The proposed plan shows new construction of two (2) one-story buildings: a proposed CVS pharmacy of approx. 12,900 sq.ft., and a Dunkin Donuts/Tri City Sales building of approx. 10,400 sq.ft. on two (2) lots. The plan also shows construction of two (2) drive through lanes for the CVS pharmacy building. The public hearing was continued to March 15, 2007 and April 5, 2007. The Public Hearing was closed on April 5, 2007. At the regularly scheduled meeting of the Planning Board held on April 5, 2007, the Board voted by a vote of nine (9) in favor(Power, Moustakis, Collins, Kavanagh, Puleo, Lombardini, Hanscom, Sullivan, Ready), none(0) opposed, to approve the application as complying with the requirements of Site Plan Review subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "Tri-City Plaza, Highland Avenue, Salem, Massachusetts"prepared by Vanasse Hangen Brustlin, Inc., 101 Walnut Street, Watertown, MA dated November 13, 2006, including pages C-I —C-8 and revised December 11, 2006, and the elevations entitled "CVS Pharmacy"prepared by William Starck Architects, Inc., 114 Durfee Street, Fall River, Massachusetts, sheet A-4.1, dated December 21, 2006. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall require approval by the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Project Delays The developer, his successors or assigns shall notify the Department of Planning and Community Development if work on the site ceases for any reason for a period of six (6) months. In this event, the applicant shall be required to appear before the Planning Board and report to the Board the reason(s)why work has ceased at the project and a schedule of when work will begin again at the site, as well as a date of final project completion. If substantial work has not commenced on the site, as deemed by the Board, and such work is not anticipated to begin within two (2) years of the date of the Planning Board's original decision,the applicant shall notify the Board and,prior to the two-year anniversary of the issuance of the permit, shall request an extension of the permit from the Board. Applicant shall provide in such request any and all materials the Board may require to make a determination on the extension request, including but not limited to: studies, reports or new plans, at the applicant's expense, as requested by the Board and deemed necessary by the City Planner. 4. Landscaping a. Any proposed landscaping shall be done in accordance with the approved set of plans. b. The applicant shall coordinate with the City of Salem Cemetery & Shade Tree Department for the selection of street trees. The selection and placement of street trees shall be reviewed and approved by the Department of Planning& Community Development prior to installation. c. The final landscaping plan shall be approved by the City Planner prior to the issuance of a building permit. The applicant shall remove the sumac trees on the landscaping plan and replace them with another kind of species,to be approved by the City Planner. d. The developer shall install the fencing to screen the site prior to construction, and shall install such landscaping to screen the site as is feasible prior to the start of construction to mitigate the impacts of construction noise on the neighborhood. e. The developer shall install a drainage device in the berm of the on site detention basin between the property owner on the north side of the detention basin and the site to alleviate the collection of drainage at this location. Plans to be submitted to the Department of Planning and Community Development for review and approval by the City Engineer 4. Signage All proposed signage shall be reviewed and approved by the City Planner prior to the issuance of a sign permit. 5. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. A final lighting plan shall be submitted to the City Planner and the City Electrician for review and approval prior to the issuance of a building permit. c. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6, Construction Practices All construction shall be carried out in accordance with the following conditions: 2 4 a. The operation of tools or equipment used in construction or demolition work shall occur in accordance with Salem Ordinance Section 22-2 (5): .Construction and Blasting and between the hours of 8:00 AM and 5:00 PM on weekdays and Saturdays. No work shall take place on Sundays or holidays. The Planning Board will agree to changes in the starting time, at the request of the applicant and if approved by a formal vote of the City Council, as per the ordinance. b. Any blasting,rock crushing,jack hammering,hydraulic blasting, or pile driving shall occur in accordance with Salem Ordinance Section 22-2 (5)• Construction and Blasting and be limited to Monday-Friday between the hours of 8:00 AM and 5:00 PM. There shall be no blasting, rock crushing,jack hammering, hydraulic blasting, or pile driving on Saturdays, Sundays, or holidays. c. Blasting shall be undertaken in accordance with all local and state regulations. d. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. e. All construction vehicles and equipment shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they exit the site. f. The applicant shall abide by any and all applicable rules,regulations and ordinances of the City of Salem. g. All construction vehicles and equipment left overnight at the site must be located completely on the site. It. No Street shall be closed without prior approval of the Department of Planning and Community Development, unless deemed an emergency by the Salem Police Department. 