289 DERBY STREET - ZONING (3) 1 3 APPLICATION / 1 CITY OF SALEM CITY OF SALEM ItERK s oFFieE A, PLANNING BOA � RD >�184 OEC _3 Wetlands & Flood Hazard District Special Permit and Site Plan Review Decision December 2, 2004 289 Derby Street Realty Trust 532 Lowell Street Peabody,MA 01960 RE: 289 Derby Street Site Plan Review Decision&Wetlands and Flood Hazard District Special Permit On Thursday, September 2, 2004, the Planning Board of the City of Salem opened a Public Hearing regarding the application of 289 Derby Street Realty Trust under Site Plan Review and the Wetlands and Flood Hazard District for the construction of a six-story mixed use building with approximately 5,000 square feet of commercial space on the first floor and thirty-eight (38) residential units on the upper floors. The project includes the construction of a portion of the hatborwalk along the South River and the construction of an underground parking facility. The public hearing was continued to September 16, 2004, October 7, 2004, October 21, 2004, November 4, 2004,November 18, 2004 and December 2, 2004. The Public Hearing was closed on December 2, 2004. At the regularly scheduled meeting of the Planning Board held on December 2, 2004, the Board voted by a vote of eight in favor (Power, Sullivan, Moustakis, Puleo, Lombardini, DiGeronimo, Weiner, Collins), none opposed, to approve the application as complying with the requirements of Site Plan Review and the Wetlands & Flood Hazard District subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "Site plan for Town & Country Homes, Inc. of New England, Proposed Condominium& Retail Development,Lot #441, Map #34, 289 Derby Street, City of Salem, Essex County, Massachusetts,"prepared by Bohler Engineering, P.C., 352 Turnpike Road, Southboro, Massachusetts 01772, dated April 28, 2004, and revised July 22, 2004, September 9, 2004, October 7, 2004, and November 1, 2004 including pages 1-17; and the plans entitled, "Proposed Condominiums for 289 Derby Street, Salem, Massachusetts,"prepared by Martins, 130 Sylvan Street, Danvers, MA 01923, including pages ALl A1.2 A1.3, A2.1,A2.2,A2.3,A3.1,A3.2,A4.1, and A4.2, dated 10/20/2004. 120 WASHINGTON STREET, SALEM, MASSACHUSETTS 01970 •TEL: 978.745.9595 FAX: 978.740.0404 ♦ WWW.SALEM.COM 1 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed substantial by the City Planner, shall be brought to the Planning Board for a vote. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Underground Parking a. The applicant shall submit construction plans that are signed and stamped by a registered professional engineer for the underground parking garage to the Department of Planning& Community Development, the Building Commissioner, and the City Engineer for review and approval prior to the issuance of a Building Permit. b. The applicant shall submit specifications for the pumping units that will be installed for the underground parking garage drainage system to the Office of the City Engineer and the Department of Planning& Community Development for review and approval prior to demolition and the issuance of a building permit. 4. Landscaping a. Any proposed landscaping shall be done in accordance with the approved set of plans. b. The applicant shall coordinate with the City of Salem Cemetery& Shade Tree Department for the selection of street trees. The selection and placement of street trees shall be reviewed and approved by the Department of Planning& Community Development prior to installation. c.The final landscaping plan shall be approved by the City Planner prior to the issuance of a building permit. 5. HVAC If an HVAC unit is located on the roof or site, it shall be visually screened. The method for screening the unit shall be submitted to the City Planner for review and approval prior to installation. 6. Noise Following occupancy of the building,if the Department of Planning& Community Development receives any complaints concerning noise emanating from the air conditioner units, the applicant shall be required to show that the decibel level is no higher than the pre- development level and if so, shall submit a plan for review and approval by the City Planner to make any improvements necessary. 7. Signage All proposed signage shall be reviewed and approved by the City Planner prior to the issuance of a sign permit. 8. Lighting a.No light shall cast a glare onto adjacent parcels or adjacent rights of way. b.A final fighting plan shall be submitted to the City Planner and the City Electrician for review and approval prior to the issuance of a building permit. 2 c.After installation, lighting shall be reviewed by the City Planner and the City Electrician prior to the issuance of a Certificate of Occupancy. 9. Pedestrian Warning Device and Signage The applicant shall install signage and a visual warning device to warn pedestrians of vehicular traffic exiting the site. A plan and the specifications for the signage and visual warning device shall be approved by the Department of Planning&Community Development prior to the issuance of a building permit. 10. Department of Environmental Protection The applicant shall adhere to all requirements as set forth by the Department of Environmental Protection and the approved Chapter 91 License. 