On behalf of the Project Proponent,the City of Salem, LEC Environmental Consultants,Inc. (LEC) is
' submitting this combined Application for a Waterways License and Water Quality Certification to the
Massachusetts Department of Environmental Protection(DEP)under the Public Waterfront Act(Chapter
91, section 10)and Section 401 of the Federal Clean Waters Act(33 U.S.C. s.1251 et sm.)and the
' Massachusetts Clean Water Act(M.G.L. c.21, ss. 26-53),respectively, for the Forest River Park Seawall
Repair Project, located in Salem, Massachusetts. The proposed project involves replacing the existing
seawall with a new seawall structure,replacing an 80-foot section of seawall with a sloped rip-rap
revetment, removing the existing beach access ramp and replacing it with new stairs and a new ramp, and
repaving the upgradient access.
' Included in the attached Application are details of the proposed project depicted on the Department of
Public Works Seawall Repair Project 100%Design Submittal Plans,prepared by Woodard&Curran,
' dated June 30, 2017(Appendix B), a Sediment Grain Size Analysis, along with representative map and

Introduction
' The proposed project involves demolition and reconstruction of an approximately sixty(60)year old
deteriorating,concrete seawall, located along the shoreline to Salem Harbor within the eastern portion of
Forest River Park. The project also involves replacing an 80-foot long segment of the existing wall with a
' sloped rip-rap revetment,repaving the parking area located upgradient of the wall,and construction of a
new stairway and ramp to improve safe public access to the beach. Portions of the proposed work will
' occur below the High Tide Line(HTL)and below Mean High Water(MEW), and within state-protected
Wetland Resource Areas, including Coastal Beach, Salt Marsh, Rocky Intertidal Shore, Coastal Bank,Land
Subject to Coastal Storm Flowage (LSCSF), and Land Containing Shellfish. Construction of the new
' seawall will result in temporary disturbances to the above Wetland Resource Areas; however,the project
has been designed to restore each resource area as described herein and,therefore,no permanent
t disturbances are proposed. As noted above,the project has been approved by the Salem Conservation
Commission through an OOC, dated June 28,2017.
In addition to the Notice of Intent(NOI)filing and associated OOC, LEC has submitted an Environmental
' Notification Form(ENF) in accordance with the Massachusetts Environmental Policy Act(M.G.L. c 30, s.
61-62H, MEPA)and the MEPA Regulations(301 CMR 11.00) and an Application for Department of the
' Army Permit was submitted July 7, 2017.
General Site Description
' Forest River Park is a twenty-nine(29)acre public park shown on Assessor's Map 33 as Lot 743,with a
street address of 32 Clifton Avenue(Appendix A,Figure 1). The Park is located at the end of Clifton
Avenue and extends to the shoreline of Salem Harbor. The seawall extends along the shoreline of Salem
' Harbor and contains a concrete ramp with steel railings for public beach access. The 525-foot long seawall
is approximately 5-feet tall when measured from the adjacent seaward land surface,with top of wall
elevations varying between 9.0 and 9.5. The seawall is in poor general condition due.to its age. Steel
railings have visible corrosion and do not appear to be code compliant, and there is no safety railing on the
seawall to protect the public using the walking path on the high side of the seawall. The interior access
' roadways within Forest River Park extend toward the seawall where several paved parking spaces are used
by the public.The pavement extends along the seawall as a 15-foot wide roadway which eventually
transitions to a gravel path upgradient from the northern section of the wall. The existing conditions are
tdepicted on Sheet EX-100 of the Plans.
Existing Wetland Resource Areas located in the vicinity of the seawall include a Coastal Beach, Rocky
' Intertidal Shore, Salt Marsh, and Land Containing Shellfish located seaward and adjacent to the wall. The
wall itself functions as a Coastal Bank. The entire project footprint is located within Land Subject to
Coastal Storm Flowage. Each of these Wetland Resource Areas are described in detail below.
' Forest River Park includes recreational fields, park buildings,paved driveways and parking areas, forested
uplands, and a small Pond. The main driveway continues east to a parking area situated adjacent to the
' seawall overlooking Salem Harbor. Between the recreational fields and the seawall, a small man-made
Pond exists. To the north of the Pond and seawall, a series of structures and associated appurtenances,
known as Pioneer Village,are located within a forested upland. An 8-foot tall chain-link fence extends
' around the Pond and Pioneer Village, including a segment of fence situated along the seawall on the
landward side of the roadway which extends behind the wall.

