D'Amico, Jr. For a Special Permit under Section 7-15 and Site Plan Review under Section 7-18 This Decision is rendered upon an application for a Special Permit for a Planned Unit Development (the "PUD") pursuant to Section 7-15 of the Zoning Ordinance of the City of Salem (the "Ordinance") and Site Plan Review pursuant to Section 7-18 of the Zoning Ordinance of the City of Salem. The application was submitted on January 13, 2000, by JPI Apartment Development LC and James V. D'Amico, Jr. (collectively the "Applicant") together with a site plan entitled "Permit Plans, Planned Unit Development, 190 Bridge Street, Salem, Massachusetts", dated January 12, 2000 and last revised July 5, 2000,prepared for JPI and James D'Amico, Jr., by Rizzo associates, Inc. (the "Plan"). The proposed PUD would create a mixture of uses on the site including approximately 8,500 square feet of retail space, recreational trails, and a maximum of 266 multi-family residential dwellings. The site is subject to a proposed right of way taking by the Mass. Highway Department for the Bridge Street Bypass Road project. The proposed right of way area has been delineated by the State and acknowledged in the Applicant's plans, therefore no structures have been located within the right of way. The Board, within seven (7) days after receipt of the application, transmitted a copy of the application and the plan to the Inspector of Buildings,the City Engineer,the Board of Health, and the Conservation Commission. Notice of the filing of the application was also given tot he City Clerk, the Fire Department, the Police Department, Superintendent of Streets and the School Department. The Cit Solicitor has reviewed the application and has advised the Planning Board that the Y PP g application satisfied the threshold requirements for a PUD application. Notice of the Public Hearing by the Board of this application was duly published in the Salem Evening News, the local newspaper, on January 20, 2000 and January 27, 2000 and duly mailed to all persons entitled thereto by the law. A public hearing on the application was held in accordance with such notice at 7:30 PM on February 3, 2000 in the second floor conference room at One Salem Green. The public hearing One Salem Green, Salem, Massachusetts 01970 (978) 745-9595 ext. 311 Fax (978) 740-0404 was continued to March 2, 2000 at One Salem Green, March 16, 2000 and April 6, 2000 at Old Town Hall, April 24, 2000, May 4, 2000, May 18, 2000, and June 1, 2000 and June 15, 2000 at One Salem Green. The public hearing was closed on June 15, 2000. Reports on the application were received from the following Boards and Officers: 1. Board of Health -January 30, 2000 2. Fire Prevention -January 27, 2000 The Board has made a thorough study of and has given full consideration to, all documents, plans and other materials submitted by the Applicant and by members of the public; the reports and correspondence, written or otherwise, of the Inspector of buildings; the City.Engineer; the Board of Health; the City Solicitor; and the Conservation Commission and all statements made and other materials presented and submitted at the Public Hearing and at other public meetings of the Board at which the application was discussed, and therefore makes the following findings: 1. The proposed Planned Unit Development is in keeping with the surrounding residential and downtown neighborhoods; 2. The development of the Industrial parcel, which has been vacant for several years, will generate new business activity on the site, create jobs, both full and part time, and generate tax revenue for the City of Salem. 3. The Applicant has studied and will assure remediation of any contamination found at the site in accordance with regulations of the Massachusetts Department of Environmental protection. 4. The Planned Unit Development parcel contains more than sixty thousand (60,000) square feet of land. 5. A traffic study was undertaken by the Applicant to determine the traffic needs and impacts of the project to the area surrounding the site. 6. Parking and loading requirements, as well as maximum bulk and yards, are hereby established as per the plans and dimensions submitted. 7. The landscaping plan as submitted and conditioned herein, which includes fencing and tree planting along the perimeter of the site abutting the residential neighborhoods, mitigates the impact of the development on the privacy and the safety to the abutting neighbors. 8. The Planned Unit Development parcel consists of approximately 14.7 acres. 9. The proposed by-pass road to be constructed by the State is shown in the location requested by the City of Salem and agreed to by the State. 10. The applicant, at the request of the board and abutting neighbors, has amended the plans several times to reduce the commercial uses on the site and to increase the residential use. Such amendments included the elimination of a free-standing 14,000 square foot retail pad, as well as the elimination of a free-standing drive through ATM bank site. I. Therefore, the Planned Unit Development Special Permit shall be subject to the following conditions: 1. Conformance with the Plan Work shall conform with the set of plans entitled, "Permit Plans, Planned Unit Development, 190 Bridge Street, Salem, Massachusetts", dated January 12, 2000 and last revised July 5, 2000, prepared for JPI and James D'Amico, Jr., by Rizzo associates, Inc. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum of 3 Ys" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. e. The applicant,his successors, or assigns shall design a landscape plan for the portion of Bridge Street which will remain following the construction of the by-pass road. The plan shall be completed prior to the issuance of the first Certificate of Occupancy and shall be approved by the City Planner. The applicant, his successors, or assigns shall fully financially, support the construction of the landscape plan. 4. Signage The Applicant shall submit a detailed sign package for the entire PUD site to be reviewed and approved in writing by the City Planner prior to the issuance of any Certificate of Occupancy in the PUD. 5. Lighting a. Lighting shall be installed as shown on the approved plan. b. No light shall cast a glare onto adjacent parcels or adjacent rights of way. