On Thursday, May 4,2000, the Planning Board of the City of Salem opened a Public Hearing
regarding the application of Peter Copelas under Section 7-18, Site Plan Review of the City of
Salem Zoning Ordinance to approve the demolition of three (3) existing residential buildings
containing a total of five (5)units and the construction of a new building containing eight(8)
units. The building is proposed to be two stories. In addition,the plan shows the parking for 15
vehicles on the site.
The Public Hearing was continued to May 18,2000 and closed on May 18, 2000. At a regularly
scheduled meeting of the Planning Board held on May 18,2000,the Board voted by a vote of
eight(8) in favor, none (0) opposed,to approve the application as complying with the
requirements of Site Plan Review, subject to the following conditions:
1. Conformance with the Plan
Work shall conform with the set of plans entitled,"Site Development Permit Plan—Proposed
Multi-Family Building, Salem, MA", sheets 1-2, prepared by Eastern Land Survey
Associates,Inc.,dated March 31, 2000. Work shall also conform with the landscaping plan
titled, "Proposed Residential Development, Rawlins Street, Salem, MA, Planting Plan", sheet
1, prepared by Laura S. Rutledge, dated May 15, 2000.
2. Amendments
Any amendments to the site plan shall be reviewed by the City Planner and if deemed
necessary by the City Planner, shall be brought to the Planning Board. Any waiver of
conditions contained within shall require the approval of the Planning Board.

3. Signage
a. Proposed signage shall be reviewed and approved by the City Planner and the Sign
Review Committee.
4. Lighting ,
a. Lighting shall be installed as shown on the approved plan.
b. No light shall cast a glare onto adjacent parcels or adjacent rights of way.
c. A final lighting plan shall be submitted to the City Planner for review and approval piidr
to the issuance of a building permit. r`
e. After installation,lighting shall be reviewed by the City Planner,prior to the issuance of a
Certificate of Occupancy.
5. Landscaping
a. All landscaping shall be done in accordance with the approved set of plans.
b. Trees shall be a minimum of 3 ''/a" caliper.
c. Maintenance of landscape vegetation shall be the responsibility of the developer, his
successors or assigns.
d. After such landscaping is completed,the developer will add further landscaping if such is
requested by the Planning Board or the City Planner.
e. Ivy shall be planted on the exterior wall of the Peter's Laundry building (135 Boston
Street), which is adjacent to the project site.
f. A fence shall be constructed for the entire length of the property on both Boston Street
and Rawlins Street. The final design of the fence shall be approved by the City Planner prior
to the issuance of a building permit.
g. The trees proposed to be planted on Rawlins Street are required to be planted for the
entire length of the property line.
6. Curbing
Curbing shall be installed along Boston Street for the length of the subject property. The
curbing proposed shall be approved by the Engineering Department prior to installation to
ensure its appropriateness with the existing curbing located on Boston Street.
7. Elevations
Final elevations shall be approved by the Planning Board prior to the issuance of a building
permit.

8. Construction Practices
All construction shall be carried out in accordance with the following conditions:

a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall
continue beyond 5:00 PM. There shall be no work conducted on Sundays or holidays. Inside
work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to
commencement of construction of the project.
c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM.
There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be
undertaken in accordance with all local and state regulations.
d. All construction vehicles shall be cleaned prior to leaving the site so that they do not
leave dirt and/or debris on surrounding roadways as they leave the site.
e. All construction shall be performed in accordance with the Rules and Regulations of the
Planning Board, and in accordance with any and all rules, regulations and ordinances of the
City of Salem.
f. All construction vehicles left overnight at the site, must be located completely on the site
and not on Traders Way.
9. Clerk of the Works
A Clerk of the Works shall be provided by the City, at the applicant,his successors or
assigns' expense, as is deemed necessary by the City Planner.
10. Board of Health
All Board of Health requirements shall be strictly adhered to.
11. Fire Department
All work shall comply with the requirements of the Salem Fire Department.
12. Building Inspector
All work shall comply with the requirements of the Salem Building Inspector.
13. Maintenance
a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the
developer,his successors or assigns.
b. Winter snow in excess of snow storage areas on the site shall be removed off site.

c. Maintenance of all landscaping shall be the responsibility of the applicant,his successors
or assigns. The applicant,his successors or assigns, shall guarantee all trees and shrubs for a
two-(2) year period.
14. As-built Plans
As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the
Planning Department and Engineering Department prior to the issuance of the final
Certificate of Occupancy.
15. Violations
Violations of any condition shall result in revocation of this permit by the Planning Board,
unless the violation of such condition is waived by a majority vote of the Planning Board.
I hereby certify that a copy of this decision and plans has been filed with the City Clerk and
copies are on file with the Planning Board. The Special Permit shall not take effect until a copy
of this decision bearing the certification of the City Clerk that twenty(20)days have elapsed and
no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied,
is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of
record is recorded on the owner's Certificate of Title. The owner or applicant,his successors or
assigns, shall pay the fee for recording or registering.