Forested uplands extend around the shoreline of the Pond with the largest contiguous area located on the
1 north side in the vicinity of the Pioneer Village buildings. Vegetation within the adjacent forested upland
areas include a moderately dense canopy layer of red oak(Quercus rubra),white oak(Quercus alba),
1 catalpa(Catalpa speciosa), cottonwood(Populus deltoides), and Norway maple(Acer platanoides). The
shrub layer is dominated by sapling canopy species, with clusters of raspberry(Rubus spp.), multiflora rose
(Rosa multiflora), autumn olive(Elaeagnus umbellata), and privet(Ligustrum vulgare). Groundcover
1 species include patches of Asiatic bittersweet(Celastrus orbiculatus),burdock(Arctium spp.), and
scattered tufts of grasses(Family Poaceae). The existing Pond contains a fringing BV W, dominated by a
conspicuous common reed(Phragmites australis)marsh, along portions of its northern shoreline.
1 FEMA Designation
According to the Federal Emergency Management Agency Flood Insurance Rate Maps for the Essex
1 County, Massachusetts, (Panel: 25005C077F), dated July 16,2014,the aforementioned Forest River Park
includes an area mapped as Zone AE(el. 11) extending from a Coastal Flood Zone—Areas subject to
1 inundation by the 1%annual chance flood, Base Flood Elevations Determined, and Salem Harbor
landward to the seawall is mapped as Zone VE(el. 16)—Areas subject to inundation by the I%annual
chance flood, Coastal Flood Zone with Velocity Hazard; Base Flood Elevations Determined. A Zone AE
1 (el. 11)extends from the Coastal Flood Zone including the Pond,Pioneer Village,.baseball field,
basketball field,and a portion of the recreational field(Appendix A, Figure 2).
1 Rare Specie
s
According to the 13`^edition of the Massachusetts Natural Heritage Atlas(effective October 1, 2008)
published by the Natural Heritage & Endangered Species Program(NHESP),the proposed project does
1 not occur within an Estimated Habitat of Rare Wildlife or Priority Habitat of Rare Species, and there are
no Certified or Potential Vernal Pools in the vicinity of the proposed work(Appendix A, Figure 4).
1 Wetland Resource Area Descriptions
In accordance with the Massachusetts Wetlands Protection Act(M.G.L. c. 131, s. 40), its implementing
1 Regulations(3 10 CMR 10.00), and the City of Salem Wetlands Protection Ordinance(Salem Code
Chapter 50), existing protectable Wetland Resource Areas have been identified and characterized on or
immediately adjacent to the project footprint. Portions of the proposed work will occur within Coastal
1 Beach, Salt Marsh,Rocky Intertidal Shore, Coastal Bank, Land Subject to Coastal Storm Flowage
(LSCSF), and Land Containing Shellfish,and within the Buffer Zone to BV W and Bank. A brief
1 description of each resource area is provided below.
Bordering Vegetated Wetland
1 Bordering Vegetated Wetland (BV W)is defined at 310 CMR 10.55 (2)as freshwater wetlands that border
on creeks, rivers, streams,ponds and lakes. The types of freshwater wetlands are wet meadows, marshes,
swamps and bogs. Bordering Vegetated Wetlands are areas where the soils are saturated and/or
1 inundated such that they support a predominance of wetland indicator plants. The boundary of Bordering
Vegetated Wetland is the line within which 50%or more of the vegetational community consists of wetland
indicator plants and saturated or inundated conditions exist.

