Project Site— The Salem Ferry Pier will be located in the Salem Harbor off of Blaney Street in Salem,
' Massachusetts. The backland site was previously improved with a parking lot and a concrete
abutment used for the temporary ferry demonstration project in 1998. The proposed Ferry Pier
facility is similar in scope to the previous facility but will not require any upland improvement. The
' proposed facility will be comprised of a combination of existing and new equipment some of which will
be moved from Central Wharf in Salem to the project site. See attached Project Description.
' Alternatives — Other than additional design refinements, the only other project alternative is a No
Build. Under the No Build Alternative, the site would remain unutilized
' On and Off-site Mitigation Measures— The project activities do not result in impacts that require

activities in resource areas are limited to Installation of supporting piles.
Coastal Hazard Policy#1
Preserve, protect, restore, and enhance the beneficial functions of storm damage prevention and
flood control provided by natural coastal landforms, such as dunes, beaches, barrier beaches,
coastal banks, land subject to coastal storm flow, salt marshes, and land under the ocean."
There are no natural coastal landforms such as dune's, beaches, barrier beaches, coastal banks
or salt marshes that provide storm damage prevention and flood control. There is Land Under
Ocean resource, however project activities will not create adverse impacts on this resource area.
Public Access Management Principle#4
'Expand existing recreation facilities and acquire and develop new public areas for coastal

' 1.1 PROJECT IDENTIFICATION
' Project Name: Salem Ferry Pier
Address/Location: The project is located at Blaney Street in Salem, MA.
1.2 PROJECT SITE
' The City of Salem ("the proponent") is proposing to install a passenger ferry and excursion
vessel berthing facility at Blaney Street off of Derby Street in the same location of a
previously authorized temporary commuter ferry facility which operated on the site in
1998. The site includes a gravel parking lot which can accommodate 196 vehicles. This
parking lot was developed as part of the previous ferry operation. Sufficient deep water to
' accommodate ferries and excursion vessels is located approximately 200 feet off the
shoreline. See Figure 1, Locus Plan and Figure 2, Existing Conditions.
' 1.3 PROJECT SUMMARY
' The proposed facility, which is being funded by the State Seaport Advisory Council, will be
comprised of a combination of new and used equipment which will service commuter
' ferries and excursion vessels. An existing City-owned handicapped accessible, 20 by 50
foot steel float and associated twin 30 foot gangway systems will be moved from the nearby
Central Wharf at the National Park Service site in Salem to the Blaney Street site. New
' facilities to be added to these structures include two 50-foot aluminum gangways; a 10 x 10
foot and a 20 x 20 foot pile supported handicap accessible platforms and a new 20 x 50
foot concrete or steel float with a boarding height of 48 inches. The two floats will be
' anchored by six 24-inch diameter steel pipe piles. The facility, which will be attached to an
existing abutment, will extend some 250 feet into the harbor and will occupy
' approximately 3,500 square feet of watersheet. The facility will be in operation for three to
five years or until the planned New Salem Wharf facility is constructed. See Figure 3,
Proposed Site Plan and Figure 4, Section A.
' There is an adjacent gravel parking lot with space for 196 vehicles on the upland portion of
the site. The parking will be available for users of the proposed facility.

II ' 1.4 CONSISTENCY WITH LOCAL PLANNING AND ZONING
REGULATIONS
The site is zoned Industrial and has been designed consistent with the applicable zoning
regulations.
' The project is also located within Salem Harbor and complies with the provisions of the
' Salem Municipal Harbor. Plan (hereinafter referred to as the "Harbor Plan"), which was
approved by the Secretary of Environmental Affairs on November 9, 2000.
' 1.5 CONSISTENCY WITH STATE CHAPTER 91 PROGRAM
' JURISDICTION
The project is proposed in flowed tidelands and is therefore subject to the provisions of the
state Chapter 91 regulations at 310 CRM 9.00.
' COMPLIANCE WITH CHAPTER 91 REGULATIONS
The proposed project is water-dependent pursuant. to 310 CMR 9.12(2) of the waterways
regulations because it consists of a water-related passenger transportation facility. The
following paragraphs describe the project compliance with the existing, applicable Chapter
' 91 standards outlined in 310 CMR 9.00.
310 CMR 9.32 (1) (a) Categorical Restrictions on Fill and Structures: The project is entirely
' comprised of water-dependent structures.
310 CMR 9.32 (1) (b) Tidelands within Designated Port Areas: The project is a water-
dependent industrial use as defined in 310 CMR 9.12(2)(b)2 as it is a facility associated with
commercial passenger vessel operations.
310 CMR 9.33 (1) Environmental Protection Standards. The project has been designed in
compliance with applicable environmental regulatory programs of the Commonwealth.
' The project will file a Notice of Intent with the Salem Conservation Commission.
310 CMR 9.34 Conformance with Municipal Zoning and Harbor Plans: As noted in Section
' 1.4 above and 1.5.2 below, the project conforms with municipal zoning and the Salem
Municipal Harbor Plan.
' 310 CMR 9.35 Standards to Preserve Water-Related Public Rights: Pursuant to 310 CMR
9.35 (2), the project does not interfere with public rights of navigation as it does not extend
' seaward of a state harbor line, impede free passage in the harbor, impair any line of sight
required for navigation, require alteration of an established course of vessels, interfere with
access to adjoining areas, extend beyond the length required to achieve safe be

' generate water-borne traffic that would substantially interfere with other existing or future
water-borne traffic, adversely affect the depth or width of an existing channel or impair in
' any other substantial manner the ability of the public to pass freely upon the waterways and
to engage in transport or loading/unloading activities. Furthermore, the project does not
significantly interfere with public rights of free passage over and through the water nor does
' it interfere with any public rights associated with a common landing, public easement or
other form of public access from the land to the water.
' Pursuant to 310 CMR 9.35(3), the project does not interfere with public rights of fishing and
fowling as the facility is not located in an area used extensively by the public for such
activities and does not pose an obstacle to the public's ability to pursue such activities.
The project does not propose any structures on the adjacent upland and the public can pass
freely in this area for the purposes of fishing, fowling, navigation and natural derivatives
' thereof.
310 CMR 9.36 Standards to Protect Water-Dependent Uses: The project is located more
' than 25 feet away from adjacent property lines and therefore does not interfere with littoral
or riparian property owner rights to approach their property from Salem Harbor or to
' approach Salem Harbor from their property. The project does not displace nor interfere
with any existing water-dependent uses at the project site nor will the project interfere with
the adjacent Hawthorne Cove Marina operations. The project will not preempt any existing
twater-dependent industrial use located within the Designated.Port area.
310 CMR 9.37 Engineering and Construction Standards: The project has been designed by
' a certified Registered Professional Engineer and complies with all applicable safety
regulations.
' COMPLIANCE WITH THE SALEM MUNICIPAL HARBOR PLAN
In addition to complying with the existing baseline Chapter 91 regulations described above,
' the project also complies with the general planning guidelines of the Salem Harbor Plan.
The site is located in the North Commercial Waterfront Planning area where the New
Salem Wharf, a proposed private/public multi use wharf serving a variety of waterfront uses
including berthing for commercial fishermen, excursion boats, cruise ships, water taxis and
other water-based transportation, is proposed.