Dear Mr. Copelas:
At a meeting held on April 30, 2003, Don Cefalo, Stephanie Mullaney, and I met with you,
Architect Doug Hopper, and your contractors to discuss a temporary Certificate of Occupancy
permit for your Boston Street project.
At that meeting, we agreed that we could sign a routing slip for a temporary Certificate of
Occupancy to be issued by the Building Department for the four front units (facing Boston
Street). The temporary Certificate of Occupancy will be valid for a maximum of 30 days. The
following is a list of items that must be completed on the site within 30 days from the date of the
issuance of the temporary Certificate of Occupancy:
1. The stairs, as shown on the approved plan, adjacent to the retaining wall located in the
rear of the "Laundry Building," must be constructed to insure adequate egress in case of a
fire emergency. These stairs must be installed prior to the issuance of any Certificate of
Occupancy for the upper units.
2. The 4-foot iron decorative fencing shall be located along the length of Boston Street as
shown on the approved plan. The Department of Planning and Community Development
has reviewed the specification for the fence and has approved the"Specrail Catalog, item
S1, Bennington Moder' for installation.

3. Fencing consistant with the other decorative iron fencing used on the site shall be
installed around the retaining wall behind the "Laundry Building.." This fence must be
installed prior to the issuance of any type of Certificate of Occupancy for the rear/upper
units. In addition, a specfication for the fencing must be submitted and approved by the
Department of Planning and Community Development prior to installation.
4. The fencing located along the property line for the abutting residential property shall be
installed as shown on the approved plan. The fence height shall be no taller than 6-feet as
allowed for in the Salem Zoning Ordinance. In addition, the Department of Planning and
Community Development has reviewed the specification for the fence and has approved
the "Maximum Vinyl Products Catalog,Tongue and Grove Lattice Model".
5. The rear parking area shall be loam and seeded in accordance with the approved plan.
6. A revised landscaping plan and schedule demonstrating the changes agreed upon by both
parties at our April 30, 2003 meeting shall be submitted to the Department of Planning
and Community Development for review and approval. This plan should also reflect the
screening of the gas meters with appropriate plantings or shrubbery, the addition to the
bollards as discussed, and the relocation of the trees shown on the approved plan along
Rawlins Street. The landscaping, as shown on the revised plan to be approved, must be
installed within 30 days of the date of issuance of the temporary occupancy permit.
7. As discussed in the April 30, 2003 meeting and a subsequent site visit by Stephanie
Mullaney of the Salem Department of Planning and Community Development, the five
trees as shown on the approved plan along Rawlins Street shall be relocated. The
applicant shall install at least three 3 %z inch caliper trees behind the iron fencing along
Rawlins Street and four additional 3 '/2 inch caliper trees shall be added to the rear of the
parking area, along the retaining wall adjacent to the abutting residence (a species with
shallow roots). The new locations for these trees shall be shown on the revised
landscaping plan.
8. The sidewalk along Rawlins Street must be completed to include a curbcut at the
driveway entrance, and sloped within ADA handicapped accessibility guidelines.
9. The parking areas must be paved and striped throughout the site, including two
handicapped parking spaces - one in each parking area.
10. The run-off issue identified between the retaining wall and the abutting residential
property must be resolved to the satisfaction of the abutting property owner.
If the items listed have not been completed within 30 days of the issuance of the temporary
Certificate of Occupancy, the temporary Certificate of Occupancy shall be revoked until such
time that these items have been completed to the satisfaction of the Building Inspector. If at any
time prior to the 30 days, the applicant is aware of an issue that would prohibit one of the items
to not be completed,the applicant must notify the Department of Planning and Community
Development for review of an extension of time.

structure states the following:
1. A final lighting plan shall be submitted to the City Planner for review and approval prior to
the issuance of a building permit.
2. Final elevations shall be approved by the Planning Board prior to the issuance of a building
permit.
3. A fence shall be constructed for the entire length of the property on both Boston Street and
Rawlins Street. The final design of the fence shall be approved by the City Planner prior to
the issuance of a building permit.
I have signed off on the routing slip for issuance of the building permit on the condition that
plans for the lighting, elevations, and the fence be submitted to the City Planner prior to work on
any of these portions of the plan beginning. If work on the lighting, elevations, or fence are
started prior to approval of the plans by the City Planner, I am requesting that the Department of
Public Property notify the owner to stop work immediately and until the plans have been
approved.

On April 15, 2003, Doug Hopper (Architect) met with Willy Beaulieu (City of Salem Clerk of
the Works) on site at the Boston/Rawlin Street project to discuss an issue raised by the abutting
property owned Donna Williams. Ms. Williams is concerned that the retaining wall, which now
abuts her property, does not have a right angle return wall to prevent the back fill material behind
the wall from washing out.
Mr. Hopper confirmed that the approved amended site plan entitled "Proposed Residential
Development, Rawlin Street, Salem MA", Sheet Al, revised 11/26/02, and did not indicate a
right angle return wall for the retaining wall. After further discussion with Mr. Hopper, it was
agreed at this meeting that the contractor would install Versa-Lok blocks to enclose the retaining
wall, preventing any potential washout.
