Mr. Fletcher' s letter was authored by him when he was a representative of the City of Salem. I pur- chased the land and set prices, etc. based upon my anticipated cost and I have existing contracts with home owners for units in this condo development based upon my costs. I have relied upon Fletcher' s letter and other infor- mation, including a written agreement with the Planning Board for Phase II, combined with my other costs to determine my prices. In other words, I am locked in and if I am forced to spend an additional $300,000± to fix up City water pipes, this money will come out of my pocket. Your representation that there is adequate water supply does not agree with your requirement to install a storage tank. The usual and normal installa- tion of a booster pump DOES NOT REQUIRE storage tanks unless there is inade- quate water supply. If there is adequate water supply, as you state in your June 12th letter "It is my position that there is adequate water supply in this area", we do not need to have storage capacity. If there is an inade- quate supply of water, it is due to the conditions of the pipe. This statement is verified by your "acceptable alternative" of cleaning and lining, developed by my engineer. I offered to clean the pipes but you also want them lined. My problem is that this is a responsibility of the City and is a benefit to the entire area of the City and therefore I should not be forced into - paying for it through the withholding of certificates of occupancy on units which have been issued a building permit. As you are aware through meetings with the City's Director of Public Services, Paul S. Niman, the City has embarked on a three phased program to upgrade the core of its water system and increase the reliability and quality of water supplied to the distribution system. Phase I, which involves construction of a new high lift pumping station at Wenham Lake, is nearly complete. Phase II, which involves construction of a new 24 inch transmission main, is awaiting construction grant funding. Phase III, which involves refurbishing the Folly Hill Reservoir, is still in the planning stages. Additionally, the distribution system contains many pipes which contain severe corosion and tuberculation problems. However, it was originally planned that work on the dis- tribution system would not begin until the three phases were completed. One such area of the distribution system which has experienced severe tubercula- tion problems is the 16 inch main in Loring Avenue servicing the southern portion of our City. While there is currently adequate water to meet our needs, there is in- sufficient flow to meet the increased fire demands imposed by developments such as the Village at Vinnin Square. To solve this problem we have worked closely with the developer of the project, Mr. James Zieff, and have worked out an agreement by which we are hopeful these improvements could take place. Specifically, the City and Mr. Zieff have agreed to share the cost of the City's portion of a grant to clean and line the main in Loring Avenue. The estimated cost of this work is $300,000. If 50% grant funding is obtained, Mr. Zieff has agreed to pay $100,000 plus engineering costs of the project. The City will pay the remaining $50,000. 2 �I Mr. Thomas McLaughlin (Cont'd.) Our agreement (Salem/Vinnin) calls for certificates of occupancy in the mid- rise to be delayed until this problem is solved. At various meetings, Paul Niman has stated that he would release his restriction of issuance of C.O. 's if an agreement was in place. However, this does not consider Captain Turner' s control and designation of 2250 gal ./minute water capacity requirement prior to his release of C.O. ' s. Therefore, if we fully consider Captain Turner's position we have to complete the corrective work prior to the need for certificates for the midrise (March 1987) . In order to have this work complete by March 1987, we should proceed with it now since it is impossible to do the work after the bituminous plants close down and in cold weather (December 1± to March l±) . This period of time does not allow for any delay in award. If we are lucky enough to go the State funded route (50% of construction costs) , we must by law advertise and proceed with public bids. This procedure would span a two - three month period of time. In other words, work would not begin until December 15th± which puts us into the cold weather/no con- struction period. If we proceed without State funding, we need a letter of authorization for us to touch City-owned property. The City also must apply to the State for permission to penetrate the pavement. This should be done right away to forestall a delay due to paperwork. In sum total , we have a Catch 22 situation which is rapidly deteriorating to an impossible time frame. It appears that significant changes have been made in the layout of the proposed units subsequent to the ori- ginal assignment of numbers. In addition, the Building Inspector has been supplied with a renumbering of the units without the consultation or clearance of this office. Section 26-5 of the City of Salem's Code of Ordinances specifically assigns the authority to assign street numbers solely to the Board of Assessors. This situation causes particular concern since the renumbering appears to lack any sequential basis which would address the public safety requirements of the appropriate City departments, in particular those of the Fire Department. Mr. James Zeiff, in the Environmental Impact Statement, has quoted the Fire Department and the Public Works Department as indicating that the city water supply "is completely adequate carrying a pressure of 68 psi at the project entrance" . In the recent past, Mr. John LeClerc, the Salem Plumbing Inspector, commented to this department on the extremely low water pressure in the Valiant Way portion of Phase 1 . It has been discussed in the past that a water pump would be required to maintain ample pressure for both the domestic and fire fighting needs of this subdivision. The Fire Department has concerns for the overall adequacy of the municipal water supply system and its ability to function properly under the increased demands of growth within the city. I cannot comment on the adequacy of the roadways as no information has yet been presented relative to this.
