Chapter 91 (c.91), the Public Waterfront Act, and the Waterways Regulations at 310 CMR 9.00, and its intent to approve the referenced application, subject to the attached conditions. Juniper Point 9 South Mason Street, LLC (the "Applicant'), requests authorization pursuant to M.G.L. c.91 and applicable provisions of 310 CMR 9.00 to rehabilitate, expand, and convert an existing industrial building into a residential building and construct and maintain a new residential townhouse-style building with associated parking, vehicular circulation, site lighting, connecting walkways, landscaping, utilities, and stormwater management system located on filled tidelands of the North River at 9 South Mason Street, 3A Buff m. Street Extension, and 23 Mason Street in Salem, Essex County (the "project site"). - The total project site encompasses 56,623-square feet, of which approximately 28,260-square feet (or 49.9% of the site) consists of previously authorized filled private tidelands and the remaining 28,363-square feet(or 50.1% of the site) consists of non-jurisdictional uplands. The entire proposed project consists of a four (4) building, 29-unit residential redevelopment at 9 South Mason Street, 3A Buffum Street Extension, and 23 Mason Street. TTY#MassRelay service 1-800-939-2370 - MassDEP Websites www.mass.gov/dep Printed on Recycled Paper Written Determination and Draft Special Conditions Page 2 of 11 Waterways Application NQ: W 17-4957-N South Mason Street Redevelopment,North River,Salem, Essex County #2 and Building #4 shown on Sheet 2 of 5.of Draft License Plans No. W17-4957-N) at 9 South Mason Street each with 6-residential units; the rehabilitation, expansion, and conversion of an existing 3-story industrial building (Building #1 shown on Sheet 2 of 5 of said plans) at 9 South Mason Street into a 4-story (including basement storage area) 10-unit residential building; the demolition of an existing 1-story garage at 23 Mason Street, and the rehabilitation and expansion of an existing 3-story residential building (Building #3 shown on Sheet 2 of 5 of said plans) at 3A Buffiun Street Extension parcel into 7-residential units. Only Building #1 and Building #4 are located within c.91 jurisdiction, while Building #2 and Building #3 are located entirely outside of c.91 jurisdiction. Said project also includes surface parking, vehicular circulation, landscaping, site lighting, connecting walkways, underground utilities, and a stormwater management system. Findings: 1) The Department determines that the use of filled Private Tidelands for parking, residential housing units, internal vehicular roadways, stormwater management, and transmission of underground utilities are nonwater-dependent uses pursuant to 310 CMR 9_12(2)(f)(3), (5), (8), and 310 CMR 9.12(4), respectively. 2) The Department determines that 28,260-square feet of the 56,623-square feet project site consists of filled Private Tidelands. In this case, the historic high water mark derives from U.S. Coast Survey Plan (Sheet T-303-2) titled"Map of Salem Harbor including the City and Islands" dated 1849. 3) The Department determines that the required Public Notice was published in the Salem News and in the Environmental Monitor on May 10, 2017. The required Public Hearing was held on May 18, 2017 at 4:00pm at Salem City Hall Annex, Meeting Room 313, 120 Washington Street, Salem. No public comments were received by the Department prior to the June 9, 2017 comment period deadline. However, one (1) late comment letter from was received by the Department on June 20, 2017 from Eric Papetti (Salem Resident). 4) The Applicant has submitted relevant documentation regarding compliance with other regulatory requirements including the Massachusetts Environmental Policy Act (EEA #15661) ENF Certificate issued on March 22, 2017, the Wetlands Protection Act per Order of Conditions (DEP File #64-624) issued by the Salem Conservation Commission on March 31, 2017, . Municipal Zoning Certification signed by the City of Salem Building Commissioner on April 10, 2017, and the Planning Board Notification Form signed by a City of Salem Director of Planning and Community.Development on April 10, 2017. 5) The project site is regulated under M.G.L. Chapter 21E, 310 CMR 40.0000, and the Massachusetts Contingency Plan (MCP) by the Department's Northeast Regional Office (NERO) Bureau of Waste Site Cleanup (BWSC) and pursuant to the provisions of an Activity and Use Limitation (AUL) associated with Release Tracking Numbers (RTN) #3- 3959 and RTN#3-33324. Written Determination and Draft Special Conditions Page 3 of 11 Waterways Application NO: W 17-4957-N South Mason Street Redevelopment,North River, Salem, Essex County 6) The Department determines that the project, as conditioned, complies with all applicable standards of the Waterways Regulations, including the special provisions for nonwater- dependent use projects at 310 CMR 9.51 through 9.53. a. The project does not have a Water Dependent Use Zone (WDUZ) as it is separated from shoreline by an intervening properties and a public roadway, therefore the requirements at 310 CMR 9.51(3)(c) are not required. b. The project meets the Facilities of Private Tenancy (FPT) setback requirement at 310 CMR 9.51(3)(b), as no FPTs nor private parking are located within 100-feet of the mean high water mark within c.91 jurisdiction. c. The project also meets the lot coverage requirements at 310 CMR 9.51(3)(d), by providing more than 50% open space on the portion of the project site located within c.91 jurisdiction. Specifically, approximately 8,667-square feet (30.7%) of the project site located within c.91 jurisdiction is covered by a nonwater- dependent building footprint, while the remaining 19,593-square feet (69.3%) of. the site located within c.91 jurisdiction consist of open space. 