At a regularly scheduled meeting of the Planning Board on November 7, 1985, the Board voted, by a vote of six in favor, one opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Work shall conform to plans accompanying Wetlands and Flood Hazard Special Permit application dated September 30, 1985. Plans prepared by Sasaki Associates, Inc. , dated April 8, 1981 . 2. Work shall further conform to all conditions set forth in an Order of Conditions approved by the Salem Conservation Commission, dated October 24, 1985. 3 . This order does not grant any property rights or exclusive privileges; it does not authorize any injury to private/public property or any invasion of public/private rights. I hereby certify that a copy of this decision and plans have been filed with the City Clerk and copies are on file with the Planning Board. This Special Permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or- is recorded and noted on the owner' s certificate of title. (Reference : Marina Plan by Sasaki Associates , Revision of 4-1-81) METHODOLOGY: 1) Observations and photographs , summer of 1982 . 2) Research on topographical history of area. 3) Test pits at base of wall. 4) Test boring program. 5) Interviews with marine contractor and engineer. 6) Structural calculations . Field Data (rod probes) . 5) Structural Engineering Calculations dated 10-1. 6) North Wall 'Elevation (11" X 17" sheet) . 7) Section View Looking East DESCRIPTION OF TESTING PROGRAM: Exploration of the relevant terrain including a verification of bottom of wall location was made using a combination of hand dug test pits and selected test borings. Three borings were taken at low tide using a portable drilling rig . Results of this program are attached. Wall Stability -2- 12-28-82 CONCLUSIONSs 1) EXISTING STRUCTURE As indicated in Reference #7, the existing stone wall is a continuous support element for the six-story concrete structure , Such Imposed vertical loads acting on the top of the wall strongly favor wall stability . Accordingly, the stone foundation may be considered laterally restrained at the top . 2) WALL DRAINAGE The open pointed composition of the wall allows for a free drainage of tidal waters in the receding phase . Such can be observed clearly at the site during outgoing tide . The building up of undesireable wet earth pressures against the Inside of the wall is minimized. 3) SOIL COMPOSITION The test borings revealed the presence of moderately dense sand-gravel material generally from the level of the wall bottom downward . Below that, so-called refusal of the boring probe was reached between 12 and 16 feet, indicating the existance of hardpan or soft rock at those levels . Such materials offer good resistance to vertical pressures and to horizontal sliding tendencies . 4) FOUNDATION TYPE The bottom of the wall was ident- ifted by test digging and probing with rods and is located as shown on Reference #7• While the presence of piling could not be confirmed, the soil materials present in the area would suggest a possible combin- ation of piling and continuous wall soil bearing . Wall Stability - 3 - 12-28-82 5) SOIL BEARING PRESSURE VECTOR The attached calc- ulations reveal that the ratio of horizontal earth pressure to vertical gravity loadings Is such that the resultant pressure vector is markedly downward . Such a fact is favorable to lateral stability of the wall base , particularly where the earth near the base of the wall is counted on to resist .outward movement in the event of the dredging removal of .existing materials as proposed. 6) PROTECTIVE EARTH BERM In accordance with standard foundation design. practice regarding earth bearing footings , a protective slope of undisturbed earth called a berm (or anequivalent means ) is recommended. Such an element serves the purpose of providing standard resistance to frost penetration at extreme low. tides in winter, and also safeguards against long-term erosion of soils at the base of the wall. SUMMARY CONCLUSIONt On the basis of this analysis , the author confirms that a dredging configuration as shown on Reference #7 anllncluding the protective feature noted above will not adversely affect the existing building wall. Two-foot contours of the existing and proposed land surface; 4. Location of existing and proposed structures, water-courses, drainage and drainage easements, means of access, utilities, and sewer disposal facilities including leaching fields, if any. Proposed elevations should be noted. 5. Boundaries of all districts, areas and zones as noted in Section I. I -2- B. In the Wetlands District, a determination by a qualified engineer of the seasonal high water table, performed during the last two weeks of March or the first three weeks of April. A minimum of two percolation tests for each leaching area shall be performed. C. In cases of flood-proofing or pile construction, certification by a registered professional engineer or architect as to the elevation of flood-proofing measures and as to compliance with the applicable sections of the Massachusetts State Building Code concerned with flood depths, pressures, velocities, impact and uplift forces, and other factors associated with the base flood. Where specific methods or techniques have been previously certi- fied, the Planning Board may waive this requirement. D. A list of Federal, State, and other local permits required by the applicant. Procedure The Planning Board shall, within 7 days after the filing of this application, transmit one copy of said application, plans and all other submitted information to the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission who may, at their discretion, investigate the application and report in writing their recommendation to the Planning Board. The Planning Board shall not take final action on such application until it has received a report thereon from the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission or until thirty-five (35) days have elapsed after dis- tribution of such application without a submission of a report. The Planning Board Shall hold a Public Hearing on said application as soon as possible after receiving the above reports, in accordance with Chapter 40A of the Massachusetts General Laws. The Planning Board shall notify the applicant in writing of its decision on the special permit. The decision shall document the proposed development or use and the grounds for granting or refusing the special permit. The -6- Planning Board may, as a condition of approval, require that the appli- cant give effective notice to prospective purchasers, by signs or by recording the special permit at the Registry of Deeds, of the wet- land or flood hazard conditions associated with said premises and the steps undertaken by the petitioner or hi'3 successor in title to alleviate the effects of same.
