Correnti: The Planning Board received a complaint regarding the parcel located at 94 Bridge Street. The complaint focussed on the lack of landscaping planted on the site. In addition,the complaint addressed the lighting which causes a glare on the adjacent parcels. In response to the complaint,a site visit was made by the Planning Board's Clerk of the Works to ensure that the construction on the site was completed as shown on the approved plan and in the decision of the Planning Board. Will Beaulieu,the Planning Board's Clerk of the Works,determined that the landscaping planted on the site was insufficient. There are many trees and shrubs shown on the approved plan which were not located on the site at the time of this letter. I have enclosed the approved landscaping plan for your convenience. The landscaping on the site must meet what is shown on the approved plan. This landscaping should be completed during the coming spring season. I have also enclosed the decision of the Planning Board for this project. On item #5 of the decision it states that"all site lighting shall be installed and maintained in such a way so as to not reflect or cause glare on abutting properties, or which adversely affect safe vision of operators of vehicles moving on nearby streets." The complaint we received stated that the lighting on the gas canopy is causing a glare on the adjacent properties. Please adjust the lighting on the gas canopy so that it does not glare on any adjacent parcels or the roadway. Please address these concerns as soon as possible. Af J S DECISION Site Plan Review Special Permit Peterborough Oil Co., Inc. c/o Attorney Joseph Correnti Serafini, Serafini and Darling 63 Federal Street Salem, MA 01970 RE: Peterborough Oil - 94 Bridge Street On Thursday, June 5, 1997, the Planning Board of the City of Salem opened a public hearing regarding the application of Peterborough Oil Co., Inc., 665 N. Main Street, Leominster, MA, under Section 7-18, Site Plan Review of the Salem Zoning Ordinance, with respect to property located at 94 Bridge Street. The proposed project involves the demolition of the existing block building and removal of gasoline pumps to allow the construction of a new building of approximately the same size, as well as the installation of new gasoline pumps and canopy. The public hearing was closed on July 10, 1997, and at a regularly scheduled meeting of the Planning Board held on July 10, 1997,the Board voted by a vote of eight(8) in favor, and one(1) opposed, to approve the application as complying with the requirements of Section 7-18, subject to the following conditions: 1. Conformance with Plan Work shall conform with set of plans entitled, "Proposed Service Station Improvements for Peterborough Oil Co., Inc, Bridge Street, Salem, MA", dated May 1, 1997, revised through June 26, 1997, containing nine(9) sheets labeled 1-9, prepared by Tyree Engineering, PC, 9 Otis Street, Westborough, MA 01581. 2. Amendments Any amendments to the Site Plan or waiver of conditions contained within shall require the approval of the Planning Board. 1. 3. Utilities A. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. B. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 4. Board of Appeals All requirements of the Board of Appeal Decision shall be strictly complied with. 5. The applicant shall work with the City Planner and the City's Landscape Architect to determine the most appropriate screening and landscaping for the rear of the property, along Cross Street, and for the side of the property located on Pearl Street. The design shall include a pedestrian opening at the rear of the property. This plan shall be submitted to the City Planner for written approval prior to the issuance of a Building Permit. F. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy,the applicant, his successors or assigns, shall be required to add further landscaping if such is required by the City Planner. 7. Si na e Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. HVAC Equipment The Applicant shall submit catalog cuts of the HVAC system documenting projected noise levels shall be submitted to the Planning Department prior to the issuance of a Building Permit. The dB of the equipment shall be no more than 50 dB as measured at the nearest property line, and reasonable muffling of the HVAC equipment shall be installed to further reduce the level of noise from the equipment. 14. Maintenance A. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. B.Winter snow in excess of snow storage areas on the site shall be removed off site. 15. Construction Practices All construction shall be carried out in accordance with the following conditions: A.No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. B.AII reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutter in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. C. