General Conditions Under Massachusetts Wetlands Protection Act (only applicable to approved projects) 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title of the affected property. In the case of recorded land,the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. General Conditions Under Massachusetts Wetlands Protection Act 10. Where the Department of Environmental Protection is requested to issue a Superseding Order,the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 15. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or Flagging. Once in place,the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body. The staked erosion control line shall be adjusted, if necessary,during the pre-construction meeting. No clearing of vegetation,including trees,or disturbance of soil shall occur prior to the pre-construction meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. 21. There shall be_hay bales and wooden stakes under cover on the site to be used only for emergency erosion control. EROSION CONTROL 22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specifications provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project; the Commission may require additional measures. 23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment form entering wetland resource areas. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 25. The area of construction shall remain in a stable condition at the close of each construction day. 26. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 27. Within thirty(30)days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer that two months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, F Attachment to Order of Conditions # 64-378 Page 4of 5 exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 31. All waste products,grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 33. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 35. There shall be no pumping of water from wetland resource areas. 36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L Chapter 21A,section 16. AFTER CONSTRUCTION 39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance(COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form.if required by the Conservation Commission at the time of request). (2) A letter from a Registered Professional Engineer certifying compliance of the property with this Order of Conditions. (3) An"As-Built"plan signed and stamped by a Registered Professional Engineer or Land Surveyor showing post-construction conditions within all areas under the jurisdiction of the Massachusetts Wetlands Protection Act. This plan shall include at a minimum: (a) All wetland resource area boundaries with associated buffer zones and regulatory setback areas taken from the plan(s)approved in this Order of Conditions; Attachment to Order of Conditions k 64-378 Page 5of 5 (b) Locations and elevations of all stormwater management conveyances, structures and best management designs, including foundation drains,constructed under this Order within any wetland resource area or buffer zone; (c) Distances from any structures constructed under this Order to wetland resource areas- "structures"include,but are not limited to,all buildings,septic system components,wells, utility lines, fences,retaining walls,and roads/driveways; (d) A line delineating the limit of work-"work"includes any filling,excavating and/or disturbance of soils or vegetation approved under this Order; 40. The site is bounded by Derby Street to the north, a commercial building to the east, the South River to the south and Hess Oil to the west. See Figure 1, Locus Map. The site has historically been used for ' industrial purposes and today houses the Coastal Oil service station which includes a 2,000 square foot (sf) single story brick service building, a small, 200 sf shed building, two gasoline pumps and a taxi cab service and automobile/truck storage area in the rear of the ' property. See Figure 2, Existing Conditions Plan. t The project site is located on Derby Street, a commercially developed area and is in close proximity to the recently expanded Peabody Essex Museum, Pickering Wharf and the Salem National Maritime site along Salem Harbor. ' 2 PROJECT SUMMARY The proposed 289 Derby Street project (hereinafter referred to as "the project") involves the demolition of the existing Coastal Oil service station and construction of a single, six story ' mixed use building with 38 housing units, 2,200 square feet (sf) of commercial space fronting on Derby Street and an additional 2,660 sf of un-programmed facilities of public accommodation facing the South River. Parking for 57 cars is provided through a ' combination of a below ground parking level, ground floor parking and exterior surface parking. A Harborwalk is proposed along the South River which will connect to Derby ' Street along the west side of the site via a 5-foot wide pedestrian path. See Figure 3, Project Site Plan, Figure 4, Ground Floor Plan and Figure 5, Parking Garage Plan. ' The building has undergone significant design review by the Salem Redevelopment Authority and has been designed with the first two floors directly abutting Derby Street thereby continuing the existing street edge in this area. The upper floors are set back 7 feet ' from the street edge to minimize the impact of the six story