This action came to be heard before the Court, Ronan, J.
presiding, upon the motion of the plaintiffs Robert Gerolamo and
Barbara Gerolamo for summary judgment pursuant to Mass. R. Civ. P.
56, the Court finds that there is no genuine issue as to material
fact, and that the plaintiffs Robert Gerolamo and Barbara Gerolamo
are entitled to a judgment as a matter of law.
It is hereby Ordered that ;
the decision of the Board of Appeals of the City of Salem is annuled
The Clerk/Magistrate of this Court shall within 30 days send an
