Dear Ms. DeSantis:
This department was contacted by Ward Councillor Joe O'Keefe, and asked to inspect the
fire gate located between phase one and phase two of Pickman Park.
This gate was required to remain locked by agreement between the Salem Planning
Board and the Developer of Pickman Park.
Currently, the gate is located but the fence on one side is broken allowing traffic to
circumvent the gate.
You are directed to either repair the fence or place a temporary fix to restrict traffic.
Please contact this office upon receipt of a schedule for these repairs.

Dear Mr. Martel;
I have received a letter from Jill Fama, Property manager for Pickman Park
Condominiums, in which she asks again whether an owner can choose to keep the metal
firebox without repairing the flue pipe and collar.
The whole issue of a failed and improperly modified flue pipe was discovered
after a serious fire that damaged two units. As you know, an Order to Inspect al I flue
pipes before the fireplaces could be used, was issued by this department. You are also
aware that the chimney inspections revealed the need to replace one chimney system (as
this company is no longer in business) and to repair the other brand of chimney systems.
I was asked the same question, at that time, as to what choices the Owner's had.
My decision was as follows:
1.) Eliminate the fireplace and sheetrock the opening.
1.) Replace the Firebox and Flue Pipe completely (Required with the Preway
system as the company is no longer in business.)
2.) Repair the Top Collar and Cap on the Lennox system (as the parts are still
available.)
The reason I would not allow the Firebox to remain if the Chimney is not repaired
is Public safety. Although an owner may block off the Flue Pipe or place Decorative
glass in front of the fireplace, a subsequent Owner, guest, or relative, etc. may attempt to
use the fireplace with potentially fatal results.
The State Building Code section I am referring to is 780 CMR, Section 103,
Maintenance; which requires all service equipment, means of egress, devices, and
safeguards shall be maintained in good working order.
If you feel aggrieved by my Interpretation or Order, your appeal is to the Board of
Building Regulation and Standards, located at 1 Ashburton Place in Boston.
