" two sheets; Sheet One dated March 13, 1992 with final revision dated December 2 , 1993 and Sheet Two dated October 5, 1993, prepared by Eastern Land Survey Associates, Inc. 2 . UTILITIES a. Utility installation shall be reviewed and approved by the City Engineer . b. Developer will be required to extend the water line from City water main terminus. C. Abutters shall be allowed to connect to the newly constructed water line at their own expense. 4 . If any damage occurs to the abutters water line during construction of the main water line, the developer will be responsible to fix abutters water line. 3 . BOARD OF HEALTH Board of Health requirements set forth in a letter dated September 14, 1993 , shall be strictly adhered to. 4 . CLERK OF THE WORKS The City of Salem Clerk of the Works shall be provided at the expense of the developer as is deemed necessary by the City Planner . 5 . CONSTRUCTION PRACTICES All construction shall be carried out in accordance with the following conditions : a. No work shall commence before 8 : 00 a.m. on weekdays and 8 : 00 a.m. on Saturdays. No work shall continue beyond 5 :00 p.m. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times . b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to al abutters in writing at least 72 hours prior to the commencement of construction. C. During construction appropriate measures will be taken to ensure that the sheeting run-off will be directed onto applicants property. d. Drilling and blasting and hoe-ramming shall be limited to Monday-Friday between 8 :00 a.m. and 5: 00 p.m. There shall be no drilling and blasting on Saturdays, Sundays or holidays. e. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on roadways as they leave the site. f . All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board. 6 . STREET LIGHTING Street lighting shall be reviewed and approved by the City Electrician. 7 . AS-BUILT PLANS As-Built plans, stamped by a Registered Professional Engineer or land surveyor, shall be submitted to the Planning Department and Engineering Department prior to issuance of a Certificate of Occupancy. 8 . VIOLATIONS Violations of any condition shall result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner ' s certificate of title. The fee for recording or registering shall be paid by owner or applicant. It is the intention of the undersigned that it is hereby understood and agreed that this contract shall constitute a covenant running with the land included in the aforesaid subdivision and shall operate as a restriction upon said land. This covenant shall take effect upon the approval of said plan. Reference to this covenant shall be entered upon said plan and this covenant shall be recorded when said plan is recorded. It is understood and agreed that any lot within the subdivision shall be released from the foregoing conditions upon the recording of a certificate of performance executed by a majority of the Salem Planning Board and enumerating the specific lot to be so released. r J 3 . The undersigned represents and covenants that the undersigned is the proposed owner in fee simple of the land included in the aforesaid subdivision and that there is a mortgage of record on the property to Progressive Credit Union of Malden, MA. A mortgagee who acquires titles to the mortgaged premises or part thereof may sell any such lot, subject only to that portion of this covenant which provides that no lot so sold shall be built upon until such ways and services have been provided to serve such lot. 4 . The construction of all ways and the installation of all municipal services shall be completed in accordance with the applicable Rules and Regulations of the City of Salem Governing the Subdivision of Land before December 31, 1994 , unless an extension of time is granted by the Salem Planning Board.