The BVW is associated with the Pond located within the northern portion of Forest River Park. Vegetation
' within the BVW is dominated by a dense colony of common reed(Phragmites australis). Scattere&
individuals of mature sugar maple(Acer saccharum),red maple (Acer rubrum),and green ash(Fraxinus
' pennsylvanica)make up the canopy layer, and the shrub layer includes seedlings from the canopy and pussy
willow(Salix discolor), red-osier dogwood (Cornus sericea), glossy buckthorn(Rhamnus frangula), and
blackberry(Rubus spp.). Patches of Japanese knotweed(Polygonum cuspidatum) are also located on the
' edge of the BVW in places.
Bank
Bank is defined in 310 CMR 10.54 (2)(c)as the first observable break in slope or the mean annual flood
level, whichever is lower. The lower boundary of a Bank is the mean annual low flow level. Bank is
associated with the aforementioned Pond and is essentially coincident with Mean High Water which was
' estimated in the field based on indicators of high water such as changes in vegetation, as shown on the
Plans. The embankments are up to 4 feet along the southern shoreline and transition to the BVW system
' along the northern and eastern shoreline.
Coastal Beach
Coastal Beach is defined at 310 CMR 10.27(2)as an unconsolidated sediment subject to wave, tidal and
coastal storm action which forms the gently sloping shore of a body of salt water and includes tidal flats.
Coastal beaches extend from the mean low water line landward to the dune line, coastal bankline or the
seaward edge of existing man-made structures, when these structures replace one of the above lines,
whichever is closest to the ocean.
' Coastal Beach is present immediately south of the aforementionedRocky Intertidal Shore and extends
eastward from the concrete seawall to the Mean Low Water line. The Coastal Beach is primarily
comprised of fine to coarse sand with scattered cobbles and boulders throughout.
Salt Marsh
According to 310 CMR 10.32 (2), Salt Marsh means a coastal wetland that extends landward up to the
' highest high tide line, that is, the highest spring tide of the year, and is characterized by plants that are
well adapted to or prefer living in, saline soils. Dominant plants within salt marshes typically include salt
meadow cord grass (Spartina patens)and/or salt marsh cord grass (Spartina alterniora), but may also
' include, without limitation, spike grass (Distichlis spicata), high-tide bush (Iva frutescens), black grass
(Juncus gerardii), and common reedgrass (Phragmites). A salt marsh may contain tidal creeks, ditches
' and pools.
The salt marsh delineation was performed pursuant to 310 CMR 10.32 (2), as amended October 24,2014,
to include ALL plants adapted to saline conditions. The site contains a small, isolated patch of Salt Marsh
' within the Rocky Intertidal Shore,consisting primarily of salt marsh cordgrass(Spartina alternii lora). The
boundary was determined through visual observations and field survey of the footprint of vegetation.
tRocky Intertidal Shore
Rocky Intertidal Shore is defined at 310 CMR 10.31 as naturally occurring rocky areas, such as bedrock
' or boulder strewn areas between the mean high water line and the mean low water line.