building at the pedestrian level. The 21 foot high base of the building matches the adjacent 20 to 24 foot high buildings. The design and materials used for the lower two floors along Derby Street will complement ' the existing commercial buildings and create a differentiation between the lower and upper floors of the proposed building. ' The site plan provides approximately 9,500 sf of open space including a Harborwalk along the South River. See Figure 6, Building Perspective, Figures 7 and 8, Building Elevations, ' Figure 9, Building Section and Figure 10, Harborwalk and Plaza Sections. ' Page 1 ' 289 Derby Street Chapter 91 License Application Project Description ' The project will provide public access to and along the South River with the addition of a continuous Harborwalk, including a pedestrian connection from Derby Street to the ' Harborwalk along the west side of the site. ' 3 CONSISTENCY WITH STATE CHAPTER 91 PROGRAM JURISDICTION According to the Chapter 91 jurisdictional line contained in the City of Salem Municipal Harbor Plan (SMHP), the site is comprised entirely of filled, formerly flowed tidelands with the original shoreline approximately coincident with the southerly side of Derby Street. See Figure 11, Designated Port Area and Chapter 91 Designation. The original low water line is presumed to be located approximately 18 feet seaward of the site parcel based on a low ' water line depicted on a plan of proposed dredging in the South River, prepared by the Commonwealth of Massachusetts Harbor and Land Commissioners Office in December 1908 (see also License # 9727 issued to Amerada Hess Corporation on May 30, 2003). ' Thus, the entire site is filled private tidelands. ' 3.1 COMPLIANCE WITH CHAPTER 91 STANDARDS The proposed development project is nonwater-dependent pursuant to 310 CMR 9.12(4) of the waterways regulations because it consists of a residential development. As stated in M.G.L. Chapter 91 Section 18, "no structure or fill for a nonwater-dependent ,use of tidelands may be authorized unless a .written determinationby the Department [of Environmental Protection] is made following a ' public hearing that said structures or fill shall serve a proper public purpose and that said purpose shall provide a greater public benefit than detriment to the rights of the ' public in said tidelands..." Pursuant to 310 CMR 9.31(2)(b) of the Waterways regulations, DEP presumes that the referenced requirement is met if the project complies with the nonwater-dependent use standards of 310 CMR 9.51 - 9.53, and ' is consistent with the policies of the Massachusetts Office of Coastal Zone Management (CZM). ' The following paragraphs describe the project compliance with the existing, applicable Chapter 91 standards outlined in 310 CMR 9.00 and the applicable Chapter 91 substitute standards and offsets contained in the SMHP as approved by ' the Secretary of the Executive Office of Environmental Affairs. See Figure 12, Chapter 91 Compliance Plan. COMPLIANCE WITH CHAPTER 91 REGULATIONS The project complies with the following standards of the existing Chapter 91 regulations. ' Page 2 1 289 Derby Street Chapter 91 License Application Project Description ' 310 CMR 9.51, WATER-DEPENDENT USE ZONE In accordance with 310 CMR 9.51, the project must preserve the site's capacity to ' serve water-dependent uses. This standard is met by ensuring that any nonwater- dependent building(s) and at-grade parking are set back from the waterfront, a sufficient amount of open space is provided on-site and buildings are relatively ' modest in size along the immediate waterfront. Under the Chapter 91 regulations, the water-dependent use zone (WDUZ) runs parallel to the project shoreline and is equal to 25% of the distance from the high water mark to the landward property line, and can be no less than 25 feet, and no more than 100 feet. Calculated in this manner, the WDUZ extends approximately 50 feet from the shoreline into the ' project site. The project building is set back approximately 50 feet from the shoreline and no at-grade parking is provided within the WDUZ. ' 310 CMR 9.51 (3)(B), FACILITIES OF PRIVATE TENANCY(FPTS) In accordance with 310 CMR (3) (B), Facilities of Private Tenancy are not allowed ' on the ground floor of a nonwater-dependent building located within 100 feet of the project shoreline. The portion of the building footprint located within 100 feet of project shoreline is programmed for facilities of public accommodations. ' While the project is located on filled private tidelands, wherein the public's rights of access are limited to fishing, fowling and navigation, the open space and pedestrian ' facilities at the project site will be open to the general public 24 hours per day. Of the approximately 12,890 sf of the site located within 100 feet of the project shoreline, approximately 11,800 sf or 92% is comprised of publicly accessible open ' space, landscaping and public access. The remaining area will be used for an access ramp for subsurface parking. 