The proposed project involves the renovation to the existing three story old police station to a fourteen unit,two-bedroom condominium complex and the construction of additional square footage above to the existing wing on Charter Street. Additionally, the jail cell wing of the build will be demolished to provide parking for 28 parking spaces. The Public Hearing was continued to January 17, 2002, February 7, 2002, February 21, 2002, March 7, 2002,March 21, 2002 and closed on April 4, 2002. At a regularly scheduled meeting of the Planning Board held on April 4 2002, the Planning Board, based on the information contained in the application and presented at the hearings, voted by a vote of eight (8) in favor, none (0) opposed to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Conformance with the Plan Work shall conform to the plans entitled, " Renovation for the Old Salem Police Station, Salem, MA" Sheets A-1 thru A-8,prepared by Neshamkin French Architects, Inc., 5 Monument Square, Charlestown, MA 02129, dated 10-10-01 and revised in accordance with the decisions and requirements of all other applicable Boards and Commission in the City of Salem. Revised Plans reflecting these changes must be submitted and approved by the City Planner prior to the issuance of a building permit. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. c. A final set of landscaping plans shall be submitted and approved by the City Planner. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. After completed, the City Planner shall review the parking lot area to determine whether additional trees are necessary. 4. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. The applicant shall install two (2) City of Salem standard period lights, one (1) on Central Street and one (1) on Charter. The two (2) new lights shall replace the existing cobra light fixtures located in these areas. Following installation, the City will take over --maintenance ofthe-street-lighting. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. It is expected that two City of Salem standard period lights will be installed in the parking area. This light shall be shown on the final lighting plan. d. After installation, lighting shall be reviewed by the City Planner,prior to the issuance of a Certificate of Occupancy. 5. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules,regulations and ordinances of the City of Salem. ti f. All construction vehicles left overnight at the site, must be located completely on the site g. All construction activities shall be in accordance with the attached"Salem Police Station Construction Management Plan". 6. Noise Following occupancy of the building, if the Department of Planning & Community Development receives any complaints concerning noise emanating from the air conditioner units, the applicant'shall be required to conduct a noise test at 2 AM on a date specified by the City Planner. If the test determines that the decibel level is higher than (3 DB)the level at pre-development, the applicant shall make improvements as required by the City Planner, to return the decibel to its pre-development level. 7. Clerk of the Works A Clerk of the Works shall be provided by the City, at the expense of the applicant, his successors or assigns, as is deemed necessary by the City Planner. —" 8. Performance Bond The applicant is required to post a performance bond for the cost of the construction of the project as shown on the approved plans. A bond has been required as part of the Salem Redevelopment Authority's sale of the parcel as well. There shall only be one bond required for the project, thus the applicant shall submit a copy of the performance bond, with approval of the Salem Redevelopment Authority, to the City Planner prior to the issuance of a building permit. 9. Salem Redevelopment Authority All requirements as set forth by both the Salem Redevelopment Authority and its Committee, the Design Review Board, shall be strictly adhered to. Violation of SRA requirements shall be considered a violation of the Site Plan. 10. Sidewalk Repair The applicant,his successors, or assigns shall repair five sidewalk panels on the walk located adjacent to the structure on both Charter Street and Central Street. The applicant shall submit a plan showing the five panels to be repaired and the method and material for repair to the City Planner for approval. The sidewalk repair shall be completed by the applicant prior to the issuance of a certificate of occupancy. I 17 Central Street(Old Police Station). Apri 4,2002-4 11. Access Agreement An access agreement will be drafted with Red's Restaurant for the dumpster and location of the dumpster. This agreement shall be recorded with the property title at the Registry of Deeds and a copy provided to the City Planner prior to the issuance of the build permit. 12. Window Treatment Consistent window treatment cover, a copy of the covenant shall be provided to the City Planner prior to the issuance of the building permit. 13. Board of Health All Board of Health requirements as specified in the attached decision dated January 9, 2002, shall be strictly adhered to. 14. Fire Department All work shall comply with the requirements of the Salem Fire Department. 15. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 16. Utilities a. Underground utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 17. Exterior Elevations a. Elevations shall be in keeping with the approved plans. b. Final elevations, brick type, and other building materials shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 18. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 19. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 17 Central Street(Old Police Station). Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title. The owner or applicant, his successors or assigns, shall pay the fee for recording or registering. Walter B Power, III Chairman Salem Police Station Construction Management Plan 1. Charter Street— The developer will not close Charter Street during construction, with the exception of the day of the water service connection for a period of one-day. Due to the number of times that Charter Street is closed by the Peabody-Essex Museum, it is likely that the developer can coordinate this water service connection with the Peabody-Essex to ensure that it occurs on a day that they require closing the street. We will require staging along the sidewalk of Charter Street to allow the pointing of the brick, construction of the carriage house units and perhaps window installation. This will not close the street and will be done in accordance with all local regulations relating to police protection and notification. 2. Construction Vehicles— Construction vehicles will park on-site during the construction period. There are currently several spaces on-site and this number will increase following demolition of the rear building. We have met with the Ward Councilor and have agreed that the demolition will be completed in a timely manner to ensure that the construction workers will be able to park on-site. Further, all construction workers who do not use their vehicles during the day will either park on our site or in an off-street parking facility. 3. Abutting Parking Lot& Dumpster— Our attorney has reached agreement in principle with our abutting neighbors regarding the rear parking lot that is accessed across our parking lot. We have agreed to pave their parking lot, provide them with a deeded easement (an improvement over their existing non-deeded right of passage) and replace their fence along their property line. Documents memorializing ese agr dents are being prepared. Also, we have agreed to allow Red's Sa dw' Shop to place a dumpster on our property. During the construction peri d e have agreed to allow Red's to maintain the dumpster in its existing location. Documents memorializing this agreement are being prepared. 4. Demolition— The demolition of the rear addition will be completed as early as possible to create a parking and staging area on our property. At its regular meeting on June 15, 2006, the Planning Board heard and agreed to the following remediation items for the site to complete the requirements in the decision for signing off on the final Certificate of Occupancy: 1. Landscaping Plan A new landscaping plan must be submitted and approved by the City Planner prior to issuance of the C.O. 2. Fencing The fencing to screen the dumpsters adjacent to Red's Sandwich Shop will be installed, and the location shall be marked on revised plans. 3. City of Salem Period Lights Two period lights for Charter Street and Central Street have been ordered and will be installed in 4-8 weeks. The lights will be installed by the City of Salem Electrical Dept, at the developer's expense. 4. Two City of Salem Period Lights in the Rear Parking Area The developer will install one light, of similar appearance to the existing single light in the rear parking structure near the electric utility box adjacent to Red's Sandwich Shop. An additional double-headed light of similar design will be installed in the rear parking area near the current location of the single light. The design of these lights will be agreed upon between the developer and the homeowners association,as well as the Salem Redevelopment Authority (SRA) and/or the Design Review Board (DRB). 5. This fence will be installed by Judie Burke, a resident of Museum Place at her own expense within the next 2-3 weeks. 6. Exterior Lights An exterior light currently located near the comer of Central and Charter Streets on the Charter Street side will remain in its current location,per agreement of the homeowners association and the developer. Additionally, the existing 15 or so metal halide lights will be replaced with a design agreeable to the homeowners association and the SRA/DRB. 7. As-built Plans As-built plans must be received by the Department of Planning and Community Development. These plans should show the grading and drainage plan as requested by Mr. Nerden in the Department of Public Works, and show all of the above referenced changes. The Planning Board has also requested that the developer report back to the Planning Board by August 3, 2006 with the progress of these items.
