Landscape & Masonry Supplies, Inc., 8-10 Broadway D ^� Site Plan Review Decision W mg cn m N On Thursday, September 18, 2003, the Planning Board of the City of Salem opened a Public Hearing regarding the application of the Dilisio Brothers Landscape &Masonry Supply Co. under Site Plan Review for the renovation of an existing one-story structure, with total square footage of 16,895 square feet. The structure will consist of two retail units in the front of the building (approximately 3,610 square feet) and three office/retail/storage units will be located in the rear of the building. The project includes site improvements such as sidewalk, granite curbing, street period lighting, and opaque fencing. The public hearing was continued to October 2, 2003, October 16, 2003, and November 6, 2003. The Public Hearing was closed on November 6, 2003. At a regularly scheduled meeting of the Planning Board held on November 6, 2003, the Board voted by a vote of eight in favor(Power, Durand, Puleo, Moustakis, Lombardini, Weiner, Sullivan, Collins), none opposed, to approve the application as complying with the requirements of Site Plan Review subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "DiLisio Brothers Landscape & Masonary Supply, Inc. at#8-10 Broadway," sheets 1-4, prepared by Patrowicz Land Development Engineering, 60 Washington Street, Salem, MA 01970 dated August 26, 2003, revised September 29, 2003 and September 30, 2003; and sheets Ex 1, Ex2, A1, and A2 prepared by H. H. Morant& Co., Inc. Architects, 221 Washington Street, Salem, MA, dated August 27, 2003. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. Trees shall be a minimum of 3 '/z" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. Any street trees removed as a result of construction shall be replanted. The location of the trees shall be approved by the City Planner prior to replanting. e. Final completed landscaping shall be subject to approval by the City Planner prior to the issuance of a Certificate of Occupancy. 4. Use Limitation The exterior portion of the property on the northerly side of the building shall be used solely as a parking area for the same purposes parking areas are customarily used provided however that the storage of vehicles and/or equipment in connection with tenant businesses located in the building is specifically prohibited. The applicant shall restrict, by lease or otherwise, tenant use of the parking area to comply with this requirement and business hours of operation allowed by applicable ordinances of the City of Salem. 5. Signage a. The applicant shall install "No Parking" signs along Broadway. The signage location shall be reviewed and approved by the Department of Planning and Community Development prior to installation. b. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 6. HVAC So as to mitigate noise pollution, the HVAC unit shall be placed in the front left corner of the building (as far from residential abutters as possible). 7. Drainage The applicant shall install a French drainage system in the parking lot (as shown on the approved plan) to alleviate drainage problems from roof downspouts. 8. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. Period lighting shall be installed in the parking lot and along Broadway. The locations and specifications of the lighting shall be reflected on a revised lighting plan submitted and approved by the Department of Planning and Community Development and the City Electrician prior to the issuance of a Certificate of Occupancy. c. A final lighting plan shall be submitted to the City Planner and the City Electrician for review and approval prior to the issuance of a building permit. 2 d. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 9. Conservation Commission All work shall comply with the Order of Conditions issued by the Salem Conservation Commission, if applicable. 10. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. The Planning Board will agree to any proposed changes in the starting time, if approved by a formal vote of the City Council. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Any drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they exit the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site. g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant prior to the issuance of a building permit. Included in this plan, but not limited to, shall be a demolition plan, information regarding how the construction equipment will be stored, a description of the construction staging area and its location in relation to the site, and where the construction employees will park their vehicles. The plan and schedule shall be submitted and approved by the City Planner prior to the issuance of a Building Permit. 11. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 12. Board of Health All work shall comply with the requirements of the Salem Board of Health, if applicable. 13. City Engineer The applicant, his successors or assigns shall comply with all requirements of the City Engineer 14. Fire Department All work shall comply with the requirements of the Salem Fire Department. 15. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 16. Utilities Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 17. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 18. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Department of Planning and Community Development and Department of Public Works prior to the issuance of the final Certificate of Occupancy. 19. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title. The fenced-in portion will be used by a Dog Day Care business, which obtained a special permit from the Zoning Board of Appeals on May 19, 2004. It has been determined that the proposed changes do not constitute substantial changes and do not require Planning Board approval. The proposed screening for the fence shall include arborvitae trees and the placement of the screening shall be approved by the Department of Planning & Community Development prior to installation. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit to operate a Dog Day Care Business in a portion of the building for the property located at 8-10 Broadway located in an Industrial Zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-3 (2) (8), which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension of expansion, of nonconforming lots, land, structures, and uses, provided however, that such change, extension, enlargement of expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or stuctures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve Substantial hardship, financial or otherwise, to the petitioner. C.
