Shadrawy, Jr. Shadrawy& Rabinovitz 15 Broad Street Boston, MA 02109-3803 RE: Walgreens Drug Store - 45-53 and 59 Boston Street, 3 Pope Street and 15 Proctor Street On Thursday, June 18, 1998, the Planning Board of the City of Salem opened a public hearing regarding the application of Suncor Development of Massachusetts, LP, under Section 7-18, Site Plan Review, of the Salem Zoning Ordinance, with respect to the construction of a 13,855 s.f. building and associated site improvements to house a - Walgreens Drugstore at 45-53 and 59 Boston Street, 3 Pope Street and 15 Proctor Street. The public hearing was closed on August 24, 1998. At a regularly scheduled meeting of the Planning Board held on August 24, 1998, the Board voted by a vote of eight (8) in favor, none (0) opposed, to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Conformance with Plan Work shall conform with set of plans entitled, "Walgreens, Boston& Proctor, Salem, MA", dated April 15, 1998, revised through August 24, 1998, prepared by Atlantic Design Engineers, Inc. P.O. Box 1051, Sandwich, MA 02563, containing five sheets, CO.1-CO.3, S-1, and Elevations, prepared by Levinson Associates, L.P. 2. Amendments Any amendments to the Site Plan or waiver of conditions contained within shall require the approval of the Planning Board. 3. Traffic a. There shall be no left turn exit out of the site onto Boston Street. The applicant, his successors or assigns. shall provide a detailed plan to the City Planner for his written approval depicting the construction of the exit driveway to prohibit left turns onto Boston Street. The plan shall be approved prior to the issuance of a Building Permit. b. Petitioner agrees to provide to the City of Salem upon request a sum not to exceed $25,000 to reimburse the City the actual expenses incurred by the City of Salem necessitated by the making of Proctor Street into a two-way street, provided that construction of Proctor Street into a two-way street is commenced within eighteen(18) months of this decision. This provision shall not limit, delay, restrict or prohibit the Applicant from proceeding with the development of its site as contemplated hereunder pending action by the City. Any action or work needed to be undertaken or performed relative to turning Proctor Street into a two-way street shall be the City of Salem's responsibility. The petitioner agrees to reasonably cooperate with the City during the development of Proctor Street into a two-way street. 4. Exterior Elevations Final elevations, brick type and other building materials shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 5. Salem Fire Memorial Marker The Applicant, his successors or assigns, shall donate an amount not to exceed $1,000 to the City to design and install a memorial marker commemorating the Great Salem Fire at the intersection of Boston and Proctor Street. The funds shall be donated to the City prior to the issuance of a Certificate of Occupancy. Location shall be approved by the City Planner and the Ward Councillor. 6. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. i 7. Site Lighting a. A lighting plan shall be submitted to the City Planner for review and written approval prior to the issuance of a Building Permit. b. All site lighting shall be installed and maintained in such a way so as to not reflect or cause glare on abutting properties, or which adversely effect safe vision of operators of vehicles moving on nearby streets. 8. Noise Applicant shall conduct a pre-construction noise test at 2:00 a.m. to determine ambient level. The Applicant has agreed to no discernable increase in dBA, defined as 3 or less dBA. Applicant shall conduct a post construction noise test at 2:00 a.m. Post construction test shall be conducted between May and September. Noise test shall be conducted at the site of the nearest residential dwelling unit. 9. Landscaping a. Applicant, his successors or assigns, shall submit a detailed plant list indicating quantities of proposed plantings to the City Planner for written approval prior to the issuance of a Building Permit. b. Trees shall be a minimum of 3 '/2" caliper. c. Vertical granite curbing shall be installed at all entrance radii to the site. d. Concrete curbing or sloped granite curbing shall be installed within the site. e. A concrete sidewalk, including the resetting of all existing granite curbing, shall be installed around the site on Pope Street and Boston Street and extend on Proctor Street to the far side of 25 Proctor Street. f. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy,the applicant,his successors or assigns, shall be required to add further landscaping if such is required by the City Planner. 10. Signage Proposed signage shall be reviewed and approved in writing by the City Planner, and may be less than the signage allowed in the Salem Sign Ordinance. 