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. e. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of the last Certificate of Occupancy. 6. Traffic a. A study shall be conducted by the applicant to determine whether a fully automated L traffic signal is necessary at the intersection of St. Peter Street and Bridge Street. The study shall be completed prior to the issuance of the first Certificate of Occupancy and shall be approved by the City Planner. If the study determines that a fully automated signal is necessary at the intersection of St. Peter Street and Bridge Street, then the applicant shall financially support the installation of a signal. b. The ingress/egress of the entrance closest to Washington Street shall be a right in/right out only. c. The applicant, his successors, or assigns shall provide an easement, as shown on the approved plan, to the City to allow for a future connection of Woodbury Court and Howard Street. In addition, an easement shall be provided by the applicant, his successors, or assigns, which allows for future parking of approximately five vehicles to be constructed in close proximity to Woodbury Court. 7. Elevations Preliminary facade elevations have been approved by the Planning Board and final facade elevations shall be submitted to and approved by the Planning Board prior to the issuance for the first building permit in the PUD. 8. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall continue beyond 5:00 PM. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site and not on Bridge Street. ' 9. MBTA Commuter Rail The applicant, his successors, or assigns shall make adequate land available for a pedestrian crossover of the MBTA Commuter Rail track. In addition,the applicant, his successors, or assigns shall support the City in a joint application to the State for such pedestrian crossover of the track. 10. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 11. Board of Health All Board of Health requirements shall be strictly adhered to. 12. Fire Department All work shall comply with the requirements of the Salem Fire Department. 13. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 14. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer,his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two-(2) year period. 15. General Upon request of the Applicant and following a public hearing, any provision of this Special Permit may be waived or amended by a 2/3 vote of the Planning Board. 16. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 17. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. II. Based upon all of the written materials submitted to the Board, as well as the spoken and visual presentations and other oral communications received at the public hearing and with the amendments and clarifications to the application contained as conditions in this decision, the Board makes the following findings: 1. The proposed Planned Unit Development is in harmony with the purposes and intent of the Ordinance and the Master Plan of the City of Salem and will promote the purposes of Section 7-15 of the Ordinance. 2. The mixture of uses in the Planned Unit Development is determined to be sufficiently advantageous to render it appropriate to depart from the normal requirements of the District. 3. The Planned Unit Development will not result in a net negative environmental impact. Therefore,the Board is satisfied that the project meets all of the requirements of the Planned Unit Development Special Permit for parcels 60,000 square feet or greater as set forth in section 7-15 of the City of Salem Zoning Ordinance have been individually and collectively met; and, accordingly,the Board has voted by a vote of eight (8) in favor, none (0) opposed to grant a Special Permit for a Planned Unit Development for construction and use of the premises pursuant to the Applicant's application,upon and in accordance with the provisions, conditions, and procedures set forth above. Appeal from this decision, if any, shall be made pursuant to the Massachusetts General Laws, and shall be filed within twenty (20) days after the date of filing of this decision in the office of the City Clerk. D'Amico, Jr. 190 Bridge Street, Salem, MA 01970 A public meeting was held on July 10, 2003 regarding the request of JPI Development to amend their Special Permit for a Planned Unit Development (pursuant to Section 7-15 of the Zoning Ordinance of the City of Salem) and their Site Plan Review (pursuant to Section 7-18 of the Zoning Ordinance of the City of Salem) decision for the parcel located at 190 Bridge Street. The applicant proposed to include a maintenance shed of approximately 500 square feet on the parcel. The shed was not shown on the original approved plans. At the July 10, 2003 public meeting held concerning this amendment request, the Board voted by a vote of eight (8) in favor(Power,Puleo, Moustakis, Sullivan, Collins, Weiner,Durand, Lombardini), and none (0) opposed, to approve the amendment as complying with the requirements of the Planned Unit Development Special Permit and Site Plan Review with the following conditions: 1. Maintenance Building a. Highways to address certain title and construction issues from the development as built. Although most of the issues involve new or old utility lines and are being reviewed by the Salem City Engineer, one of the proposed instruments and associated plan is proposed to comply with Condition 6 (c) of the Special Permit granted in 2000 to JPI by the Salem Planning Board, and is clearly subject to review by your Department. I have enclosed