MA 01970 RE: Amendment Hawthom Common (formerly Ridgeside Apartments), 205 Highland AVenUe, Site Plan Review On March 1, 2001, an amendment to the Site Plan Review Decision was presented at a regularly scheduled meeting of the Planning Board of the City of Salem held on March 1, 2001, the Board \oted by a vote of seven (7) in favor, none (0) opposed, to approve the amendments as complying with the requirements of Site Plan Review. The original Public Hearing was open by the Planning Board on Thursday, February 17, 2000, regarding the application of Autumn Development Company, Inc. under Site Plan Review for the property located at 205 Highland Avenue. The proposed project includes the demolition of the l'ornier Vincent's Potato Chip plant currently located on the site and the construction of five InUlli-family residential structures, each with 24 units, for a total of 120 units on site. In addition. the plan shows an outdoor swimming pool, and a clubhouse to be constructed on the sitc. The property will have the parking for 180 vehicles on site. The Amended Site Plan iliClUdes 2 uaral'e units located on site. A final lighting plan shall be Submitted to the City planner for review and approval prior to the iSSUance ofa building- pennit. d. After installation, lig-liting shall be revicN\ed by the City planner, prior to the issuance of a Certificate of Occupancy. 7. Conservation Commission All work shall comply with the Order of Conditions issued by the Salem Conservation Commission. S. Construction Practices All construction shall be carried Out in accordance with the following conditions: a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall continue beyond 5:00 PM on weekdays and Saturdays. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left ovemight at the site, must be located completely on the site and not on First Street or Highland Avenue. 1). Clerk of the Works A Clerk ofthe Works shall be provided by the City, at the applicant, his Successors or assi.-ris' expense, as is deerned ricecssary by the City Planner. Fire Department All work shall comply with the requirements of the Salem Fire Department. 12. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 13. Maintenance a. Refuse removal, -round maintenance and snow removal shall be the responsibility of the developer, his Successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 14. Postal Service All postal service, both pickup and delivery, shall be conducted in the clubhouse area. 15. Emergency Exit on Highland Avenue The emergency exit from the site located adjacent to Highland Avenue shall be constructed with slant curbing and a grassed surface. If it is determined by the City Planner that residents and visitors to the site are utilizing the exit for vehicular purposes, the applicant his successors or assigns shall install a gate at the entrance, which will only be utilized by emergency service vehicles. 16. Trash Compactor a. The height of the Compactor located at the south comer of the site shall not exceed the height of the fenced enclosure for all dumpsters located on the site. b. A recycling area shall be designated and maintained by apartment complex personnel. c. In the event of noise complaints, the applicant at the requested of the Planning Board or the City Planner shall be summoned to appear or meet with either to resolve any problems. 17. First Street a. The applicant, his Successors, or assigns shall patch the sidewalk, located on First Street adjacent to the parcel and as shown on the approved site plan, as necessary. In addition the applicant, his Successors, or assigns, shall overlay the sidewalk to the entry way for the development, which is located on First Street, with a minimum of 1'/2 inches of pavement. b. The applicant, his Successors, or assigns shall lay vertical granite Curbing along the parcels' First Street frontagge front the comer of First Street and Highland A%enue to the First Amendment Hawthorne Commons(formerly Ridgeside Apartments) March 1, 2001 - 5 Street entrance way to the site, as shown on the approved site plan. In addition, vertical guranite Curbing shall be laid for approximately three feet after the First Street entranceway to tile site. 18. As-built Plans As-bUilt plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Eng-ineering Department prior to the issuance of the final Certificate Of Occupancy. 19. Violations Violations of any condition shall result in revocation of this perinit by the Planning Board, unless tile violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. This decision shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
