Specific Legislative Authorizations and Licenses issued previously at the project site include: _ Chapter 162 of the Massachusetts Legislative Acts of,1878, Harbor and Lands Commission (H&L) License No. 605 issued in 1881 and H&L License No. 606 issued in 1881, H&L License No. 3941 issued in 1915, Department of Public Works (DPW) License No. 1535 issued in 1933, DPW License No. 2886 issued in 1946, and DPW License No. 3592 issued in 1953. These authorized structures and fill shall be maintained in accordance with the terms and conditions of said licenses and plans, or as modified herein. The structures authorized hereby shall be limited to the following uses: existing nonwater- dependent commercial building with Facilities of Public Accommodations, vehicular parking and circulation, public. access to and enjoyment of waterfront open space for passive recreational purposes, shoreline stabilization, and conveyance and discharge of stormwater. This License is valid for a term of thirty (30) years from the date of issuance. By written request of the Licensee for an amendment, the Department may grant a renewal for the term of years not to exceed that authorized in this license. This License is subject to the following Special Conditions and Standard Conditions: Special Condition 1: The Licensee shall ensure that all environmental remedial actions are performed in compliance with the Massachusetts Contingency Plan under the supervision of a Licensed Site Professional (RTN#3-2131, as may be amended). Waterways License N2: 14054 Page 3 of 8 Grove Street Apartment, Salem, Essex County Special Condition 2: The Licensee, or its contractor, shall not perform any in-water sediment producing work during the time of year restrictions, from March 1st to June 1st of any year, as required by the Massachusetts Division of Marine Fisheries in order torotect the migration gration and spawning of marine fisheries resources and diadromous fish. Special Condition 3: The Licensee may maintain the upper floors of the existing building at 60 Grove Street as commercial nonwater-dependent uses. However, the ground floor of the existing building located within 100-feet of the high water mark shall bero r p g ammed as a Facility of Public Accommodation (FPA) and/or as a water-dependent use. Any use specifically listed in the FPA definition at 310 CMR 9.02 shall be presumed to meet the above requirements for such facilities. Conversely, any use proposed as a FPA on the ground floor that is not specifically listed in the regulatory definition shall require prior review and approval of the Department. Any change in use of said building from that which has been authorized herein or any substantial structural alteration shall require a new Chapter 91 Waterways License. Special Condition 4: No parking for any use shall be permitted within the 25-foot wide Water Dependent Use Zone at 60 Grove Street, as depicted on License Plan Sheet 3 of 9 and Landscaping Plan Sheet L-1 dated December 18, 2015 on file with the Department. Special Condition 5: The Licensee shall construct and maintain in good repair a network of public open space with no obstacles for safe, free and universally accessible public passage. All open space shall be accessible twenty-four (24) hours a day with no gates or other barriers installed to impede public pedestrian circulation. The open space shall include the following components as described on License Plan Sheets 3 and 4 of 9 and as further detailed on Landscaping Plan Sheets L-1 and L-2 dated December 18, 2015 on file with the Department: a) An approximately 1,020-linear foot pedestrian/bicycle path("public accessway")that has a minimum unobstructed width of 10-feet and is constructed of bituminous concrete or other Massachusetts Architectural Access Board (MAAB) accessible material. The public accessway shall connect seamlessly to, and meet the existing elevation of, the existing adjacent sidewalks to the southeast of the project site along Grove Street and to the north of the project site along Harmony Grove Road. Wayfmding signs for the public accessway shall be posted at each entrance, as further described and required in Special Condition#6 below. b) The public open space shall include, but is not be limited to, the paved public accessway and the following public amenities: benches, bike racks, lighting,trash receptacles, signage, trees and other landscaping that complements but does not obstruct public access. c) The public open space shall be completed and shall be available for safe pedestrian use by the issuance date of the fust Certificate of Occupancy for the Project Site except for installation of landscape elements governed by seasonal opportunity. In any case, the exterior open space landscaping shall be completed no later than six (6) months after the issuance of such Certificate of Occupancy. Waterways License No: 14054 Page 4 of 8 Grove Street Apartment, Salem, Essex County d) Within twenty-four (24) hours of a snow event, all,snow shall be removed from the' public accessway and stored in a designated snow storage areas onsite. No snow shall be disposed p of into the North River. e) Adequate lighting shall be installed and maintained in good repair at appropriately spaced intervals along the entire length of the public accessway, with special attention being paid to both entrances to the share use path. Special Condition 6: The Licensee shall install and maintain in good repair two (2) wayfinding signs of adequate size to be clearly visible to pedestrians from both public accessway entrances: one (1) at Grove Street and one (1) at Harmony Grove Road. Said signs shall be designed in accordance with all local laws