11. Harbor Walkway The applicant agrees to construct a walkway and associated amenities, meeting the requirements as set forth in the approved municipal Harbor Plan for the City of Salem along the rear property line of the parcel, as depicted on the approved plans. The specific materials, location, landscaping, and additional aesthetic treatments shall be determined by the City Planner. 12. Construction Practices All construction shall be carried out in accordance with the following conditions: a. The operation of tools or equipment used in construction or demolition work shall occur in accordance with Salem Ordinance Section 22-2 (5)' Construction and Blaster and between the hours of 8:00 AM and 5:00 PM on weekdays and Saturdays. No work shall take place on Sundays or holidays. The Planning Board will agree to changes in the starting time, at the request of the applicant and if approved by a format vote of the City Council, as per the ordinance. b. Any blasting,rock crushing, jack hammering, hydraulic blasting, or pile driving shall occur in accordance with Salem Ordinance Section 22-2 (5)• Construction and Blasting and be limited to Monday-Friday between the hours of 8:00 AM and 5:00 PM. There shall be no blasting, rock crushing,jack hammering, hydraulic blasting, or pile driving on Saturdays, Sundays, or holidays. c. Blasting shall be undertaken in accordance with all local and state regulations. d. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. e. All construction vehicles and equipment shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they exit the site. f. The applicant shall abide by any and all applicable rules, regulations and ordinances of the City of Salem. 3 g. All construction vehicles and equipment left overnight at the site must be located completely on the site. h. No Street shall be closed without prior approval of the Department of Planning and Community Development, unless deemed an emergency by the Salem Police Department. 13. Construction Traffic & Phasing a. All construction will occur on site; no construction will occur or be staged within City right of way. Any deviation from this shall be approved by the Department of Planning& Community Development prior to construction. b. A construction traffic/phasing management plan and schedule shall be submitted to the Department of Planning&Community Development for review and approval prior to the issuance of a building permit. c. Any roadways, driveways, or sidewalks damaged during construction shall be restored to their original condition by the applicant. d. The applicant shall clean construction vehicles before they exit the construction site, and clean and sweep all streets affected by their construction truck traffic as necessary. 14. Contractor Parking The applicant has agreed to require contractors to park onsite or in the South Harbor Parking Garage. 15. Curb cuts on State Highways The applicant, if the property abuts a state highway shall obtain a curb-cut permit from Mass Highway prior to the issuance of a building permit. 16. Salem Redevelopment Authority All work shall comply with the requirements of the Salem Redevelopment Authority. 17. Conservation Commission All work shall comply with the requirements of the Salem Conservation Commission 18. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 19. Salem Health Department All work shall comply with the requirements of the Salem Health Department,if applicable. 20. Office of the City Engineer a. The applicant, his successors or assigns shall comply with all requirements of the City Engineer. b. The applicant shall revise the plans relative to the water and sewer connections to the satisfaction of the office of the City Engineer. 4 C. The applicant shall submit the final plans to the office of the CityEngineer for review and approval prior to demolition and the issuance of a building permit. 21. Fire Department All work shall comply with the requirements of the Salem Fire Department. 22. Office of the Building Commissioner All work shall comply with the requirements of the office of the Salem Building Commissioner. 23. Utilities Any utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 24. Crosswalks The applicant agrees to contribute funds in the amount of$15,000 to the City of Salem prior to the issuance of a building permit for the reconstruction of crosswalks adjacent to the parcel on Derby Street. 25. Drainage a. The drainage plan for the site shall be reviewed and approved by the Office of the City Engineer prior to the issuance of a building permit. b. The applicant shall submit a maintenance plan for the Vortechnics unit to the Department of Planning&Community Development and the Office of the City Engineer for review and approval prior to the issuance of a building permit. 26. Maintenance a. Refuse removal,ground maintenance and snow removal shall be the responsibility of the applicant. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of any landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two-year period. 27. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Department of Planning and Community Development and Department of Public Works prior to the issuance of the final Certificate of Occupancy. 28. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Decision shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been 5 fled or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
