The plans to improve a portion of the plaza to include a Target store was presented at the regularly scheduled meeting of the Planning Board of the City of Salem held November 21, 2002. The Public Hearing closed on November 21, 2002. At a regularly scheduled meeting of the Planning Board held on November 21, 2002, the Board voted by a vote of(8) in favor(Power, Puleo, Moustakis, Durand, Sullivan, Weiner, Cullen, and Collins), (0) opposed, and one absent (Lombardini) to approve the amendment as complying with the requirements of Site Plan Review pursuant to Section 7-18 of the Salem Zoning Ordinance. The decision to approve this amendment to the original site plan decision approved on July 24, 1997 (attached), does not eliminate any of the conditions or requirements of that decision. All conditions and requirements of that decision are still in effect. The approval of the Board subject to the following conditions: 1. Conformance with the Plans Work shall conform to the original plans entitled, ` Proposed Shopping Center Renovations, Salem MA", dated March 3, 1997, revised through July 24, 1997, July 25, 1999, and November 12, 2002, and prepared by Eastern Land Survey Associates, Inc., 104 Lowell Street, Peabody, MA 01960. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f All construction vehicles left overnight at the site, must be located completely on the site. As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 17. Access to Traders Way The Applicant shall maintain free and open vehicular access between Hawthorne Square and the rear of the abutting shopping area, Highlander Plaza, to allow for access to Traders Way and access to the Proposed Access Road. This access shall be maintained in perpetuity. The original decision is dated July 25, 1997. The Salem Zoning Ordinance states that such approval shall lapse within two years if substantial construction has not commenced, except for good cause. The Salem Planning Board has determined that there is good cause as to why substantial construction has not commenced at the site.
