Dear Mr. Munroe:
You have requested my opinion whether or not the above
lot of land containing 8, 000 square feet of land should be
afforded the protection of the first sentence of the fourth
paragraph of GLc40A §6 set out as Section VIII (B) (1 ) in
the City of Salem Zoning Ordinance.
It appears that the lot in question conforms to all
the requirements of the existing zoning ordinance with the
exception of the area and frontage requirement. An examination
of the records at the Registry of Deeds indicates that the
most recent instrument of record prior to August 27, 1965
(effective date of the zoning ordinance) indicates the lot
was separately owned and it has retained it' s separate identity
since that time. In addition, it has a minimum 5,000 suare
feet of area and 50 feet of frontage.
It is my understanding that the single family home on
the lot was recently totally distroyed by fire. As the owner
contemplates building an entirely new structure rather than
reconstructing the old one, the prohibition of Section VIII
D. (2 ) is not applicable. However, any new structure must
conform to the other density requirements of the ordinance.

I , Michael E. Tyler, an Attorney at Law licensed to practice in the
Commonwealth of Massachusetts, hereby state the following, all of
which pertain to the land on Phillips Street in Salem, Massachusetts ,
a portion of which is Lot 13 on a Plan of Lots recorded with the
Essex South District Registry of Deeds in Book 833 , Page 300, and
also being a portion of Lot 24 on a Plan of Land recorded with Essex
South District Registry of Deeds in Book 476 , Page 300 :
1 . According to the description and plan, the Lot has at least
5 , 000 square feet and 50 ' of frontage on an improved street.
2 . The Lot is located in an area zoned for single or two-family
use.
3. The Lot did conform to existing Zoning when said Lot was legally
created.
4 . The most recent instrument of record, prior to August 27, 1965,
indicates that the Lot was separately owned.
5. As pertains to all conveyances after the Zoning change of
August 27 , 1965 , the Lot has retained its separate identity
by continually being described as a separate and distinct lot.
6 . The above-referenced Lot has been a separate Lot and is not
available for use in connection with adjoining land as of
