I found holes in the ceiling where I witnessed leaking through the storm drain. Tenant shower water comes into her space. I observed water stains on ductwork and 2 overhead light fixtures where water is coming in. She has a dozen buckets and pans scattered around her store. Depending on how long it has been leaking, I question the integrity of the ceiling and its structure. I shall give you fifteen (15) days to make repairs to this space upon which I shall make a return inspection with the Health Department. Rossi Appraisal, dated 10 March 1989 This memo records our phone conversation of 10 July 1989 with Mr. Rossi and its confirmation with Mr. James Curtin, Pickering Wharf Limited Partnership, on 11 July 1989. We have reviewed the proposed repairs. An experienced contractor formulated the proposed repairs and an engineer appraised and added to the work. However, nobody we have talked to knows the geometry and dimensions of the existing bulkheads or has records of the soil profile along them. The proposed repairs are apparently based upon assumption and judgment. Along with judgment, we believe the repairs should be designed on the basis of engineering computation and knowledge, not assumption, of existing conditions. This is also the intent of the MA State Building Code. An application for a repair permit requires a "site plan showing to scale the size and location of all new construction and all existing structures" (MA Code sec. 113.6), and a soil statement "including sufficient records and data to establish character, nature and load bearing capacity" (MA Code sec. 720.1). Mr. Rossi stated that these requirements, and the investigation required to meet them, were not necessary for this project. We disagree. None of the proposed repairs address the overturning failure of the bulkhead along stations 5+65 to 6 as reported by Childs (see our letter to you, dated 5 July 1989). We believe the proposed repairs are inadequate to assure, with an acceptable level of confidence, that the bulkheads will be made safe and serviceable. cc: Alfred J. The report was prepared by Childs Engineering Corporation and is dated August 1987. This letter reports on our review and confirms our telephone conversation of 28 June 1989 with Mr. Dillon. The Childs report noted four areas of the bulkhead that were failing at the time of their report. They are: e_ , . 1. Near the Chase House - "in a mode of failure"; 2. From stations 5+65 to 6+00 - "overturning'; 3. From stations 9+75 to 10+25 - "partial sliding failure" and "partial overturning I ail ure"; 4. Stations 3+78.8 - "undermining is occuring", and "will settle suddenly when undermining reaches a critical point". �U' The report recommended that immediate repairs be made to three of the four areas. As you know, the wall near the Chase House collapsed last year and has since been replaced. It only recommended monitoring the area at stations 5+65 to 6+00 even though the wall there was reported as "overturning". The report also stated that "the entire stone seawall will have to be reconstructed in the near future (within 10 years)". The report was based largely upon visual observation and assumed bulkhead cross- sections and assumed soil conditions. Actual conditions may be better or worse. The Childs report documents that the bulkhead constitutes a hazard. We concur. ,q The cost estimates in the report are also based upon assumed wall sections and soil conditions. Salvo City Hall 93 Washington Street Salem, MA 01970 Dear Mayor Salvo: In the early morning hours of July 16, 1988, a seawall at Pickering Wharf collapsed and fell into the harbor. The City of Salem, it appears, has chosen to ignore the issue. The fact is that a seawall built in Salem and built under the supervision of the City of Salem, which falls and collapses in less than ten years seems to be no issue at all . I do wonder if the Mayor of Salem has inspected the scene of the damage. I also wonder if the Mayor of Salem knows that other walls are failing and will ultimately collapse into the harbor . The half million dollars it is taking to build a new wall is coming out of the pockets of the condominium owners at Pickering Wharf. The City bears a heavy responsibility in this matter ; a responsibility which, to date, has been avoided and ignored. The City, through the inspector of buildings, did advise us of all the permits and approvals that must be obtained. - Were all the procedures properly followed when the flawed wall was built in 1979? I would think that a rather simple check of City records would produce all sorts of interesting information. Senator Kennedy has taken an interest in the situation, and his Boston office is currently conducting an investigation. A legal aide from the Senator ' s office has spoken with a member •of our City administration. His response to the questions asked indicated to me that the City does not have the slightest idea of what is going on at Pickering Wharf. Mayor Anthony V. Salvo October 17, 1988 Page 2 Every brochure put out by the City of Salem shows Pickering Wharf as one of the major tourist attractions, and the Wharf takes credit for a good deal of tourist dollars spent in our City. I am asking the Mayor of Salem for help. How about making the people who are responsible for this fiasco stand up and be counted? They are a matter of public record, and they are all still here. THE SALEM EVENING NEWS would not, or could not , do anything about a story on the wall. After some ninth grade reporting on the immediate collapse they dropped the matter entirely. The Pickering Wharf Real Estate Development Group (PWREDG) must file a Notice of Intent with the Salem Conservation Commission, and a Special Permit Application with the Planning Board. Both boards have given approval for immediate work provided applications are submitted as soon as engineered plans are prepared, and that they are informed of ongoing work. These conditions will be met, beginning with my appearance before the Conservation Commission on July 28 , 1988. As the wall is licensed, and the construction constitutes repair of an