.Rocky Intertidal Shore is present immediately east of the existing concrete seawall and extends seaward to
1 the Mean Low Water line. The Rocky Intertidal Shore is comprised of cobbles and boulders with coarse
sand and gravel located between and beneath the larger stones.
1 Coastal Bank
Coastal Bank is defined at 310 CMR 10.30)as the seaward face or side of any elevated landform, other
1 than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action,,or.
other wetland.
,Coastal Bank is essentially coincident with the top of the concrete seawall, located adjacent to the Coastal
1 Beach,Rocky Intertidal Shore, and Salt Marsh. The Coastal Bank is a non-eroding, manmade structure;
therefore, its function is limited to protection of the interests of Storm Damage Prevention and Flood
1 Control as defined in the Massachusetts Department of Environmental Protection(MassDEP)Wetlands
Protection Program Policy 92-1. The Coastal Bank does not supply sediment to the coastal system, but its
stability is important for storm damage prevention and flood control.
1 Land Subject to Coastal Storm Flowage
Land Subject to Coastal Storm Flowage is defined at 310 CMR 10.04 as land subject to any inundation
1 caused by coastal storms up to and including that caused by the 100-year storm, surge ofrecord or storm
of record, whichever is greater.
1 Salem Harbor landward to the seawall is mapped as Zone VE(el. 16), and a Zone AE(el. 11)extends from
the Coastal Flood Zone including the Forest River Park pond,Pioneer Village, baseball field, basketball
field, and a portion of the recreational field.
1 Land Containing Shellfish
Land Containing Shellfish is defined at 310 CMR 10.24 (2)as land under the ocean, tidal flats, rocky
1 intertidal shores, salt marshes and land under salt ponds when any such land contains shellfish. Shellfish
means the following species: Bay scallop (Argopecten irradians); Blue mussel(Mytilus edulis); Ocean
1 quahog(Arctica islandica); Oyster(Crassostrea virginica); Quahog(Mercenaria merceneria); Razor
clam (Ensis directus);Sea clam (Spicula solidissima);Sea scallop(Placopecten magellanicus);Soft shell
clam (Mya arenaria).
1 According to the MassGIS Database, the adjacent portion of Salem Harbor is considered suitable for soft
shell clam(Mya arenaria);however,the area is also mapped as a Prohibited Growing Area. No specific
studies of shellfish were conducted, but for the purposes of this filing, we presume shellfish habitat exists
1 within the resource areas located seaward of the seawall.
Proposed Project
1 ;The proposed project involves demolition and reconstruction of the existing 525-foot long seawall on the
Seaward boundary of Forest River Park in Salem,Massachusetts. The project also involves replacing an
1 80-foot long section of the wall with a rip-rap revetment, repaving upgradient parking areas and access
roads, removing the existing concrete ramp, and installing new stairs and a ramp. The total proposed
project footprint of work associated with the seawall repair project is 20,225 square feet. Demolition and
1 reconstruction of the seawall has been deemed necessary due to deteriorating conditions as described in

further detail within the Stormwater Management Report,prepared by Woodard &Curran (available
1 electronically upon request). Improving public safety and beach access are also significant factors in the
design and scope of the project.
1 The existing seawall will be replaced with a similar structure with a top of wall elevation set at 9.50. The
wall will be constructed on footings, as depicted on Sheet S-101 of the Plans and anew railing is proposed
along the top of the wall. The approximately 80-foot long section of the existing seawall(southern
1 section)will be replaced with a 2:1 sloped stone revetment, as depicted on Sheet C-200 of the Plans.
The existing ramp that extends onto the beach will be removed and replaced with a system of stairs,and a
1 ,new Americans with Disabilities Act(ADA)compliant ramp to the beach will be constructed, as depicted
on Sheet C-201 and S-100 of the Plans. The design of the new pedestrian ramp is"set-back" landward of
the wall in order to match the toe of the ramp with the edge of the seawall,resulting in a net gain in square
1 footage of the Coastal Beach.
The existing pavement upgradient from the seawall will be replaced with new pavement after minor
1 grading occurs as depicted on Sheet C-200 of the Plans. Temporarily disturbed uplands upgradient from
the rip-rap revetment will be restored with loam and seed.
1 According to Woodard & Curran,the proposed temporary disturbances are necessary and unavoidable due
to construction equipment access and work zone requirements associated with demolition and construction
of the new seawall. As noted above,the proposed project will involve temporary Coastal Wetland
1 Resource impacts as follows:
• Coastal Beach—4,363 square feet.
1 • Salt Marsh—207 square feet.
• Rocky Intertidal Shore—526 square feet.
1 • Coastal Bank—521 linear feet.
• Land Subject to Coastal Storm Flowage(LSCSF)—20,225 square feet
1 • Land Containing Shellfish—5,096 square feet
The excavation required to complete the project will be sequenced in a manner that will minimize amount
1 of open excavation at any one time and to facilitate restoration of the resource areas located within the
work footprint seaward of the wall. A Sediment Grain Size Analysis(Appendix C)was performed and, as
expected,the sediment is dominated by coarse-grained material with minimal fine particles. Excavated
1 soil will be stockpiled onsite at the previously approved upland location within Forest River Park, with
care taken to separate materials that are specific to each resource area(i.e. separate pile of Coastal Beach
soil, pile of Salt Marsh soil and stones, pile of Rocky Intertidal Shore soil and stones). Temporarily
1 stockpiled soil will be stabilized as necessary to prevent erosional potential. Upon completion of seawall
construction,the soil will be re-placed within the appropriate Coastal Resource Area from which it
1 wasexcavated(Coastal Beach, Salt Marsh,and Rocky Intertidal Shore). Final grades will be restored to
approximate preconstruction elevations and contours.
In addition to restoration of the soil profile within the associated Salt Marsh, planting of S. alterniora
1 plugs will occur as depicted in the Salt Marsh Planting detail on Sheet C-300 of the Plans. Post-