7. Construction Traffic & Phasing . a. All construction will occur on site; no construction will occur or be staged within City right of way. Any deviation from this shall be approved by the Department of Planning &Community Development prior to construction. b. A construction traffic/phasing management plan and schedule shall be submitted to the Department of Planning& Community Development for review and approval prior to the issuance of a building permit. c. Any roadways, driveways, or sidewalks damaged during construction shall be restored to their original condition by the applicant. d. The applicant shall clean construction vehicles before they exit the construction site, and clean and sweep all streets affected by their construction truck traffic as necessary. 3 j . 8. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 9. Salem Health Department All work shall comply with the requirements of the Salem Health Department, if applicable. 10. Office of the City Engineer The applicant, his successors or assigns shall comply with all requirements of the City Engineer 11. Fire Department All work shall comply with the requirements of the Salem Fire Department. 12. Office of the Building Commissioner All work shall comply with the requirements of the office of the Salem Building Commissioner. 13. Traffic Mitigation The developer shall reconstruct Verona Street, which will include the following work: removal and disposal of existing pavement, placement of a new gravel subgrade and compaction, new pavement (270 feet at 22-foot width),new edge treatment in the form of bituminous berms on both sides of the street, and any other necessary miscellaneous items. The proposed drainage of Verona Street shall be reviewed and approved by the City Engineer and the City Planner prior to the start of construction to ensure that stormwater runoff from Verona Street will not drain onto Highland .Avenue due to the proposed improvements. 14. Verona Street Exit The developer,their successors or assigns shall construct an exit only"right turn only"onto Verona Street as far as possible from Highland Avenue as an additional exit for the project. The geometric design of the exit must discourage left turns onto Verona Street and to help ensure that right-tums only will be the only turning movement available. Signage will also be installed to notify drivers of this means of egress from the site. 15. Utilities a.Any utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b.The applicant shall install bollards around the fire hydrant near the entrance drive on Marlborough Road. c.All utilities not being re-used for the project shall be cut and capped as close to the main line as possible on the site. d.The applicant shall repave the portion of Marlborough Road disturbed due to utility installation and construction from curb to curb at the intersection of the entrance drive and Marlborough Road for a distance of twenty-five (25) feet in either direction from the center of the disturbed area. 4 17.Traffic a. The driveway on Marlborough Road shall only allow a right turn exit from the site from 3:00— 6:00 pm Monday through Friday. Traffic shall be free to enter the site at this location from both directions. A left turn egress shall be permitted at this location all other times. An oversized sign detailing this restriction shall be installed at the driveway location. No trucks shall be permitted to enter or exit the site at this location. b. The driveway on Highland Avenue shall allow two-way traffic to enter/exit the site and shall accommodate trucks with a 50-foot wheelbase.. c. All intersections of the driveways and streets shall be designed and constructed to meet the City of Salem Zoning Ordinance(Sec. 7-7)requirements for visibility. Those requirements being that no fence, hedge wall or structure shall be more than three (3) feet high within a triangular area formed by the intersecting street lines and a straight line joining the street lines at points twenty- five (25) feet from the intersection. d. The developer shall return to the Planning Board six (6) months from the issuance of the site's final Certificate of Occupancy to discuss with the Board the traffic circulation of the driveway on Marlborough Road and whether it is operating effectively. If it is not operating effectively, the Board will determine if widening the curb cut to accommodate a double exit,thereby allowing a separate lane for a left turning vehicle, is required to resolve the traffic issues at this drive. 18. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the applicant. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of any landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two-year period. d. The applicant, their successors or assigns, shall empty the dumpsters on the site between the hours of 8:00 a.m. and 5:00 p.m. e. The applicant, their successors or assigns, shall limit their deliveries to a time period from 8:00 am to 7:00 pm only. No deliveries shall be conducted before 8:00 am or after 7:00 pm 19. As-built Plans As-built plans,stamped by a Registered Professional Engineer, shall be submitted to the Department of Planning and Community Development and Department of Public Services prior to the issuance of the final Certificate of Occupancy. The As-Built plans submitted to the City Engineer shall be in electronic file format suitable for the GV/s use and approved bythe City Engineer,prior to the issuance of the final Certificate of Occupancy for the subdivision and/or the acceptance of any streets. 5 A completed tie card,a blank copy(available at the Engineering Departrra'nt) and a certification signed and stamped by the design engineer,stating that the work was completed in substantial compliance with the design drawing must be submitted to the City Engineer prior to the issuance of the final Certificate of Occupancy for the subdivision and/or the acceptance of any streets; as well as,any subsequent requirements by the City Engineer. 20. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Decision shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty(20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
