I hereby certify that, pursuant to Massachusetts General Laws, the Salem Planning Board
has taken the following action with respect to the above referenced subdivision.
By a vote of seven (7) in favor, none (0) opposed, the Planning Board approved the
proposed subdivision plan as presented with the attached conditions.
Notice of the Planning Board's action and the reasons supporting it are more fully
described in the attached copy of a letter, the original of which was sent to the applicant by
certified mail, postage prepaid, at his address on the petition.

DECISION
Definitive Subdivision Plan

Dear Mr. & Mrs. Singleton:
On October 5, 1995, the Salem Planning Board opened a public hearing for the proposed
extension of the roadway and utilities to allow for the construction of a single family dwelling at 1
Brooks Street. On October 19, 1995, the Planning Board closed the public hearing and made the
following findings of fact: 1) Whereas the petitioners lot is the last lot that can be developed on Brooks
Street; 2) Whereas abutters have opposed the petition on the basis that the extension of the paper street
will encroach on existing uses; and 3) Whereas this encroachment can be maintained by extending the
paper street by only fifty (50) feet. Now, therefore the Planning Board agrees to permit the extension of
the paper street by only 50 feet. The Planning Board voted by a vote of seven (7) in favor, none (0)
opposed to approve the subdivision plan subject to the following conditions:
I. Conformance with Plan
Work shall conform to plan entitled"Definitive Subdivision Plan, Brook Street, Salem, MA",
prepared by Eastern Land Survev Associates, Inc., dated July 1, 1995, revised October 16, 1995,
and revised October 25, 1995.
2. Utilities
Utility installation shall be reviewed and approved by the City Engineer.
3. Board of Health
All requirements of the Board of Health approval of October 10, 1995 shall be strictly adhered
to.
4. Conservation Commission
The Applicant, his successors or assigns shall comply with all requirements of the Salem
Conservation Commission.
5. Tree Removal
a. The Applicant shall flag all trees proposed to be removed from the site and obtain
written approval from the Planning Department prior to any tree removal. The Applicant
shall attempt to keep as many trees as possible in order to provide proper screening for
the surrounding properties.
b. If trees abutting the property at 3 Brooks Street are removed, the Applicant shall install a
fence and/or landscape buffer between the site and abutting dwelling at 3 Brooks Street.
Such screening shall be approved in writing by the City Planner.
6. Parking
There shall be no parking within the turnaround easement area as shown on the approved plan.
7. House Location
The front door of the proposed dwelling shall be parallel to Brooks Street.
8. Hvdrant
A Darling hydrant shall be installed at the end of the pavement. The hydrant shall be shown on
the plan.
9. Landscaning
The Applicant shall loam and seed seven (7) foot grass strips on each side of the roadway.
10. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work shall
continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays.
Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours
prior to commencement of construction.
C. All construction shall be carried out in accordance with the Rules and Regulations of the
Planning Board, and in accordance with any and all rules, regulations and ordinances of
the City of Salem.
11. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or land surveyor, shall be
submitted to the Planning Department and Engineering Department prior to issuance of a
Certificate of Occupancy.
12. Violations
Violations of any conditions may result in revocation of this permit by the Planning Board.
This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk
that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and
it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under
the name of the owner of record is recorded on the owner's Certificate of Title. The fee for recording or
registering shall be paid by the owner or applicant.
I hereby certify that a copy of this decision and plans are on file with the City Clerk and a copy is on file
with the Planning Board.