construction monitoring of the Salt Marsh plantings will occur for two full growing seasons, with annual
1 monitoring reports submitted to the Commission at the end of each growing season.
Various erosion, sedimentation,and turbidity controls,as well as BMPs,will be used and maintained
1 during construction for stabilization purposes. Temporary steel sheeting is proposed along the seaward
limit of work to protect the adjacent resource areas during soil excavating, concrete pouring activity, and to
prevent construction-related sediment-producing activity. Where dewatering is necessary during
1 excavations and pouring operations,a dewatering plan shall be submitted to the Commission by the
Contractor. The dewatering plan shall be designed to ensure no construction-related, sediment-producing
activity to cause turbidity in flowing tidal waters due to proposed dewatering. Erosion controls will be
1 inspected/maintained for the entirety of the project until vegetated stabilization is achieved.
Summary
1 On behalf of the City of Salem,LEC Environmental Consultants, Inc. (LEC) is submitting this combined
Application for a Waterways License and Water Quality Certification to the Massachusetts Department of
1 Environmental Protection(DEP)under the Public Waterfront Act(Chapter 91, section 10)and Section 401
of the Federal Clean Waters Act(33 U.S.C. s.1251 et sea.)and the Massachusetts Clean Water Act
:(M.G.L. c.21, ss. 26-53), respectively,for the Forest River Park Seawall Repair Project, located in Salem,
1 Massachusetts. The seawall will be rebuilt to meet current standards, and safe public access to the beach
will be improved by the project. The project will involve work activity within coastal Wetland Resource
1 Areas, including Salt Marsh, Coastal Beach,Rocky Intertidal Shore, Land Containing Shellfish,and Land
Subject to Coastal Storm Flowage; however, all disturbances will be temporary in nature with each
resource area fully restored post-construction.

' ® Submit one original of all drawings. Submit the fewest number of sheets necessary to adequately
illustrate the project on 8-1/2 inch X 11 inch paper.
' ® A 1-inch margin should be left at the top edge of each drawing for purposes of reproduction and
binding. A 1/2 inch margin is required in the three other edges.
® A complete title block on each drawing submitted should identify the project and contain:the
' name of the waterway; name of the applicant; number of the sheet and total number of sheets in

18. Nature of Activity(Description of project,include all features)
' the overall proposed project involves the demolition and reconstruction of the existing 525-foot long seawall on the seaward boundary of
Forest River Park in Salem,Massachusetts.The total proposed project footprint is 20,225 square feet
-the new seawall design includes 8'footings below grade and replacing an 80-foot long section of the wall with a rip-rap revetment
' -repaving up-gradient parking areas and access roads
-removing the existing concrete ramp and installing new stairs and a ramp(to meet ADA standards)
-temporarily disturbed uplands up-gradient from the rip-rap revetment will be restored with loam and seed
- excavated soil will be stockpiled on-site with care to separate materials that are specific to each resource area for restoration purposes
' various temporary soil erosion,sediment and turbidity controls as well as BMPs will be used and maintained during construction for
stabilization purposes.Temporary steel sheeting is proposed within the coastal resource areas as a mitigating measure.