7) The Department has determined that the building has been designed to address sea level rise, as required by 310 CMR 9.37(2), as the elevation of the first habitable floor of the buildings located within c.91 jurisdiction (Building #1 and #4) and the 100-year flood zone (Zone AE base flood elevation = 10.00-feet NAVD88), are proposed to located at elevation 13.5-feet NAVD88 (for Building #4) and 16.7-feet NAVD88 (for Building #1) both of which are above said flood zone. 8) The Department determines that the project as conditioned serves a proper public purpose that provides greater benefit than detriment to the rights of the public in tidelands in accordance with 310 CMR 9.31(2)(b). The proposed project involves the redevelopment of a former industrial site into a residential development with a stormwater management system. The project will also include a connecting walkways to the adjacent public way in order to meet 310 CMR 9.52(2). 9) The Department presumes that the proposed project is consistent with all applicable Coastal Zone Management(CZM)policies, in accordance with M.G.L. c.91 § 18 and 310 CMR 9.13(2)(x). Conclusion: On the basis of the foregoing analysis, the Department will approve the proposed structures and uses described herein, as shown on the draft license plans and as shall be modified and delineated on the final license plans in accordance with the terms of this Determination. This Determination is subject to the attached Special Conditions to be carried out by the referenced Applicant (hereinafter the "Licensee"). These Special Conditions will be included, in substantially the same form, along with the Standard Conditions, with the final Chapter 91 Waterways License to be issued pursuant hereto. This Determination, including the attached Special Conditions, is subject toappeal as described in more detail in the Notice of Appeal Rights section on Pages 5 and 6. The following persons shall have the right to an adjudicatory hearing concerning this decision by the Department to grant or deny a license or permit, in accordance with 310 CMR 9.17(1): (a) an applicant who has demonstrated property rights in the lands in question, or which is a public agency; (b)any person aggrieved by the decision of the Department to grant a license or permit who has submitted written comments within the public comment period; (c) ten (10) residents of the Commonwealth who, pursuant to M.G.L. Chapter 30A, § 10A, have submitted comments within the public comment period with at least 5 of the 10 residents residing in the municipality(s) in which the license or permitted activity is located. The appeal shall clearly and specifically state the facts and grounds for the appeal and the relief sought, and each appealing resident shall file an affidavit stating the intent to be part of the group and to be represented by its authorized representative; (d) the municipal official in the affected municipality who has submitted written comments within the public comment period; and (e) CZM, for any project identified in 310 CMR 9.13(2)(a)for CZM participation or 310 CMR 9.13(2)(b) for DCR participation, if it has filed a notice of participation within the public comment period. Dismissal of request The request for appeal will be dismissed if the filing fee is not paid, unless the appellant is exempt or is granted a waiver. Exemptions The filing fee is not required if the appellant is a city or town(or municipal agency), county, or district of the Commonwealth of Massachusetts,or a municipal housing authority. Waiver The Department may waive the adjudicatory hearing filing fee pursuant to 310 CMR 4.06(2)for a person who shows that paying the fee will create an undue financial hardship. Written Determination and Draft Special Conditions Page 8 of 11 Waterways Application NO: W 17-4957-N South Mason Street Redevelopment,North River, Salem, Essex County Specific Legislative Authorizations and/or Licenses issued previously at the project site include: Chapter 162 of the State Legislative Acts of 1878. The authorized structures and/or fill shall be maintained in accordance with the terms and conditions of said licenses and plans, or as further modified herein. The structures authorized hereby shall be limited to the following uses: residential, surface parking, vehicular circulation, conveyance of stormwater, and the transmission of underground utilities. This License is valid for a term of thirty (30) years from the date of issuance. By written request of the Licensee for an amendment, the Department may grant a renewal for the term of years not to exceed that authorized in this license. This Determination is subject to the following Special Conditions and Standard Conditions. These Special Conditions will be included, in substantially the same form, along with the Standard Conditions,with the Chapter 91 Waterways License to be issued pursuant hereto. Special Condition 1: Issuance of this authorization does not relieve the Licensee of the obligation to comply with all other applicable State or Federal statutes or regulations. Any changes made to the project as described in Waterways License Application No. W17-4957-N and associated Draft License Plans referenced above will require further notification