310 CMR 9.51(3)(D) OPEN SPACE In accordance with 310 CMR 9.51(3)(d), no more than 50% of the project site may be occupied by nonwater-dependent use buildings. The regulations require that, at a minimum, one square foot of open space be provided on the project site for each square foot of tidelands occupied by the footprint of buildings containing nonwater- dependent uses. The project uplands consist of approximately 25,043 square feet (sf). As proposed, the residential building will occupy approximately 12,400 sf or ' 49.5% of the site thereby keeping at least half of the project site free from nonwater- dependent buildings. ' 310 CMR 9.51(3)(E), HEIGHT In accordance with 310 CMR 9.51(3)(e) building heights cannot not exceed 55 feet within 100 feet of the high water mark. Landward of 100 feet from high water, ' building heights may increase at a ratio of 1 vertical foot for every two additional horizontal feet. The proposed building height ranges from approximately 55 feet within 100 feet of the high water mark; to approximately 65 feet within 7 feet of Derby Street; and to 20 feet along Derby Street. ' Page 3 ' 289 Derby Street Chapter 91 License Application Project Description ' 310 CMR 9.52(2)(8) PEDESTRIAN ACCESS NETWORK The proposed sidewalk from Derby Street to the Harborwalk on the western site ' boundary and the proposed Harborwalk along the South River enable the project to meet the pedestrian access network requirements of 310 CMR 9.52(2)(b). ' 310 CMR 9.53 COMMONWEALTH TIDELANDS Because the site is privately owned and constitutes private rather than ' Commonwealth tidelands, the provisions of 310 CMR 9.53 pertaining to water- dependent activity, exterior open space and facilities of public accommodation do not apply. ' 3.2 COMPLIANCE WITH SALEM MUNICIPAL HARBOR PLAN SUBSTITUTIONS AND OFFSETS ' In addition to complying with the existing baseline Chapter 91 regulations described above, the project also complies with the general planning guidelines of ' the Salem Harbor Plan. While the Harbor Plan includes two Chapter 91 substitute provisions that allow a reduction in the extent of the water dependent use zone and provision of open space,' the project does not take advantage of these substitutions. ' The Harbor Plan divides the waterfront into five geographic districts. The project site is located in the South Commercial Waterfront District, which includes the ' South River between Derby Street and Peabody Street as well as the Pickering Wharf and Marina and the water's edge of Shetland Mills and Palmer Cove. Land ' uses along the South River consist of commercial, utility and municipal uses. See Figure 13, South Commercial Waterfront Guidelines. ' The Harbor Plan includes areawide and district-specific recommendations. Among the areawide recommendations is the implementation of the °Salem Harbor Walk" which in the South Commercial Waterfront District is proposed to run along both ' sides of the South River wherever physically feasible. The Harbor Plan also suggests that pedestrian connections between the downtown, the waterfront and the "Point" neighborhood be created. The existing service stations and Mass Electric ' substation located along the South River currently impede such connections. The Harbor Plan recommends an incremental approach to revitalizing the South ' Commercial Waterfront into a mixed-use area. The project achieves these public access goals by providing a Harborwalk along the South River and a pedestrian connection from the Harborwalk to Derby Street. ' The Harbor Plan also recommends activation of the South River watersheet for recreational boating including the provision of floating docks on both sides of the ' river as well as a dinghy dock facility. As noted in the Harbor Plan, the shallow The Harbor Plan allows individual parcels bordering on the South River to provide less than 50% open space provided that when aggregated, the overall open space of the properties is at least 50%. ' Page 4 I ' 289 Derby Street Chapter 91 License Application Project Description ' water depths which average 5.5 feet at mean high water (or 1.0 foot at mean low water) currently present a limiting factor to boating use in the South River. The project proponents have agreed to make a financial contribution of $10,000 to the City of Salem's Watersheet Activation Fund established to provide future watersheet activation. ' 3.3 SUMMARY ' As the foregoing discussion demonstrates, the project is in compliance with the state Chapter 91 regulations as modified by the Salem Harbor Plan. The site design and program will significantly enhance the waterfront environment along this portion of the South River. Consistent with goals of Chapter 91 and the Salem Harbor Plan, the public will benefit from public realm improvements that provide public views, ' open space and access to and along the waterfront. 4.0 EXTENDED LICENSE TERM The Applicant has requested an extended term license for the proposed project. An extended term is warranted in accordance with the criteria established in 310 CMR ' 9.15(1)(b). The project site is located on filled tidelands, upon which, the Department may issue a license with a maximum term of 99 years. As detailed in a letter dated September ' 9, 2004 from the Martins Design Company, LLC, the project Architect, the expected design life of the proposed building is over 65 years with proper care and maintenance (see Exhibit 1). ' Furthermore, the long-term dedication of the project site to nonwater-dependent use is appropriate in this instance. The project site has not been used to support water-dependent ' use since the early 1900's and has been used for commercial uses