-The purpose of the proposed project is to demolish and reconstruct the deteriorating seawall mentioned herein.
-1n its current state the structural integrity of this seawall appears to be at least partially compromised. The wall is at risk of further
deterioration from coastal storm forces that could cause damage to not only the wall but also the adjacent shoreline that is protected by this
wall,and cause damage within the adjacent Forest River Park located in the landward side of the seawall that is undergoing extensive
improvements as part of a multi-million-dollar flood mitigation project and functions as a important recreational area in the community.
-The seawall is in poor condition and is exhibiting various degree of disrepair,including but not limited to the following:spalling,
cracking,extensive cracking and spelling at pipe penetrations,open vertical joints,with spelling along the joints and no sealant,surface
deterioration,there is out-of-plane deflections of sections of wall relative to adjacent walls sections,steel ramp railings have visible
corrosion and do not appear to be code compliant. Work is anticipated to start Spring of 2018 and end TBD.

Upon completion of a alternative analysis for the above mentioned project,it was determined that a full rebuild was the only solution as a
"repair option"was cost prohibitive and a"no build"option would result in failure ofthe seawall. The proposed project has been designed
to minimize the proposed temporary impacts. Sheet piling is proposed along the seaward edge ofthe"limits of work"to establish a barrier,
' preventing off-site disturbance. All proposed work will be done in conjuncture withing the confines of regulatory compliance. The
proposed project will not result in any permanent disturbance of any coastal resource area and therefore,no compensation is proposed.

' 17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated
Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be
marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall
' be maintained until a Certificate of Compliance has been issued by the Conservation
Commission.
' 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have
been fully stabilized with vegetation or other means.At no time shall sediments be
deposited in a wetland or water body. During construction, the applicant or his/her designee
shall inspect the erosion controls on a daily basis and shall remove accumulated sediments
' as needed. The applicant shall immediately control any erosion problems that occur at the
site and shall also immediately notify the Conservation Commission, which reserves the
right to require additional erosion and/or damage prevention controls it may deem
' necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
19. The work associated with this Order(the"Project")
' (1)® is subject to the Massachusetts Stormwater Standards

e) Unless and until another party accepts responsibility, the landowner, or owner of any
drainage easement, assumes responsibility for maintaining each BMP. To overcome this

BMPs. A plan and easement deed that grants the responsible party access to perform the
required operation and maintenance must be submitted along with the legally binding
agreement. '
f) The responsible party shall operate and maintain all stormwater BMPs in accordance
with the design plans, the O&M Plan, and the requirements of the Massachusetts
Stormwater Handbook. '

g) The responsible party shall:
1. Maintain an operation and maintenance log for the last three(3)consecutive
' calendar years of inspections, repairs, maintenance and/or replacement of the
stormwater management system or any part thereof, and disposal (for disposal the

2. Make the maintenance log available to MassDEP and the Conservation
Commission ("Commission") upon request; and

h) All sediment or other contaminants removed from stormwater BMPs shall be disposed

' Based on the Estimated Habitats of Rare Wildlife and Certified Vernal Pools Map(6/22/2017, online) from Natural
Heritage&Endangered Species Program (NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has
' been determined that this project does not occur near any habitat of state-listed tare wildlife species nor contain any
vernal pools.
This Order permits replacement of the existing seawall with a new seawall structure,replacing an 80-foot section of
' the seawall with a sloped rip-rap revetment, removing the existing beach access ramp and replacing it with new
stairs and a new ramp,and repaving the adjacent access road and parldng area per Notice of Intent and Stormwater
Report submitted 5/26/2017,approved plans listed below,and these conditions.
GENERAL CONDITIONS
' 1• This Order of Conditions must be recorded in its entirety(including all 5 pages of Special Conditions)
at the Essex County Registry of Deeds or the Land Court for the district in which the land is located,
after the expiration of the 10-day appeal period and within 30 days of the issuance. A copy of the
' recording information must be submitted to the Salem Conservation Commission before any
work approved in this Order commences.
2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131, Section 40,Wetlands to
310 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance, Salem Code Chapter 50.
' 3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones,other than that approved in this Order,
shall occur on this property without prior approval from the Commission.
4. Prior to any work commencing on site,a DEP Sign showing DEP File#64-632 must be installed at the
entrance to the site and seen from the public way,but not placed on a living tree.
' 5. No work approved in this Order may commence until the ten(10)day appeal period has lapsed from the
date of the issuance of this Order.
' 6. With respect to this Order,the Commission designates the Conservation Agent as its agent with powers
to act on its behalf in administering and enforcing this Order.