existing structure, DEQE and the Corps of Engineers do not require permits. Mr. Ness will seek approval from the Historical Commission. I will ask the Conservation Commission and the Planning Board to communicate to you their approval for immediate work. Mr. Ness will ask the Historical Commission to communicate with you. As engineered plans become available they will be made available to you. On behalf of the Association, and pursuant to my telephone conversation with Mr. Steve Santry of your office this afternoon, I am requesting approval from you to commence Phase I demolition work on August 1, 1988. We plan to remove the existing granite blocks, sidewalks, and debris left in place following the wall's recent collapse, and drive approximately 150 linear feet of steel sheet pile in an effort to protect The Chase House restaurant from further tidal erosion. The sheet pile will also provide a work area in which our Design/Build Contractor, North Shore Marine Inc. , will begin reconstruction activities. Documentation indicating that gas and electrical utilities have been attended to, and that an extermination company has been contracted with, are forthcoming. We understand that your office will require engineered drawings and approvals from the Salem Conservation Commission, the Massachusetts DEQE, the Salem Historical Commission, the Salem Planning Board, and possibly the Army Corp of Engineers, before granting a Building Permit for the work. Richard Ness Y' The Development Group Pickering P7harf 54 Wharf Street , 3-E Salem, MA 01970 Dear Richard: On Tuesday, July 19 , 1988 the undersigned performed a visual in spection of the seawall at Pickering Wharf in the area of the Chase House , at your request . This inspection was required as a result of the recent failure of the seawall and concern about the stability of the seawall adjacent to the failed areas . Childs Engineering was asked to perform the inspection based on our pre- vious knowledge of the seawall . Childs Engineering ' s report of August 1987 , "Investigation and Assessment of Seawall , Pickering Wharf" for the Development Group contains existing conditions noted in August 1987 , structural assessments , along with recom- mended methods of repair . As a result of the inspection on July 19 , 1988 , we found that the area directly adjacent to the failed portion of the seawall is unstable and unsafe . This unsafe area is limited to the corner closest to the South River (Sta . 2+45 , see Dwa . No. 80487-1) and approximately 20 feet to the east . There are bulges and other signs of settlement along this section of seawall (Sta . 2+45 to Sta. 2+65) ; however , there does not appear to be imminent failure of the remaining seawall along the South River (Sta . 2+65 to Sta . 3+63) . Conditions of the seawall from Sta . 2+75 to 3+63 do not appear to be significantly worse than in August 1987 . The Chase House is currently using a doorway which exits out to the sidewalk on top of the seawall near Sta . 2+90 as a route of emergency egress . This walkway can be used safely for emer- gencies if precautions are taken to monitor the seawall . Survev points should be established along the top of the seawall to measure anv lateral movement or vertical settlement. Benchmarks should be located on known stable areas , i .e . , off the seawall . Measurements should be taken on a dailv basis and if there is significant movement , use of the seawall in any way should be discontinued until the seawall can be stabilized . After two weeks if there is no significant movement , the measurements can be taken bi-weekly. Continued . . . . • CHILDS ENGINEERING CORPORATION Mr . Richard Ness July 20 , 1988 Page 2 In discussions with the Development Group , it has been estab- lished that the Chase House building is founded on piles . If this is the case , then loss of the seawall should not affect the Chase House building unless there is significant loss of fill beneath the building uncovering the pile foundation . If fill material is lost , lateral forces may develop causing instability in the Dile foundation. Construction of the new seawall is scheduled to begin on August 1 , 1988 and is expected to last three months . During this time the seawall should be monitored as described above and if there is pile driving activity during construction, monitoring should be on a daily basis . In summary, the seawall near the southern emergency exit of the Chase House appeared to be stable during our inspection , however, if continued use of that exit and sidewalk is anticipated, the seawall should be monitored . If the seawall is found to be moving , public or emergency use should be discontinued until the seawall is stabilized . If there are further questions , please do not hesitate to call our office for additional information . As requested we have enclosed five copies of our original report on Pickering Wharf. We found the West bulkhead completely collapsed and a portion of the South bulkhead with an alarming bulge about 24' from the bulkhead corner. The remaining South bulkhead, starting about 40' from the wharf's Southwest corner and running East, appears properly aligned and unaffected by the adjacent collapsed section. Based upon field measurements and reasonable assumptions concerning the bulkhead dimensions, our preliminary computations indicate that the remaining bulkhead may be unsafe. We note: (1) the bulging bulkhead is near the point of complete failure; and (2) the building is supported by piles which rely on adjacent soil for lateral support. If the soil which was retained by the West bulkhead erodes away or if the corner and bulged area of the bulkhead collapse, the building itself will become unsafe. We recommend that these items be addressed immediately. We consider it appropriate to use the walkway supported by the remaining bulkhead as a means of emergency egress only if the position of the bulkhead and sidewalk is monitored daily. This is a short term egress solution and further movement of the bulkhead will necessitate closing this egress path. Our report on the failure will follow.