since then. The project has also been carefully designed to be consistent with federal; state, and local regulatory ' requirements. As indicated in a letter dated September 9, 2004 from the potential lender, a minimum term of 65 years is required (see Exhibit 1). The site is bounded by Derby Street to the north, a commercial building to the east, the South River to the south and Hess Oil to the west. See Figure 1, Locus Map. The site has historically been used for industrial purposes and today ' houses the Coastal Oil service station which includes a 2,000 square foot (sf) single story masonry service building, a small 200 sf shed building, two gasoline pumps and a taxi cab service and automobile/truck storage areas in the rear of the property. See existing conditions shown Sheet 1 of 1, Boundary and Topographic Survey. ' Project Summary The proposed 289 Derby Street project (hereinafter referred to as "the project") involves the demolition of the existing Coastal Oil service station and construction of a single, six story mixed use building with 38 housing units, 2,200 square feet (so of ground floor commercial space fronting on Derby Street and an additional 2,660 sf of un-programmed ground floor facilities of public ' accommodation facing the South River. Parking for 57 cars is provided through a combination of a below ground parking level, ground floor parking and exterior surface parking. A Harborwalk is proposed along the South River which will connect to Derby Street along the west side of the site via a 5-foot wide pedestrian path. See Sheet 2 of 11, Site Plan. t Activities Within State Wetland Resource Areas The only resource area on the project site is Land Subject to Coastal Storm Flowage (LSCSF) which occupies about 50% of the site and extends up to elevation 10. The South River, which is adjacent ' to the site, contains Land Under Ocean (LUO). See Sheet 3 of 11, Wetland Resource Areas Plan. Activities proposed within LSCSF and the 100-foot Buffer Zone to the South River LUO Resource ' Area include: ■ demolition of the existing Coastal Oil Building and removal of underground tanks ' and gasoline dispenser(see Sheet 4 of 11, Demolition & Erosion Control Plan); a installation of foundation and construction of subsurface parking structure (see Sheet ' S of 11 Underground Parking Plan); building construction and installation of utilities (see Sheet 6 of 11 Drainage & Utility Plan); and ' m site grading and landscaping (see Sheet 7 of 11 Grading Plan and Sheet 8 of 11 Landscaping Plan). ' NOI 289 Derby Street Page 2 Demolition Activities ' The existing Coastal Oil service building will be demolished and the materials removed to a licensed landfill in accordance with state regulations (see Sheet 4 of 11, Demolition & Erosion Control Plan). The existing fuel dispensing and storage facilities will be decommissioned and closure documentation provided in accordance with the state Department of Environmental Protection (DEP) underground storage tank closure assessment manual dated April 9, 1996 (DEP Policy WSC-402-96). All fluids and sludges will be removed from the tanks and dispensing ' facilities and the tanks wiped clean by hand with a cloth prior to removal. Fuel will be recycled off site. The tanks will then be iced down with dry ice prior to removal and transport to the Turner ' Salvage facility in Lynn, MA. As required by state regulation, a Licensed Site Professional (LSP), who will examine the soil and ground water for presence of any contamination, will be present at the site during the entire decommissioning process. If contamination is found to be present to the ' extent that would require reporting to the DEP, investigations and clean up response actions would then follow. ' Prior to demolishing the building, lead paint and asbestos assessment surveys will be undertaken to determine the proper management of building demolition materials. If such substances are found, they will be abated in accordance with the State Department of Public Health regulations and ' disposed of in a lined landfill licensed by DEP. Foundation and Parking Structure While the structural analysis for the building foundation has not been completed, it is anticipated that a series of piles will be driven to refusal and once the pile driving is complete, a slurry wall ' would be installed to form the floor and walls of the below grade parking structure. Concrete would then be placed to create the parking deck, walls and ramps (see Sheet 5 of 11 Underground Parking Plan). ' Utility Installation ' While the parking structure is being constructed, water, sewer, electrical and telecommunication utilities will be extended from Derby Street into the site. ' All of the site stormwater will be directed to the South River which will reduce the stormwater burden on the existing City system in Derby Street. Prior to discharge, the stormwater will be directed through a vortechnic stormwater quality treatment unit. (See Sheet 6 of 11 Drainage ' & Utility Plan and Sheets 9 through 11 of 11, Construction Details. Building Construction, Final Grading and Landscaping ' Building construction will begin once the garage is completed. Once the building is constructed and utilities are installed, final site grading and landscaping including the construction of the ' Harborwalk and pedestrian walkways will occur.
