HARRINGTON MAYOR August 10, 1994 Walter Power, Chairman Salem Planning Board One Salem Green Salem, MA 01970 Dear Walter: I am writing regarding the Stop-N-Shop Company's proposal to develop a Stop-N-Shop Supermarket in Salem and Peabody, on Howley Street. In the months since this project was initially proposed, there have been a series of public hearings, neighborhood meetings and board meetings, during which several issues have been raised by City officials, abutters and other City-wide residents. Included in the concerns were traffic impact, hours of operation, noise, lighting and visual intrusions and the resulting reduction in the amount of open space in the neighborhood if the parcel is developed. As you know, because this development is proposed in an Industrial Zone it will require a Planned Unit Development (PUD) Special Permit to allow it to move forward. The PUD Special Permit process provides an opportunity for the City, under the expert and reasoned authority of the Planning Board, to require certain enhancements and mitigation measures in return for granting a Special Permit. I believe that such mitigation measures should protect and enhance the surrounding neighborhood and benefit the community at-large. Due to the amount of attention this project has received, I believe it is important for the community to know where I stand on the proposal. Therefore, I have met with neighborhood residents, solicited and received public comment and reviewed Stop-N-Shop's initial proposal carefully. My conclusion is that the benefits of the proposal far outweigh the potential disadvantages, but that significant enhancements should be included in Stop-N-Shop's plan which would mitigate any negative impact which could result from construction of this development. As a result of my review I have established a mitigation package that Stop-n-Shop has agreed to which is designed to benefit not only the neighborhood but the entire City. The package (see attached detailed proposal) meets these criteria and includes the following: assurances from Stop-N-Shop on reducing the hours of operation: limits on delivery times; guarantees which control the level of noise emitted from the rooftop equipment; $100,000 in community set-aside funds (which I will utilize to help provide city-wide SESD rate relief; $100,000 in transportation improvement funds to be used in the Boston Street area; a wide- ranging slate of transportation and traffic enhancements at the project site; $25,000 to be used to i SALEM CITY HALL . 93 WASHINGTON STREET . It is my intention to offer the full support of my administration to the Stop-N-Shop proposal if each of the listed enhancements is included in the final plans. We should also keep in mind that, in addition to each item included in the mitigation plan, the project will generate approximately $100,000 in commercial property tax revenue annually. This commercial tax growth is crucial to the City's ability to expand our tax base and continue to provide high quality public services. I have Stop-N-Shop's commitment to include all of the attached enhancements in their presentation to the Planning Board during the upcoming public hearing. I will request that City Planner William Luster submit and present this list of enhancements to the Board to ensure that they are included in the Stop-N-Shop plan. Neighborhood screening, approved by the Planning Board will be constructed and/or planted to buffer noise and visual intrusions into the surrounding residences. B. All rooftop and rearyard HVAC and refrigeration equipment shall include noise mufflers which do not allow the noise level to exceed 60 decibels at 20 feet (from equipment). C. Stop-N-Shop shall conform to sign requirements prescribed by the Planning Board which may be stricter than the existing sign regulations. D. Site lighting shall be designed to provide adequate site security, while at the same time, providing a shield to guard against glare in surrounding residences. II. Hours of Operation Stop-N-Shop has agreed to maintain hours of operation of 6:00 a.m. - 11:00 P.M. III. Deliveries and Refuse Collection A. Deliveries will be allowed only during business hours. B. Refuse collection will be allowed only during business hours. IV. Community Improvement Set-Aside Fund The Stop-N-Shop companies shall donate $100,000 to the City of Salem to undertake community improvement projects. Provide funds to the City of Salem to complete an independent analysis of the Robert Vanesse traffic study to determine if the traffic counts and analyses presented by Stop-N-Shop are correct. B. Traffic improvements on Boston Street, to include but not be limited to, the intersection of Boston and Aborn Streets and other associated improvements in the Boston Street area. This amount shall total $100,000. C. Installation of a traffic signal at the intersection of Howley and Main Streets. D. Geometry improvements at the Howley and Walnut Streets intersection to provide a safe flow of traffic. E. Howley Street shall be widened to accommodate the free flow of traffic into and out of the supermarket. VI. Bikeway/Walkway Stop-N-Shop shall clean debris from the North River for the entire length of their property and shall contribute toward construction of a pedestrian/bicycle trail in conformance with the recently completed City- wide Walking Trail Plan which was prepared by the Planning Department and submitted to the Massachusetts Highway Department. Stop-N-Shop's involvement shall be contingent upon the Salem Trail Plan being included on the Transportation Improvement Program of the Massachusetts Highway Department and will not exceed $25,000. VII. Neighborhood Improvements Stop-N-Shop shall provide $25,000 to the City of Salem to fund neighborhood improvements in the area surrounding the proposed development. VIII.