to and approval by the Department in accordance with 310 CMR 9.22(3) or 9.24. Special Condition 2: All work authorized herein shall be completed within five (5) years of the date of License issuance. Said construction period may be extended by the Department for one or more one year periods without public notice, provided that the Licensee submits to the Department no later than thirty (30) days prior to.the expiration of said construction period a written request to extend the period and provides an adequate justification for said extension. Special Condition 3: The use by the public of the publicly accessible areas at the project site shall be considered a permitted use, to which the limited liability provisions of M.G.L. Chapter 21, § 17c shall apply. Special Condition 4: The Licensee shall provide to the Department, within thirty (30) days of receipt, adequate proof of issuance of the first Certificate of Occupancy on the project site as well as any other documentation requested in the Special Conditions above. Written Determination and Draft Special Conditions Page 9 of 11 Waterways Application NO: W 17-4957-N South Mason Street Redevelopment,North River, Salem, Essex County Special Condition 5: The Licensee shall allow agents of the Department to enter the project site to verify compliance with the conditions of the Chapter 91 License to be issued hereto. Special Condition 6: The Licensee shall request in writing that the Department issue a Certificate of Compliance in accordance with 310 CMR 9.19. The request shall be accompanied by a certification by a registered professional engineer licensed to do business in the Commonwealth that the project was completed in accordance with the License. Special Condition 7: The Written Determination shall remain valid for up to one (1) year after issuance. Said term may be extended for one (1) or more one (t) year periods, provided that the Applicant submit to the Department, thirty (30) days prior to the expiration of said term a written request to extend the term and provides adequate justification for said extension. This condition shall expire upon issuance of the License to be issued pursuant hereto. Written Determination and Draft Special Conditions Page 10 of 11 Waterways Application N°: W 17-4957-N South Mason StreetRedevelopment,North River, Salem, Essex County STANDARD WATERWAYS LICENSE CONDITIONS 1) Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform to all terms and conditions stated herein. 2)This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3) Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4) This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth herein. This License may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways License void and the Commonwealth may proceed to remove or cause removal of any structure or fill authorized herein at the expense of the Licensee, its successors and assigns as an unauthorized and unlawful structure and/or fill. 5) The structures and/or fill authorized herein shall be maintained in good repair and in accordance with the terms and conditions stated herein and the details indicated on the accompanying license plans. 6)Nothing in this Waterways License shall be construed as authorizing encroachment in,on or over property not owned or controlled by the Licensee, except with the written consent of the owner or owners thereof. The Licensee stated Nine South Mason Street Realty Trust(9 South Mason Street),Salem Residential Development Property,LLC(3A Buffum Street Ext),and Noci Arben(23 Mason St)were the property owner at the time the application was submitted on April 12,2017. 7) This Waterways License is granted subject to all applicable Federal, State, County, and Municipal laws, ordinances and regulations including but not limited to a valid final Order of Conditions issued pursuant to the Wetlands Protection Act,M.G.L.Chapter 131 §40. 8) This Waterways License is granted upon the express condition that the use of the structures and/or fill authorized hereby shall be in strict conformance with all applicable requirements and authorizations of the DEP. 9) This License authorizes structure(s)and/or fill on: Private Tidelands. In accordance with the public easement that exists by law on private tidelands,the licensee shall allow the public to use and to pass freely upon the area of the subject property lying between the high and low water marks,for the purposes of fishing,fowling,navigation,and the natural derivatives thereof. Commonwealth Tidelands. The Licensee shall not restrict the public's right to use and to pass freely, for any lawful purpose, upon lands lying seaward of the low water mark. Said lands are held in trust by the Commonwealth for the benefit of the public. a Great Pond of the Commonwealth. The Licensee shall not restrict the public's right to use and to pass freely upon lands lying seaward of the high water mark for any lawful purpose. Navigable River or Stream. The Licensee shall not restrict the public's right to use and to pass freely, for any lawful purpose,in the waterway. No restriction on the exercise of these public rights shall be imposed unless otherwise expressly provided in this license. 10)Unless otherwise expressly provided by this license,the licensee shall not limit the hours of availability of any areas of the subject property designated for public passage, nor place any gates, fences, or other structures on such areas in a manner that would impede or discourage the free flow of pedestrian movement thereon.