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two(2) year period. REQUESTIMIK'A Mr r PERMIT FOR THE PROPERTY LOCATED AT 94 BRIDGE STREET (R-2 ) A hearing on this petition was held March 19, 1997 and continued to April 16, 1997 with the following Board Members present: Gary Barrett; Chairman, Nina Cohen, Albert Hill, Paul Valaskatgis and Arthur LeBrecque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting a Special Permit to allow the enlargement of the existing non conforming use and Change of Use to permit a mini-mart for the property located at 94 Bridge Street. The provision of the Salem Zoning Ordinance which is applicable to Permit is Section 5-3 provides this request for a Special (1 ) , which P q P as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans, makes the following findings of fact: 1. Petitioner proposes to renovate property by demolishing existing structure and erecting new structure while expanding existing non-conforming use as gas station to include convenience store and gas station. 2. The plan as altered met the enthusiastic approval of Eric Williams, of 4 Pearl St, Jack Cempellin, of North River Neighborhood Association, and Paul Ward of Pearl St. and the N.R.N.A. Regina Ward also appeared in support of the petition. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . The Special Permit requested can be granted without substantial detriment to the public good or without nullifying and substantially derogating from the intent of the district or the purpose of the ordinance. 2. The granting of the Special Permit requested will promote the public health, safety, convenience and welfare of the City's inhabitants and may be granted in harmony with the neighborhood. Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to grant the Special Permit requested, subject to the following conditions: 1. INTRODUCTION This report provides an analysis of the existing and proposed site drainage associated with the re-development of a Mobil Oil gas station and convenience store. The study establishes and compares pre- and post- development peak rates of storm runoff for the 10, 25 and 100-year design storms. Drainage impacts of the proposed development and measures to mitigate any adverse environmental affects are addressed in this report. 2. METHODOLOGY This report examines the site under existing and proposed conditions for the 10, 25 and 100-year storm events. The Rational Method has been used to estimate peak rates of runoff as recommended by the Massachusetts DPW Highway Design Manual. See Appendix A for runoff calculations. The rainfall intensities were determined from the USDA-Soil Conservation Service rainfall distribution tables. 3. EXISTING CONDITIONS The site is located on the comer of Bridge Street and Pearl Street in Salem, Massachusetts. The property is rectangular in shape and is bordered to the east by Bridge Street, to the south by Pearl Street, to the west by Cross Street and to the north by residential development. The parcel area is 22,080 square feet. The site is currently developed with an approximately 2,700 square foot Citgo service station with service bays, two gasoline pump islands, parking and other facilities relating to the gas station. The rear portion of the site is paved and fenced in with chain-link fencing. Nearly the entire site is impervious with limited landscaping. 1 This site currently drains onto Bridge Street, Pearl Street and Cross Street. This runoff is currently collected by the City storm drain system. A small portion of the site drains onto the residential development to the north of the site. Runoff Quantities A stormwater analysis was performed to calculate pre-development runoff rates for the 10, 25 and 100-year storm events using the Rational Method. This methodology is recommended by the Massachusetts DPW Highway Design Manual. The pre-development peak rates of runoff are presented in Table 1. (Refer to Appendix for calculations.) PROPOSED CONDITIONS Under proposed conditions, the existing building will be demolished and a new 2,580 square foot convenience store constructed, setback approximately 100' from Bridge Street. A new pump island and a 1,924 square foot canopy will be constructed to the front of the site. The entire site will be re-graded as needed and additional landscaping will be added on site. The drainage pattern for the site will remain essentially unchanged from the existing to the proposed condition. Runoff Ouantities The stormwater analysis for proposed conditions was performed for the 10, 25 and 100-year storm events using the Rational method. The post- development runoff rates are listed in Table 2. CONCLUSIONS The proposed development will result in a slight decrease of the peak rate of runoff from the pre-development condition for the 10, 25 and 100-year storm events under the post-development condition. A comparison of pre- development and post-development conditions are presented in Table 3.
