The new construction will increase the size of the facility from its present size,4,900 square feet, to approximately 15,000 square feet. The 21,490 square feet site will consist of the two new buildings, a children's play area, and additional parking., The public hearing was continued to July 10, 2003, July 17, 2003, September 4, 2003, September 18, 2003, October.2, 2003, and November 6, 2003. The Public Hearing was closed on November 6, 2003. At a regularly scheduled meeting of the Planning Board held on November 6, 2003, the Board voted by a vote of eight in favor(Power,Durand, Moustakis, Puleo, Lombardini, Sullivan, Weiner, Collins), none opposed, to approve the application as complying with the requirements of Site Plan Review subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "Site Plan for The Salvation Army at#93-95 North Street, Route 114, Salem, Mass.," sheets 1-7, prepared by Patrowicz Land Development Engineering, 60 Washington Street, Salem, MA 01970 dated SeptembeF 25, 2003, revised through November 5, 2003; and sheets S-1, A-1, A-2, and A-3 prepared by Elliot Associates Architects, Inc., PO Box 105, Belmont, MA, dated May 20, 2003 120 WASHINGTON STREET, SALEM, MASSACHUSETTS 01970 .TEL: 978.745.9595 FAx: 978.740.0404 0 WWW.SALEM.COM 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum of 3 '1/2" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. Any street trees removed as a result of construction shall be replanted. The location of the trees shall be approved by the City Planner prior to replanting. e. Final completed landscaping shall be subject to approval by the City Planner prior to the issuance of a Certificate of Occupancy. 4. Signage Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 5. Noise Following occupancy of the building, if the Department of Planning &Community Development receives any complaints concerning noise emanating from the air conditioner units, the applicant shall be required to show that the decibel level is no higher than the pre- development level and if so, shall submit a plan for review and approval by the City Planner to make any improvements necessary. 6. HVAC If an HVAC unit is located on the roof or site, it shall be visually screened. The method for screening the unit shall be submitted to the City Planner for review and approval prior to installation. 7. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b.A final lighting plan, particularly showing the rear parking lot, shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. c. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 8. Traffic Flow The applicant shall direct drop-offs to the rear of the building. 2 9. Gates The applicant shall submit a specification for the gate to be placed along Waters Street, at the entrance, to the City Planner for review and approval prior to,the installation of a Certificate of Occupancy. 10. Sidewalk The applicant shall replace the sidewalk along North Street with concrete for the entire length of the parcel's property line (approximately 110 feet). Specifications shall be submitted to the Department of Public Services for review and approval prior to the issuance of a building permit. All work shall be coordinated through the Department of Public Services. 11.Fencing a. The applicant shall submit specifications for the fence proposed to enclose the playground to the City Planner for review and approval prior to the issuance of a Building Permit. _ b. The applicant shall submit specifications for the fence to be replaced along the eastern property line to the City Planner for review and approval prior to the issuance of a Building Permit. 12.Maintenance of the Water Quality Inlet/Debris Collector The applicant, his successors or assigns shall maintain the water quality inlet/debris collector, not the City of Salem. 13. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays.The Planning Board will agree to any proposed changes in the starting time, if approved by a formal vote of the City Council. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Any drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they exit the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 3 f. All construction vehicles left overnight at the site, must be located completely on the site. g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant prior to the issuance of a building permit. Included in this plan, but not limited to, shall be a demolition plan, information regarding how the construction equipment will be stored, a description of the construction staging area and its location in relation to the site, and where the construction employees will park their vehicles. The plan and schedule shall be submitted and approved by the City Planner prior to the issuance of a Building Permit. 14. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 15. Board of Health All work shall comply with the requirements of the Salem Board of Health, if applicable. 16. Department of Public Services _ The applicant, his successors or assigns shall comply with all requirements of the Department of Public Services 17. Fire Department All work shall comply with the requirements of the Salem Fire Department. 18. Department of Public Properties All work shall comply with the requirements of the Department of Public Properties. 19. Utilities Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 17. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or.assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 18. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Department of Planning and Community Development and Department of Public Works prior to the issuance of the final Certificate of Occupancy. 4 19. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Site Plan Review shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title. WHEREAS the City granted a Site Plan Review Decision to the Army dated November 6, 2003, recorded with the Essex South District Registry of Deeds in Book 22301, Page 405 (the "Decision") approving the construction of a new church and facility (the "Project") at the property located at 93- 95 North Street, Salem, Essex County, Massachusetts (the "Property) ; and WHEREAS, pursuant to the Decision, the Project is substantially complete; however, the City requires the items listed on the Punchlist attached hereto as Exhibit "A" to be completed prior to the issuance of a Certificate of Occupancy for the Property; and s WHEREAS, the Army desires to open for church services on April 9, 2006, but cannot complete the Punchlist items prior to that time. NOW, THEREFORE, the parties hereby agree as follows: 1. To escrow the sum of Twenty-Seven Thousand One Hundred Twenty-Four Dollars ($27, 124 . 00) (the "Escrow Sum") to ensure the completion of the Punchlist items, which amount is herewith delivered to the City to be held by the City in escrow in accordance with the provisions of this Agreement; 2 . The City shall hold the Escrow Sum pending the completion of the items on the Punchlist by the Army. Upon receipt of the funds from the Army, the City shall promptly issue a Certificate of occupancy for the Property so as to allow for the preparation and holding of church services for the public on April 9, 2006; 3 . The Army shall use diligent efforts to complete the items, at its sole cost and expense, as soon 1 04/OJ/,2006 14:06 FAX 40004/004 as possible, but in no event later than June 30, 2006, unless agreed to in writing by the parties; 4 . Following completion of all Punchlist items, as agreed to by the City, the City shall release to the Army the Escrow Sum, with any interest remaining with the City; and 5. Should the Army fail to complete the work listed on the Punchlist attached as Exhibit "A" pursuant to the terms of this Agreement, then the City is hereby authorized to use the Escrow Funds to pay for the completion of the work.
