Dear Mr. Vorgeas,
The Salem Building Department has no record of any Building Permit being issued to your
property at 33 Pickman Road since the time of original construction in 1950.
At your property, there is now an addition and a second dwelling unit that is in violation of the
Building Code (no permit) and in violation of Salem Zoning By-Law(no Variance; no two-
family dwellings).
In order to resolve these issues:
1. It must be established that the addition was constructed in compliance with all applicable
building codes. This may involve destructive investigation if deemed necessary by the
Plumbing, Electric, or Building Inspector.
2. The second dwelling unit and the separation from the main dwelling must be eliminated.
3. Floor plans showing the original house, the subsequent addition, and the proposed plan to
eliminate the second dwelling unit,must be submitted to, and approved by, the Salem
Building Department.
4. Permits must be acquired by licensed contractors for any work that will be performed.
If you feel you are aggrieved by this Building Code interpretation, your appeal is to the Board of
Buildings, Regulations and Standards in Boston. If you feel you are aggrieved by the Zoning
interpretation,your Appeal is to the Salem Zoning Board of appeals.

Dear Mayor Usovicz:
It is my understanding I am to meet with you, Mr. Miltiades Vorgeas,and other city officials
in your office @10 AM November 14, 2001 to discuss the Forest River Conservation area.
1n a letter dated October 31, 2001 City Engineer Stanley I. Bornstein issued a lawful order to
Mr. Vorgeas to remove telephone poles from the city sidewalk in front of his home. Ibis order
was issued after a site inspection by Mr. Bornstein and myself. Previously I had meet privately
with Mr.Vorgeas and advised him I had received complaints from his neighbors about the
staging of these telephone poles on the'tree lawn' and asked him to remove them to his private
property. I recall Mr. Vorgeas advised me he would not remove these poles and wanted a formal
notice.
I received a copy of Mr. Vorgeas' November 4, 2001 response to Mr. Bornstein's order this
evening in which he stated'I feel I am within legal rights to maintain my tree lawns(berms)m
the manner for which I intend'. I do not believe my fair reading of the city ordinance Mr. Vorgeas
cites, Sec. 38-19,allows a property owner to place large wooden creosote utility poles on a tree
lawn as containers for plantings.
I do not believe it is wise or prudent for me to meet with you and Mi.Vorgeas now
_Lpowing he has no intention of complying with City Engineer Bornstein's lawful order.
