Conformance with Plan Work shall conform to plan entitled "Definitive Subdivision Plan - Sutton Hill" dated September 14, 1989, revised January 31, 1990. 2. Utilities Utility installation shall be reviewed and approved by the City Engineer. 3. Board of Health Board of Health requirements set forth in a letter dated January 10, 1990, shall be strictly adhered to. 4. Clerk of the Works A Clerk of the Works shall be provided at the expense of the developer as is deemed necessary by the City Planner. 5. Tri Party Agreement A Tri Party Agreement shall be filed with the Planning Board prior to release of the plan to ensure completion of improvements required under the City of Salem Subdivision Regulations, and as required by this approval. 6. Trees a. Trees shall be a minimum of 3 V caliper, planted 30 feet on center. b. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. 7. Lighting Lighting plan shall be reviewed and approved by the City Electrician and the Planning Department. 8. Fence Developer shall be responsible for replacing fence on the property of Francis Kelleher, located at 4 Belleview Avenue. 9. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. C. Drilling, blasting and hoe ramming shall be limited to Monday - Friday between 8:00 a.m. and 5:00 p.m. There shall be no drilling, blasting or hoe ramming on Saturdays, Sundays or holidays. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on roadways as they leave the site. e. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board. 10. Posting of Approval and Conditions Developer shall post all Planning Board Approvals and Conditions in a visible location on the site for the duration of construction. 11. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to issuance of Certificates of Occupancy. 12. Violations Violations of any conditions shall result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of this decision bearing certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed, or that if such appeal has been filed, and it has been dismissed or denied, is.recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's Certificate of Title. The fee for recording or registering shall be paid by the owner or applicant.
