Decision Special Permit Wetlands and Flood Hazard District c/o New England Telephone Company 459 Main Street Saugus, MA RE: Telephone Cable Crossing Beverly/Salem Harbor On Thursday, February 18, 1988, the Planning Board of the City of Salem held a public hearing regarding the application of New England Telephone Company for a Special Permit under Section P, Wetlands and Flood hazard Districts of the Salem Zoning Ordinance, with respect to a proposal to install a telephone cable crossing Beverly Harbor, within coastal property and flats east of the Beverly/Salem Bridge. At a regularly scheduled meeting of the Planning Board held on March 24, 1988, the Board voted by a vote of five in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Conformance with Plan Work shall conform to plan entitled, "Topo Plan in Beverly & Salem, MA showing proposed location of two armored conduits for submarine cables for new England Telephone, dated November, 1987". Z. Conservation Commission Work shall comply with all requirements of Order of Conditions #64-157, issued by the Salem Conservation Commission on January 14, 1988. 3. Construction Practices All construction shall be carried out in accordance with the following conditions: A. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be not work conducted on Sundays or holidays. B. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. 4. Violations Any violations of these conditions shall result in revocation of this permit by the Planning Board. This Special Permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title.
