Included with this letter are 1. Plan Cex, this is a plan of the structure as it exists now, with zero setback, an exit door facing my abutter's property, and a window facing my abutter's property. 2. Plan C1, which proposes the removal and relocation of the exterior wall 12" from the property line of the side yard, relocation of the exit door from side yard to back yard, removal of a window from the side yard location, and cut back of the fascia flush with exterior wall. 3. Plan C1 a, which proposes removal and relocation of the exterior wall 18" from the property line of the side yard, relocation of the exit door from side yard to back yard, removal of a window from the side yard location, and cut back of the fascia flush with exterior wall. 4. Photographs of the existing structure. I was denied by the Board of Appeals due to the fact that I possibly had an underground footing on my abutter's side of the property line, and that the overhang of the roof is over the abutter's property. If not for the possibility of the footing, I believe the Board would have granted a variance for the structure with the stipulation that I relocate the window and the door facing my abutter's property. Unaware of how the system works, I did not realize I could have asked ask for an abatement of their ruling until the ground thawed, and the foundation could be exposed for the Board's inspection. As a result, I am requesting your favorable determination of one of the two proposals. Please keep in mind, the side yard has always been the location of my second means of egress. Additionally, there was always an above grade walkway leading from the second means of egress to the driveway and backyard. Finally, outside of that retaining wall was a walkway and privacy fence that lead to the first floor/basement apartment and back yard. In essence my removal of the crumbling old wall and walkway has corrected a fifty year old encroachment on my abutter's property. I have owned the property since 1987. At the meeting on June 3, 2004, the applicant requested to withdraw his application without prejudice. The Planning Board under the provisions of Chapter 40A, Section tG gcmted the request to withdraw the petition without prejudice by a vote of nine (9) in favor (Power, Puleo, MOUstakls, Durand, Sullivan, Lombardini, Weiner, DiGeronimo, Collins), and none (0) opposed.