highlighted copies of the documents hereinafter referenced. The SP condition requires the owner to "provide and easement, as shown on the approved plan, to the City to allow for a future connection of Woodbury Court and Howard Street ... (and) an easement shall be provided ... which allows for future parking approximately five vehicles to be constructed in close proximity to Woodbury Court." The owner is now proposing an instrument that recites and grants such easements to the City on pages 2,3 5 & 6 thereof, as well as dealing with the abandonment of an unused utility line that the City Engineer will review. Page 2 Lynn Goonin Duncan, Director January 15, 2015 The "gist" of the proposed easement is that it allows passage of emergency City vehicles to access Woodbury Court (a dead-end street) and allows the placement of removable "bollards" to prevent its regular use. Such bollards have in fact been placed, and they have handles to allow them to be removed (see accompanying photo). The easement and plan (Sheet 5 —"Woodbury Court Access and Parking Easement Plan") also grant the City a defined area adjacent to the end of Woodbury Court to construct the five 5 parking spaces, as required by the SP condition, with associated lighting and signage, which would be constructed and maintained by the City. Please review, and advise me if you have any questions or concerns, as this easement is part of a package that I will be submitting to the City Engineer, City Solicitor, City Council and Mayor for approval as soon as feasible. Kaminski and Associates, Inc., Engineers—Architects—Land Planners,354 Merrimack Street—Lawrence, MA (Sheets 1-7), dated August 22,2013, as recorded in the Essex County South District Registry of Deeds and filed with the Registered Land Department of said Registry (the seven sheets being collectively referred to as "the Kaminski and Associates Plans"). D. iCondition No. 6(c) to the Special Permit requires Owner, as successor in interest to Prior Owner,to grant to the City of Salem an easement"to allow for a future / connection of Woodbury Court and Howard Street ... and for future parking of approximately five vehicles to be constructed in close proximity to Woodbury Court" (the "Emergency Access Easement" and the"Woodbury Court Parking Easement," 2 respectively). Owner and City intend and agree that this Easement and Release Agreement will fulfill the requirements of Condition No. 6(c) of the Special Permit.- E. The Salem Station Land is subject to a utility easement held by the City, shown as"Utility Easement B;' containing 4,930 S.F. on a plan recorded in Plan Book 146, Plan 31 with a deed from the City to General Mills Fun Group, Inc. (the "General Mills Deed") dated December 23, 1977, recorded with the Registry in Book 6430, Page 739. Utility Easement B is twenty (20) feet in width, extends approximately 246 feet west from the westerly end of Woodbury Court and is comprised of the areas designated "Existing 20' Wide Utility Easement to be Abandoned" (the Abandoned Easement Area") and "Sewer Easement to Remain" (the "Retained Easement Area"), both shown on Sheet 5 of the Kaminski and Associates Plans,said Sheet being entitled "Woodbury Court Access and Parking Easement Plan of Jefferson at Salem Station Located in Salem, Massachusetts, Owned by Salem Station LLC, Scale 1"=40', August 22, 2013 (that particular Sheet being also referred to as the"Easement Grant and Release Plan'). F. Acting pursuant to G.L. c. 40 § 3, 15 and every other lawful power, the Mayor and City Council of the City have determined, after notification to that effect by the Salem City Engineer, that in light of the reconfiguration of easements and rights of way described in this instrument, certain historic easements held by the City for utilities and rights of way in the Land, also described in this instrument, are no longer required for public purposes and should be abandoned. The City will, by execution of this instrument, release the Abandoned Easement Area within former Utility Easement B, and all pipes 3 and related appurtenances within the Abandoned Easement Area, but will retain the Retained Easement Area. H. New Drainage Easement. Woodbury Court Parking Easement. Owner further grants to the City a perpetual, non-exclusive easement on, over and across the area designated "Woodbury Court Parking and Access Easement `B' " as shown on Sheet 5 of the Kaminski and Associates Plans (the "Easement Grant and Release Plan"), for the sole and exclusive purpose of constructing,maintaining and operating, at the City's sole cost and liability, a parking area for up to five(5) non-commercial automobiles (the"Woodbury Court Parking Are and installing appropriate lighting fixtures and signage regarding the use and hours of operation of said parking area, provided that(a) the Woodbury Court Parking Area will be paved and lighted, (b) no construction will be undertaken on the Woodbury Court Parking Area until the plans for all proposed work have been reviewed 5 and approved by Owner; (c)the City will at all times, and at its sole cost and expense, maintain the Woodbury Court Parking Area and any parking spaces and appurtenant improvements installed or constructed thereon, in good, usable, safe, clean and orderly condition, and (d) except as required in connection with the construction or maintenance of the Woodbury Street Parking Area, no vehicles or equipment other than currently registered and operational non-commercial automobiles, will be parked,placed or allowed by the City to remain within the Woodbury Street Parking Area. All work and improvements undertaken by or on behalf of the City and all other actions taken by or on behalf of the City hereunder, will be in full compliance with all applicable laws, ordinances, rules and regulations, and any permits or approvals required in connection therewith will be obtained and maintained in effect by the City or by persons acting on its behalf.
