, 333 Highland Avenue", dated March 31 , 1987. a. Trees shall b(�, a minimum of ,32" caliper. b. Maintenance of landscape vegetation shall be the responsiblity of the developer, his successors or assigns. 4. Curbing Location of granite curbing shall be reviewed and approved by the City Planner prior to issuance of Building Permit. 5. Signage Signage shall be reviewed and approved by the City Planner. 6. Construction Practices All construction shall be conducted in accordance with the following conditions: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be no l F n J� 2 work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters _in writing at least 72 hours prior to commencement of construction. C. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on roadways as they leave the site. 7. Easement The developer shall agree to grant an easement through the rear of his property, as defined by the City Planner, to the adjacent pmrcel of land to the east. Such easement shall be executed for the purpose of providing a vehicular access to the adjacent parcel to the east when development takes place on such parcel. This easement and its location shall be reviewed and approved by the City Planner. 8. Covenant A covenant shall be executed by the developer of 333 Highland Avenue which states that all space shall be utilized for a use which is allowed in the Business Park Development Zone and also such that all space is compatible with an office use. This covenant shall be reviewed and approved by the City Planner. 9. Violation Any violation of these conditions shall result in revocation of this permit by the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. This Special Permit shall not take effect until a copy of this decision bearing the Certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded on the owner' s certificate of title.
