On Thursday, September 8, 1988, the Planning Board of the City of
Salem held a public hearing regarding pke,application of the Urban
Development Action Group, 5 Pirates Lage,-'Gloucester, MA for a Special
Permit under Section R, Site Plan Review, of the Salem Zoning Ordinance,
for the rehabilitation and constructionof two additional floors at 234
Essex Street.
At a regularly scheduled meeting of the Planning Board held on
September 89 1988, the Board voted by a vote of six in favor, two
abstentions, to approve the application as complying with the requirements
of a Special Permit, subject to the following conditions:
1 . Conformance with Plan
Work shall conform to plan entitled, "Conant Court, Site DevRlQpment
Plan", dated August 10, 1988.
2. Amendments
Any amendments to site plans shall require the approval of the City
Planner.
3. Signage
Signage shall be reviewed and approved by the SRA, DRB and City
Planner.
4. Maintenance
Refuse removal, ground maintenance and snow removal shall be the
responsibility of the developer, his successors or assigns.
5. Landscaping
Landscaping of the site shall conform to plan entitled "Site/Landscape
Plan, Conant Court", dated May 3, 1988, prepared by Robert Ossman,
Landscape Architect.
a. Trees shall be a minimum of 4" caliper. Shrubs shall be a minimum
diameter of 2' .
b• Maintenance of landscape vegetation shall be the responsibility of
1 the developer, his successors or assigns.
c. There shall be no storage of snow on landscaped areas.
6. Board of Health
Board of Health requirements shall be strictly adhered to.
.7. Parking
The developer shall work with and negotiate with the City Planner and
Planning Department to address the need for additional parking to
service the proposed residential units. Such parking shall be provided
in locations as,. required by the Planning Department, and may include
the so—called Sewall Street parking lot and Church Street lot.
8. Construction Practices
All construction shall be carried ou4.Jn accordance with the following
conditions: �^
a_. No work shall commence before 7:Q0 a.m. on weekdays and 8:00 a.m.
on Saturdays. No work shall continue beyond 5:00 p.m. There shall
be no work conducted on Sundays or holidays. Inside work of a
quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative
effects of construction on abutters. Advance notice shall be
provided to all abutters in writing at least 72 hours prior to
commencement of construction.
9. As—Built Plans j
As—built plans, stamped by a Registered Professional Engineer or,Land
Surveyor, shall be submitted prior to the issuance of Certificates of
Occupancy.
10. . Violations
Violations of any of these conditions shrill result in revocation of
this permit by the Planning Board.
This Special Permit shall not take effect until a copy of this
decision bearing the certification of the City Clerk that twenty (20) days
have elapsed and no appeal has been filed, or that if such appeal has been
' filed, and it has been dismissed or denied, is recorded in the Essex County
Registry of Deeds and is indexed in the grantor indes under the name of the
owner of record or is recorded and noted on the owner's Certificate of
Title. The fee for recording or registering shall be paid by the owner or
applicant.
