Keilty: On April 24, 2000, the Planning Board of the City of Salem opened a meeting regarding the application of Stutz Plaisted under Section 7-18, site plan review of the Salem Zoning Ordinance, with respect to a proposal to amend the site plan review approval awarded to Stutz Volvo by the Planning Board. The applicant requested the utilization of an existing building located on Green Ledge Road to be part of the Stutz Volvo operation. The building is approximately 10,140 square feet in size. The building will house the service station operations of the Volvo Dealership. In addition, a parking lot of approximately 82 parking spaces for automobile storage will be constructed. At a regularly scheduled meeting of the Planning Board held on May 4, 2000, the Board voted by a vote of seven (7) in favor and none (0) opposed, to approve the application complying with the requirements for the issuance of an amendment to site plan review approval with the following conditions: 1. Conformance with the Plan Work shall conform with the plan entitled, "Stutz Volvo Automotive Center - Parking Lot Expansion and Building Conversion Site Plan, Highland Avenue, Salem, MA', sheets Cl and C2, prepared by Oak Point Associates, dated February 24, 2000 and revised October 12, 2000. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Signage Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 5. Lighting a. Lighting shall be installed as shown on the approved plan. b. No light shall cast a glare onto adjacent parcels or adjacent rights of way. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. e. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6. Fire Department All requirements of the Salem Fire Department shall be strictly adhered to. 7. Clerk of the Works A Clerk of the Works shall be provided and paid for by the applicant as deemed necessary by the City Planner. 8. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 9. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site and not on Highland Avenue. 11. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. On June 7,2007,the Planning Board closed the public hearing and voted by a vote of six (6) in favor(Mr. Power,Mr. Puleo,Ms. Sullivan, Ms. Lombardini, Mr. Moustakis, and Mr. Collins), and two abstentions (Mr. Ready and Mr. Kavanaugh)to make the Findings of Fact as specified below and to amend the decision to eliminate the barbed wire on the fencing and remove the jersey barriers and replace them with landscaped traffic barrels, to be maintained seasonally by the applicant. The Remand Order stated that the Defendant, Stutz Volvo, had presented a Remand Motion based on the grounds that the July, 2006 Decision failed to include a statement of supporting reasons as is required by Massachusetts General Laws, Chapter 40A, Section 9 and by Section 7- 18(e) of the City of Salem Zoning Ordinance. f 4. The Planning Board having convened the Public Hearing, found the following: (a) The July, 2006 Decision of the Planning Board was an amendment of a Decision first dated November 13, 2000. (b) The November 13,2000 Decision stated that all work shall confonI l with the plan entitled, "Stutz Volvo Automotive Center-Parking Lot Expansion and Building Conversion Site Plan, Highland Avenue, Salem, Mass., Sheet CI& C2, prepared by Oak Point Associates dated February 24,2000,revised October 12,2000" (hereinafter referred to as "Oak Point Plan". (c)The Oak Point Plan called for the installation of islands which would provide definition to the roadway referred to as Greenledge Street and would provide well-defined curb cuts and would provide some landscaping relief to an otherwise entirely paved area. (d)The November 13,2000 Decision presumed that Greenledge Street was a Public Way and that the Planning Board had total and exclusive jurisdiction over the roadway. (e)The Planning Board subsequently received an opinion from the City of Salem Legal Department stating that the street was Private. (£) Stutz Volvo expressed its opinion that the way was Private and that the islands were not within their sole control to install. (g) Stutz Volvo expressed that it wanted to substitute Jersey Barriers with fencing on the top of the cement structures to satisfy certain security requirements of their insurer and the manufacturer. (h)The Board noted that the reason that the matter of a special permit was before it was due to renovation of the existing showroom facility and the renovation of what was formerly a contractors shop at the end of Greenledge Street as a new repair facility for Stutz Volvo. The renovation of the original showroom included landscaping and improved the gateway to the City of Salem. (I)The Board was aware of its complete and absolute discretion as to the treatment of the Stutz property and the proposed amendment is in harmony with the general purpose and intent of the City's Zoning Ordinance,Article VII, Section 7-18 (e). Conditions of Approval of the Amended Decision 1. Other Decisions All other conditions from previous decisions, not directly affected by this amended decision, shall remain in effect 2. Fence The existing chain link fence may remain, but the barbed wire must be removed. In addition, the chain link fence must be painted black. 3.
