The Public Hearing was continued to October 18, 2001, November 1, 2001, November 15, 2001, December 6, 2001, December 21, 2001, January 3, 2002 and closed on January 17, 2002. At a regularly scheduled meeting of the Planning Board held on January 17, 2002, the Planning Board found, based on the information contained in the application and presented at the hearing, that the proposed project satisfied the conditions set forth in Section 7-16(d), Section 7-17(b) and Section 7-18 of the Zoning Ordinance, City of Salem, Massachusetts ("Zoning Ordinance"). At the hearing, the Board voted by a vote of six (6) in favor, none (0) opposed, to approve the application as complying with the requirements for a Special Permit pursuant to Section 7-16 of the Zoning Ordinance, with the requirements for a Special Permit pursuant to Section 7-17 of the Zoninu Ordinance, and with the requirements of Site Plan Review pursuant to Section 7-18 of the Zoning Ordinance, and granted the applicant a Special Permit for the proposed project under Section 7-16 of the Zoning Ordinance, and a Special Permit for the proposed project under One Salem Green, Salem, Massachusetts 01970 (978) 745-9595 ext. 311 Fax (978) 740-0404 Public Storage, Inc. June 11, 2002 - 2 .Section 7-17 of the Zoning Ordinance, and approved the site plan for the proposed project under Section 7-18 of the Zoning Ordinance. On June 6, 2002, an amendment to the original Site Plan Review Decision was presented at the regularly scheduled meeting of the Planning Board of the City of Salem held June 6, 2002, the Board voted by a vote of eight (8) in favor(Power, Puleo, Moustakis, Collins, Sullivan, Weiner, Cullen, and Lombardini), none (0) opposed, to approve the amendment as complying with the requirements of Site Plan Review. The Public Hearing for the amendment was opened by the Planning Board on Thursday, June 6, 2002, regarding the amended site plan application of Public Storage, Inc. pursuant to Section 7- 18 of the Salem Zoning Ordinance under Site Plan Review for the construction of a three-story public storage facility located at 2 and 12 Goodhue. The amended plan incorporates a proposed subdivision of land of approximately 9,934 square feet, located at the rear of the site, to an abutter thus reducing the overall square footage of the site to 114,461. The amended plan includes an addition to the original building footprint of 2534 square feet. The building will house a total of 750 Storage units. Additional drainage is incorporated with associated landscaping and a continuous roof parapet was added to the rear(north) elevation of the building. The Public Hearing closed on June 6, 2002. At a regularly scheduled meeting of the Planning Board held on June 6, 2002, the Board voted by a vote of eight (8) in favor, none (0) opposed, to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. c. A final set of landscaping plans shall be submitted and approved by the City Planner. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. 4. Signage a. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. b. Signage shall be in keeping with the approved plans. c. All construction shall be perfonned in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site. 7. Clerk of the Works A Clerk of the Works shall be provided by the City, at the expense of the applicant, his successors or assigns, as is deemed necessary by the City Planner. 8. Board of Health All Board of Health requirements as specified in the attached decision dated September 19, 2000, shall be strictly adhered to. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Conservation Commission All work shall comply with the Order of Conditions issued by the Salem Conservation Commission. 11. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 12. Utilities a. Underground utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 13. Exterior Elevations a. Final elevations, brick type, and other building materials shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 14. Flours of Operation a. The management of the storage facility shall prohibit the use of any type of business to be operated within and/or out of the confines of the storage facility. The management of the storage facility shall imposed on the storage facility the attached list of restrictions entitled "Proposed Language for Prohibited Items and Use". 16. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 17. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 18. Future Roadway Improvements All land owned by the applicant, his successors or assigns which is located between the 50 foot setback line as shown on the approved plans and Goodhue Street shall be made available to the City in the fixture at a cost of one dollar if deemed necessary by the City Planner for roadway improvements. If the land is utilized in the future by the City for roadway improvements, the applicant, his successors or assigns shall be permitted to maintain access to Goodhue Street from the parcel. 19. Bike Path The applicant shall grant an easement, a minimum of 25 feet in width to the City of Salem for construction of a bike path and other public amenities, which easement shall be located in the area between the east side of the proposed building and the canal abutting the property. In addition, the applicant shall contribute $10,000.00 toward the construction of said bike path and other public amenities including but not limited to vegetation plantings and benches. Final location of the bike path on the parcel shall be determined prior to the start of its construction. 20. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. The leased premises shall not be used for any unlawful purposes and shall be maintained in good condition. 2. No smoking shall be allowed in the units. 3. No property shall be stored on the leased premises unless Occupant legally has a right to have that property in its possession. 4. The storage of welding, flammable, explosive or other inherently dangerous material is prohibited. 5. Occupant shall not store any items which shall be in violation of any order or requirement imposed by the Board of Health, Sanitary or Police Department or other governmental body or do any act which creates or may create a nuisance in or upon or connected with the leased premises. 6. The Occupant shall be limited to storing within the designated spaces good and materials which come under the heading of Use Group S-1 and S-2 as defined by the Massachusetts Building Code 780 CMR 311. The listing of these two groups will be posted in the office of the Owner. By example, those materials and goods which may be stored in the leased space includes, but not limited to food products that are not perishable, glass,metals, porcelain and pottery, cloth,burlap,paper,bamboo baskets,canvas, leather, books,paper in rolls and packs,boots, shoes,cardboard, furniture, furs, linoleum, lumber and wood, silk, upholstery, and mattresses. By example,those materials and goods which may not be stored in the leased premises include but are not limited to petroleum products of all nature and kind,explosives, and any materials or goods that are considered highly combustible. 7. The Owner reserves the right to inspect the leased premises from time to time and to ascertain whether the Occupant is in compliance with the rules and regulations set forth herein. The Owner reserves the right to have removed at the Occupant's expense any and all materials or goods that the Owner finds within the lease space that do not come under the Massachusetts State Building Code Use Group S-1 and S-2. 8.