and this Order of Conditions. The Commission shall be notified in writing within 30 days of all
transfers of title of any portion of the property that takes place prior to issuance of the Certificate of
Compliance.
9. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and '
approvals associated with this project. These permits may include but are not necessarily limited to the
following: '
(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816),U.S.Army
Corps of Engineers. '
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of see.27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) Sewer Extension Permit from the DEP Division of Water Pollution Control under G.L. Ch. 21A ss7
and 314 CMR 7.00. Any Board of Health permit for septic system design for any portion of the '
septic system within 100 feet of wetlands shall be submitted to the Commission prior to
construction initiation.
(4) Design Requirements for Construction in Floodplains under the State Building Code(780 CMR '
744.).
10. If there are conflicting conditions within this Order,the stricter condition(s)shall rule. ,
11. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.

' PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above,there
must be a Pre-Construction Meeting on site between the project supervisor,the contractor responsible
for the work,and the Conservation Agent and/or a member of the Conservation Commission to ensure
that the requirements of the Order of Conditions are understood. The staked erosion control line shall be
adjusted,if necessary,during the pre-construction meeting. Please contact the Conservation Agent at
' (978)619-5685 at least forty-eight(48)hours prior to construction to arrange for the Pre-
Construction Meeting.
' 19. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Agent shall inspect and approve such installation at the pre-construction
' meeting.
20. No clearing of vegetation,including trees,or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be adequate additional erosion and sediment controls stored onsite for emergency purposes.
EROSION CONTROL
' 22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in any wetland resource area and/or buffer zones. The
erosion control measures shown on the approval plan(s)and provisions in the Order will be the minimum
' standards for this project; the Commission or its Agent may require additional measures.
23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment from entering wetland resource areas.
t 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
' 25. The area of construction shall remain in a stable condition at the close of each construction day.

26. Any de-watering of trenches or other excavation required during construction shall be conducted so as '
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through straw bale sediment traps, silt filter bags or other means approved by the Commission or its '
Administrator.
27. Within thirty(30)days of completion of construction on any given portion of the project,all disturbed '
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer than two(2)months,a temporary cover of rye or other grass t
should be established to prevent erosion and sedimentation. If the season is not appropriate for plant
growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly
anchored,to prevent soils from being washed by rain or flooding. '

29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.

39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to
the Conservation Commission to request a Certificate of Compliance(COC):
(1) A Completed Request for a Certificate of Compliance form(WPA Form SA or other form if '
required by the Conservation Commission at the time of request).

' (3) An"As-Built"plan signed and stamped by a Registered Professional Engineer or Land Surveyor
showing post-construction conditions within all areas under the jurisdiction of the Massachusetts
Wetlands Protection Act. This plan shall include at a minimum:
(a) All wetland resource area boundaries with associated buffer zones and regulatory setback
areas taken from the plan(s)approved in this Order of Conditions;
' (b) Locations and elevations of all stormwater management conveyances,structures and best
management designs,including foundation drains,constructed under this Order within any
wetland resource area or buffer zone;
' (c) Distances from any structures constructed under this Order to wetland resource areas-
"structures"include,but are not limited to,all buildings,septic system components,wells,
utility lines,fences,retaining walls,and roads/driveways;
(d) A line delineating the limit of work-"work"includes any filling,excavating and/or
' disturbance of soils or vegetation approved under this Order;
40. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds
' and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions,the report must specify how
' the work differs; at which time the applicant shall fust request a modification to the Order. Only upon
review and approval by the Commission,may the applicant request in writing a Certificate of
Compliance as described above.
' 42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Agent has authorized
their removal.
