FM.MASS. 141 Highland Avenue Salem, MA 01970 Dear Mr. Romano: The Planning Board voted on June 25, 1986 to approve the proposed subdivision plan entitled, "Subdivision Plan, Emmerton Avenue", dated March 5, 1986, subject to the following conditions: 1. Work shall conform to plans entitled, "Subdivision Plan--Salem, MA. , Emmerton Avenue" dated March 5, 1986. Prior to endorsement of the plan, the plan shall be amended to provide: a. Vertical granite curbing throughout the proposed subdivision as required by the Subdivision Regulations. b. A sidewalk on the northerly side of the street, starting at a location to be defined by the Planning Board, to the walkway, to be defined by the Planning Board, for the house to be constructed on the northerly side of the new roadway. C. A sidewalk on the southerly side of the street, starting at a j location to be defined by the Planning Board, to the walkway, to be fl defined by the Planning Board, for the house to be constructed on the westernmost lot at the terminus of the new roadway. d. A roadway dedication of 47 feet in all locations where sidewalks and planting strips, constructed according to Subdivision Regulations, shall exist on both sides of the street. At all other locations, the roadway dedication shall include a width adequate to provide roadway, curbing, planting strips, and/or sidewalks as defined by the Planning Board. e. Changes required by letter of City Engineer dated April 24, 1986 (attached hereto) . f. A notation that plan is subject to conditions set forth in approval of the Planning Board dated July 21 , 1986. g. Revision of lot lines set forth in plan submitted to Board on June 25, 1986, to show alteration of proposed cul-de-sac and lot configurations at the terminus of the existing Greenway Road, and to reflect alterations defined by the Planning Board regarding roadway dedication. h. At the initiation of the subdivision, and the location at which the subdivision roadway meets the existing Greenway Road, the roadway, planting strips, curbing, and sidewalks shall be blended to meet the existing roadway, as defined by the Planning Board. i . The addition of shade trees as required in Section V-C of the City of Salem Subdivision Regulations. Locations, calipers, and sizes of such shade trees shall be approved by the Planning Department. -2- 2. No further subdivision of any lot shall take place within the subdivision. 3. Each lot within the subdivision shall be subject to requirements set forth in Section VII—R, Site Plan Review, of the Salem Zoning Ordinance. In particular, adequacy of landscaping and screening to mitigate visual impacts of the proposed construction from the existing neighborhood shall be addressed. 4. Placement of fire hydrants shall be subject to the review and approval of the Fire Department. 5. Proposed street name shall be subject to the review and approval of the Fire Department, Planning Board, and City Council. 6. The developer shall work. cooperatively with the Planning Department and Engineering Department to address the drainage problems existing to the rear of 26 Greenway Road. . 7. All construction shall be conducted in accordance with the following: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. Work shall cease at 5:00 p.m. No work shall be conducted on Sundays or holidays. b. Drilling or blasting shall take place between 8:00 a.m. and 4:30 P.m. Monday through Friday only. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. C. Advance notice shall be sent to abutters 72 hours prior to initial commencement of construction of the project. 8. Board of Health requirements set forth in a letter dated April 9, 1986, shall be strictly adhered to. 9. A performance guarantee shall be filed with the Planning Board prior to endorsement of the plan to ensure completion of improvements required under the City of Salem Subdivision Regulations, and as required by this approval. 10. A plan showing the proposed public access to land to be deeded to the City or the Conservation Land Trust as open space shall be submitted to the Planning Department for review and approval. Such plan shall include a pathway for pedestrian use and fencing which may be deemed necessary by the Planning Department for public safety. This plan shall be submitted and approved prior to issuance of a building permit for any structure within the the subdivision. Proposed public access and other improvements to such land shall be constructed or completed prior to issuance of Certificates of Occupancy for any structure within the subdivision. 11. A plan showing proposed landscaping for the buffer area between the subdivision and the existing neighborhood on Emerald Avenue, particularly within the proposed sewer easement, shall be submitted to the Planning Department for review and approval prior to endorsement of -3- the plan. Specifically, screening of the cul-de-sac from the property of Rose B. Petit shall be provided in such landscaping plan, and approved by the Planning Department. 12. The developer shall prepare the legal documents necessary to convey the parcel of land to be preserved as open space to the City or Conservation Land Trust and shall convey such land at such time as directed by the Planning Board. If such dedication has not taken place within six months of the endorsement of the plan, or prior to the sale of the last lot in the subdivision, whichever occurs first, an open space restriction shall be placed upon the parcel by the developer to make certain that such land is preserved as open space in perpetuity. 13. A pre-blast survey shall be required for all homes within the following area: the southern side of Corsage Street, both sides of Castle Road, both sides of Emerald Avenue, and both sides of Greenway Road from 5 Greenway Road in an easterly direction to the terminus of the existing roadway. 14. Utility installations shall be made in accordance with the Salem Subdivision Regulations, Rules and Regulations of the Planning Board and accepted City practices, and requirements of the City Engineering Department . 15. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board. A Clerk of the Works shall be provided at the expense of the developer as is deemed necessary by the Director of Public Services and the City Planner. 16. As—built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to issuance of Certificates of Occupancy. 17. Any violation of these conditions will result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, that it has been dismissed or denied, is recorded in the grantor index under the name of the owner of record or is recorded and noted on the owner' s certificate of title. The fee for recording or registering shall be paid by the owner or applicant.
