Site Plan Review Special Permit Elaine Finbury 14 Lynde Street Salem, MA 01970 Re: Essex House Condominiums - 289 Essex Street On Thursday, January 7, 1988, the Planning Board of the City of Salem held a public hearing regarding the application of Elaine Finbury, 14 Lynde Street, Salem, MA, for a Special Permit under Section R, Site Plan Review, of the Salem Zoning Ordinance, for the construction of 41 residential units at 289 Essex Street. At a regular scheduled meeting of the Planning Board held on April 7, 1988, the Board voted by a vote of five in favor, one opposed, to approve the application as complying with the requirements for issuance of a Special Permit, subject to the following conditions: 1. Conformance with Plan Work shall conform to plan entitled, "The Essex House, 289-293 Essex Street, Salem, MA", dated November 23, 1987. 2. Amendments Any amendments to site plan shall require the approval of the Planning Board. 3. Drainage Storm drainage shall be reviewed and approved by the City Engineer. 4. Board of Health All conditions of the Board of Health set forth in a letter dated January 12, 1988, shall be strictly adhered to. 5. Right-of-Way The method in which residents of the Essex House Condominiums shall gain access to their building through the right-of-way in the municipal parking lot shall be reviewed and approved by the City Planner. The egress to the adjacent property, 11 Summer Street, shall also be reviewed and approved by the City Planner. Site Plan Review Special Permit Elaine Finbury 14 Lynde Street Salem, MA 01970 12. Violations Violations of any conditions shall result in revocation of this permit by the Planning Board. This Special Permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner or is recorded on the owner's certificate of title. Landscaping Landscaping shall be installed, subject to review and approval of the City Planner, prior to issuance of Occupancy Permits. 7. Signag e Signage shall be reviewed and approved by the City Planner prior to the issuance of Occupancy Permits. 8. Maintenance Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. 9. Construction Equipment Construction equipment, construction trailers and building materials shall not be stored in the Crombie Street Municipal Parking Lot. 10. Community Development Action Grant The developer shall allow the immediate submission of any and all necessary documents to the Masschusetts Executive Office of Communities and Development for the provision of Community Development Action Grant Funds. 11. Construction Practices All construction shall be conducted in accordance with the following conditions: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. c. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on roadways as they leave the site. d. Construction site shall be secured each night in order to prevent trespassing.
