This structure is an invasion of our privacy, for when they are on the top level they are able to see over our six-foot fence. Upon placing a call to your office, we were told no permit was pulled for this structure. We would appreciate it if you would look into this matter to see if this is even legal. We passed papers on 13 Phillips on August22 , 1989. The wall exceeds the city ' s limit of two feet . According to your office no permit was issued to Yelody and Michael Provost , the owners of 15 Phillips St .� to exceed the city limit . The retaining wall is approximately six feet . We also want to inform you that there is a boundary dispute over the location of the wall. While we understand that the boundary dispute is a civil matter , please be advised that when you do the inspection that if the property owners at 15 Phillips St . had put the retaining wall on their property line there would not have been any reason to exceed the city ' s limit for the height of the wall. Please also not that the property owners at 15 Phillips also plan to put up a fence and install a swimming pool. Thank-you for your consideration. Provost , Acting on complaint to this office, I inspected the above referenced property for possible Building Code Violations. I found you to be in violation of the Mass State Building Code, Section 113. (permits) no permit has been obtained for the retaining wall and Section 870 (retaining walls) erected accord- ing to this section. Violation penalties; anyone who shall violate a provision of this code shall be punishable by a fine of not more than one thousand dollars ($ 1 ,000.00) or by imprisonment for not more than one year, or both, for each violation. Each day during which any portion of a violation continues shall constitute a separate offense. To correct these violations you may apply to this office for the proper permits, or remove the retaining wall. 'r You must also obtain a drainage alteration permit from the City of Salem Engineer.
