C/o Attorney George Atkins Ronan, Segal, and Harrington 59 Federal Street Salem, MA 01970 RE: Definitive Subdivision Plan(Form C) for Town and Country Homes, Inc., Scenic Way Extension Dear Attorney Atkins: On January 13, 2000, the Salem Planning Board opened a Public Hearing for a proposal submitted by Town and Country Homes, Inc. (hereafter referred to as "applicant")to allow the construction of a cul-de-sac at the end of Scenic Way and associated utilities to service the construction of four(4) single family dwellings. The Public Hearing was continued to February 3, 2000 and on February 3, 2000,the Planning Board closed the Public Hearing and by a vote of six (6) in favor, none opposed, voted to approve the definitive subdivision plan subject to the following conditions: 1. Conformance with the Plan Work shall conform to the set of plans containing sheets 1 through 4, entitled, "Definitve Subdivision Plan, Scenic Way Extension, Salem, Massachusetts", prepared by Eastern Land Survey Associates, Inc., 104 Lowell Street, Peabody, MA, dated November 16, 1999 and revised January 20, 2000. 2. Utilities a. Utility installation shall be reviewed and approved by the City Engineer. b. All utilities shall be installed underground. 3. Board of Health All requirements of the Board of Health shall be strictly adhered to. Scenic Way Extension February 10,2000-2 4. Conservation Commission All work shall comply with the Determination of Applicability issued by the Salem Conservation Commission. 5. Fire Department The applicant shall comply with all requirements of the Salem Fire Department. 6. Building Inspector The applicant shall comply with all requirements of the City of Salem Building Inspector. 7. Street Lighting Street lighting installation shall be reviewed and approved by the City Electrician and Massachusetts Electric. The street lighting shall be the responsibility of the Applicant until such time as the City accepts the street. 8. Landscaping a. Deciduous trees shall be a minimum of 3 %" caliper, planted 50 feet on center in planting strips. The City's Landscape Architect shall determine the appropriate type of trees to be planted and shall approve the applicant's selection of trees prior to planting. b. The applicant shall install vertical granite curbs,planting strips, and sidewalks as shown on the approved plans. c. The applicant shall guarantee the deciduous trees for a period of one year from installation. 9. Scenic Way The applicant agrees to restore the existing portion of Scenic Way to its intersection of Scenic Avenue to its condition prior to the construction of the subdivision. 10. Security The applicant shall file a Bond, Covenant, TriParty Agreement, or Pass Book with the Planning Board as the means to secure the completion of the roadway and associated improvements. The Board will not release the plans until such time that the Board receives the method of security. 11. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall continue beyond 5:00 PM. There shall be no work conducted on Sundays or holiday p, 5Z- Inside work of a quite nature may be permitted at other times. ' r "'v b. All reasonable action shall be taken to minimize the negative effects of constructiocon ---n M abutters. Advance notice shall be provided to all abutters in writing at least 72 hours paor to F M commencement of construction. — > o- Scenic Way Extension February 10,2000-3 c. Drilling and blasting shall be limited to Monday—Friday between 8:00 AM and 5:00 PM. There shall be no drilling or blasting on Saturday, Sundays, or holidays. e. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations, and ordinances of the City of Salem. f. The applicant shall conduct street sweeping on Scenic Way, as deemed necessary by the City Planner. 12. As-built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department. 13. Clerk of the Works The City's Clerk of the Works shall be on site during construction, as deemed necessary by the City Planner. The cost for this service shall be borne by the applicant, his successors or assigns. 14. Violations Violation of any condition contained within this decision may result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that is such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record or is recorded on the owner's Certificate of Title. The fee for recording or registering shall be paid by the owner or applicant.
