Joseph Correnti Serafini, Serafini, Darling and Correnti, LLP 63 Federal Street Salem, MA 01970 RE: Hawthorne Common II, 209 Highland Avenue Highland Avenue, Site Plan Review On Thursday, June 5, 2003, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Autumn Development Company, Inc under Site Plan Review for the property located at 209 Highland Avenue. The project is Phase II of the Hawthorne Commons Apartments, which includes the construction of four mid-rise, multifamily apartment buildings that total 108 residential units. In addition, the project call for the construction of two garage structures, one with eight (8) parking spaces and one with nine (9) parking spaces. The remaining 145 parking spaces proposed for the site will be surface parking. The Public Hearing was continued to June 19, 2003 and closed on July 17, 2003. At a regularly scheduled meeting of the Planning Board held on July 17, 2003 the Board voted by a vote of(8) eight in favor(Collins, Durand, Lombardini, Moustakis, Power, Puleo, Sullivan, Weiner), (0) none opposed, to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Conformance with the Plan Work shall conform with the set of plans entitled, "Hawthorne Commons II, Site Development Plans, Salem, MA", sheets 1-10, Rev la, Rev lb, Rev 2a, Rev 2b, 12a, 12b, 13, prepared by H.W. Moore Associates Inc, Mary Smith Associate, and Martin Architectural Group, dated May 13, 2003 revised July 3, 2003 and July 7, 2003. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. b. The signage located at the entrance to the site shall be constructed of wood with carved lettering. 5. Lighting a. Lighting shall be installed as shown on the approved plan. b. No light shall cast a glare onto adjacent parcels or adjacent rights of way. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. d. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall continue beyond 5:00 PM on weekdays and Saturdays. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. C-, There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Board of Health All Board of Health conditions as stated in the attached letter dated July 1, 2003. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 11. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 12. Trash Compactor a. The height of the trash compactor shall not exceed the height of the fenced enclosure for all dumpsters located on the site. b. A recycling area shall be designated and maintained by apartment complex personnel. - -- t�d c. In the event of noise complaints, the applicant, at the request of the Planning Board or the City Planner shall be summoned to appear or meet with either to resolve the complaint. 13. Striping The applicant, his successors, or assigns shall work with the owners of the adjacent retail complex to stripe a pedestrian pathway from the handicap ramp through the parking lot to the front corner of the buildings. The striping of the area will create better, safer access for pedestrians. 14. First Street The applicant, his successors, or assigns shall patch the sidewalk and roadway, as necessary. 15. Memorandum of Understanding The applicant and the City hereby acknowledge that a Memorandum of Understanding, has been executed by the applicant, the City, and the property owner and recorded with the Essex South District Registry of Deeds in Book 20964, Page 51. The Memorandum of Understanding, whose terms shall run with the land until completion of the obligations therein, provides, in part, that the developer of the property shall contribute to the City an amount not to exceed $150,000.00, which funding shall be used as follows: for improvements in the water system serving the area of the development, a comprehensive study of affordable housing in the City, and for use by the Affordable Housing Trust Fund, all as outlined in the Memorandum of Understanding. 16. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 17. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. This decision shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