and regulations, with the City of Salem's Sign Specifications, and with the Department's Sign Specifications attached hereto. Prior to fabrication and installation of said signs, the Licensee shall submit a draft sign plan to the City of Salem Department of Planning and Community Development for review and approval of the sign specifications and proposed installation locations. A copy of City approval and final approved plans/specifications shall be provided to the Department no later than thirty(3 0)days after City approval. Special Condition 7: The use by the-public of the publicly accessible areas at the project site shall be considered a permitted use to which the limited liability provisions of M.G.L. Chapter 21, § 17c shall apply. Special Condition 8: The Licensee shall allow agents of the Department to enter the project site to verify compliance with the conditions of the Chapter 91 License. Special Condition 9: Pursuant to 310 CMR 9.22, the Licensee may undertake minor project modifications upon written notice to, and approval by,the Department. Special Condition 10: All work authorized herein shall be completed within five (5) years of the date of License issuance. Said construction period may be extended by the Department for one (1) or more one (1) year periods without public notice, provided that the Licensee submits to the Department no later than thirty (30) days prior to the expiration of said construction period a written request to extend the period and provides an adequate justification for said extension. Special Condition 11: The Licensee shall provide to the Department, within thirty (3 0) days of receipt, adequate proof of issuance of the first Certificate of Occupancy on the project site as well as any other documentation requested in the Special Conditions above. Special Condition 12: The Licensee shall request in writing that the Department issue a Certificate of Compliance in accordance with 310 CMR 9.19. The request shall be accompanied by a certification by a registered professional engineer licensed to do business in the Commonwealth that the project was completed in accordance with the License. Waterways License N2: 14054 Page 6 of 8 Grove Street Apartment, Salem, Essex County STANDARD WATERWAYS LICENSE CONDITIONS 1. Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform with all terms and conditions stated herein. 2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3. Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4. This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth herein. This License may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways License void and the Commonwealth may proceed to remove or cause removal of any structure or fill authorized herein at the expense of the Licensee, its successors and assigns as an unauthorized and unlawful structure and/or fill. 5. The structures and/or fill authorized herein shall be maintained in good repair and in accordance with the terms and conditions stated herein and the details indicated on the accompanying license plans. 6. Nothing in this Waterways License shall be construed as authorizing encroachment in, on or over property not owned or controlled by the Licensee, except with the written consent of the owner or owners thereof. The Licensee stated that MRM Project Management. LLC was the property owner at the time the application was submitted on July 21,2015. 7. This Waterways License is granted subject to all applicable Federal, State, County, and Municipal laws, ordinances and regulations including but not limited to a valid final Order of Conditions issued pursuant to the Wetlands Protection Act,M.G.L. Chapter 131, §40. 8. This Waterways License is.granted upon the express condition that the use of the structures and/or fill authorized hereby shall be in strict conformance with all applicable requirements and authorizations of the DEP. 9. This License authorizes structure(s)and/or fill on: Private Tidelands. In accordance with the public easement that exists by law on private tidelands,the licensee shall allow the public to use and to pass freely upon the area of the subject property lying between the high and low water marks,for the purposes of fishing,fowling,navigation,and the natural derivatives thereof. _Commonwealth Tidelands. The Licensee shall not restrict the public's right to use and to pass freely,for any lawful purpose,upon lands lying seaward of the low water mark. Said lands are held in trust by the Commonwealth for the benefit of the public. a Great Pond of the Commonwealth. The Licensee shall not restrict the public's right to use and to pass freely, for any lawful purpose, in the waterway. All signs shall utilize durable materials and methods of construction and be a minimum of 18"by 18" in size.Letter height shall be a minimum of 1/2". 2. Sign shall conform to all local laws and regulations(Refer to Special Condition#6). 3. If the site is located on a formal waterfront public pathway, a minimum area of 5"diameter shall be reserved for any identifying state or municipal logo(Refer to Special Condition#6). 4. The Licensee shall maintain all signs in good condition and repair. 5. The signs shall encourage public patronage and access of the all of the facilities required by the license conditions(using directional graphics,if necessary)and state the hours of public access 6. At least one sign shall be placed in a prominent location stating that the walkway facilities were required by the MassDEP, the waterways license number of the project, and the location where the public may inspect a copy of the license. 7. Signage shall be permanently posted and unobstructed from the view of a passerby.
