LUSTER ONE SALEM GREEN City Planner 01970 (508) 745-9595, EXT. 311 FAX (508) 744-5918 Decision SITE PLAN REVIEW SPECIAL PERMIT Gary Nadeau Miroslaw Kantorosinski c/o Yasi and Yasi Two Salem Green Salem, Ma 01970 RE: Bagel Shop - 296 Highland Avenue On March 23, 1995, the Planning Board of the City of Salem held a public hearing regarding the application of Gary Nadeau and Miroslaw Kantorosinski under Section 7-18, Site Plan Review Special Permit of the Salem Zoning Ordinance, with respect to a proposal to construct a 2,808 s.f. addition at 296 Highland Avenue to house a Bagel Shop. The proposed addition is located in an Entrance Corridor Overlay District. At a regularly scheduled meeting of the Planning Board held on April 20, 1995, the Board voted, by a vote of seven in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: I. Conformance With Plan Work shall conform with the following plans: a. "Proposed Bagel Shop, Certified Plot Plan-296 Highland Avenue, Salem, MA", dated January 9, 1995, revised February 17, 1995, containing one sheet, prepared by Otte & Dwyer, Inc., 196 Central Street, Saugus, MA. b. "Proposed Bagel Shop - 296 Highland Avenue", dated March 1, 1995, containing sheets No. A-2 and A-3, prepared by James Howland Ballou, 14 Cambridge Street, Salem, MA. 2. Amendments Any amendments to the Site Plan or waiver of conditions contained within shall require the approval of the Planning Board. 3. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 4. Site Liphting a. A lighting plan shall be submitted to the City Planner for review and written approval prior to the issuance of a Building Permit. b. All site lighting shall be installed and maintained in such a way so as to not reflect or cause glare on abutting properties, or which adversely affect safe vision of operators of vehicles moving on nearby streets. 5. Landscaping a. A detailed landscaping plan and planting schedule shall be submitted to the City Planner and approved prior to the issuance of a Building Permit. b. Trees shall be a minimum of 3 1/2" caliper. c. Sloped granite curbing shall be installed around the entrance radii to the site and in absence of a MHD requirement, the applicant shall install the sloped granite curbing along the property line. d. Concrete curbing shall be installed within the entire site. e. There shall be no change to current landscaping on the slope behind the building. f. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, the applicant shall be required to add further landscaping if such is required by the City Planner. 6. Dumoster Enclosure A plan of the proposed dumpster enclosure shall be submitted to the City Planner for review and written approval prior to the issuance of a Certificate of Occupancy. 7. Sivage Proposed signage shall be reviewed and approved by the City Planner. 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. Fire Devartment All requirements of the Salem Fire Department shall be strictly adhered to. 10. Underground Utilities Any new electrical service to the site shall be in the form of a pad-mounted transformer. 11. Noise Level Between 11:00 P.M. and 7:00 A.M. the noise levels as generated by the rooftop equipment at the closest residence shall be no greater than 40 db. 12. Roof Top Eguipment All roof top equipment shall be properly screened. A detailed plan showing the location of any roof top equipment and the proposed screening shall be submitted to the.City Planner prior to the issuance of a Building Permit. Such screening shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 13. Massachusetts Highwgy Department Applicant shall obtain all required permits from Vic 'Nla_sachusetts Highway Department and submit copies to the City Planner prior to the issuance of a Building Permit. 14. Clerk of Works A Clerk of Works shall be provided and paid for by the applicant as deemed necessary by the City Planner. 15. Maintenance a.Tbe applicant shall employ an acceptable method or means for the holding and disposal of trash (rubbish) after site development with a copy of this method sent to the Planning Department and Health Department in writing for their approval. b.Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. c.Winter snow and ice maintenance process shall be approved by the City Engineer. d.Winter snow in excess of the snow storage areas on the site shall be removed off site. 16. Construction Practices All construction shall be carried out in accordancl- -Ni6i the following conditions: a. No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. c. Maintenance of all landscaping shall be the responsibility of the developer, his successors or assigns. d. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 17. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to the issuance of a Certificate of Occupancy. 18. Violations Violations of any condition may result in revocation of this permit by the Planning Board. I hereby certify that a copy of this decision and plans have been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty(20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record or is recorded on the owner's Certificate of Title. The applicant requested the construction of a drive through on the site. The decision approved by the Planning Board on April 20, 1995 is still in effect. At a regularly scheduled meeting of the Planning Board held on May 4, 2000, the Board voted by a vote of seven(7) in favor and none (0) opposed, to approve the application complying with the requirements for the issuance of an amendment to site plan review approval with the following conditions: I. Conformance with the Plan Work shall conform with the plan entitled, "Site Plan—Bagel Place, Route 107, Highland Avenue, Salem, MA", sheet Cla, prepared by H.H. Morant & Co., Inc Architects, dated May 5, 1999, revised October 4, 1999, March 15, 2000, and May 3, 2000. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. All construction vehicles left overnight at the site,must be located completely on the site and not on Highland Avenue. 8.