11. Board of Health All Board of Health requirements in a letter dated July 31, 1998, shall be strictly adhered to. 12. Water Test The water system shall be tested by the City of Salem Clerk of the Works for pressure and bacteria prior to the issuance of a Certificate of Occupancy. 13. Underground Utilities All site utilities shall be installed underground. 14. Delivery Hours Deliveries shall be limited to the hours of 6:OOAM - 6:00 P.M. 15. Clerk of Works A Clerk of Works shall be provided by the City and paid for by the applicant, his successors or assigns, as deemed necessary by the City Planner. 16. Maintenance a. The applicant, his successors or assigns, shall employ an acceptable method or means for the holding and disposal of trash(rubbish) after site development Prior to the issuance of a Certificate of Occupancy, the Applicant shall submit a plan for refuse removal to the City Planner and Board of Health for their approval. Petitioner shall include the location, design and number of trash receptacles to be located on the site in said plan with a copy of the method of maintenance for the site. b. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer,his successors or assigns. c. Winter snow in excess of the snow storage area on the site shall be removed off site. 17. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. i b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. d. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 18. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to the issuance of a Certificate of Occupancy. 18. Violation Violation of any condition herein may result in revocation of this permit by the Planning Board. I hereby certify that a copy of this decision and plans have been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record or is recorded on the owner's Certificate of Title. Shadrawy: There are several site items, which have not been completed to date at the Walgreens site on Boston Street in Salem, Massachusetts. The following is a list of the uncompleted site work: 1. The approved site plan shows the sidewalk,to be constructed by the developer on Proctor Street, is connected to the existing sidewalk on Proctor Street. To date, the pavement from the new sidewalk and that of the existing sidewalk do not match. This connection needs to occur. 2. The plans call for the abandonment of three water gates located adjacent to the site. To date, these gates have not been abandoned. 3. There is storm drainage work located on site in close proximity to Pope Street, which has not been completed. 4. The parking lot currently contains only binder course. The finishing coat of pavement for the parking lot has not been applied to date. Due to weather restraints the Planning Board is willing to accept funds, which the Board will hold until the work has been completed. 5. The parking lot has not yet been striped. 6. Handicap parking space signage has not been located on the site as of yet. 7. The site landscaping, as shown on the approved plan, has not been provided. The site lighting, as shown on the site plan, has not been provided. 9. The sidewalks on Boston Street, Proctor Street, and Pope Street were installed during foul weather and were not properly covered during a snow storm the following day. The Planning Board's site inspector suggested several measures to be taken to assure that the sidewalks would not fail. Those measures were not taken. Please provide the Planning Board with a letter stating that the developer will be responsible for replacing the sidewalks located on Boston Street, Proctor Street, and Pope Street in the spring if these sidewalks were to fail. 10. To date,the light pole located on Boston Street has not been repaired. The developer agreed to straighten the light pole during the sidewalk construction. 11. The required off-site handicap ramps to be constructed on Pope Street, Boston Street, and Proctor Street have not occurred to date. 12. The portion of the lot located between the Walgreens store and Pope Street has not been paved. This area must be paved. 13. The directional signage, to be located at the entrances to the site, as shown on the approved plan,must be installed. 14. The portion of the lot,which is not proposed for development must be cleaned of debris and loose rock. The Planning Board's site inspector suggests that the area be power washed as well. 15. The structures, such as catch basins and manholes,need to be cleaned out. The piping located on site needs to be cleaned as well. These items must be completed prior to the issuance of a certificate of occupancy, except those items listed which the Board is willing to accept in funds prior to completion of the work.
