Whereas the City Council of the City of Salem has determined that the
Salem Historical Commission, constituted pursuant to the Historic Districts
Ordinance of the City of Salem adopted by the City Council , November 24, 1971 ,
under the provisions of Massachusetts General Laws , Chapter 40C, has
conducted an investigation and reported to the Planning Board of the City
of Salem and the Massachusetts Historical Commission on the historical
and architectual significance of the buildings, structures or sites to be
included in the proposed Washington Square Historic District as provided in
Massachusetts General Laws Chapter 40C; and
Whereas the City Council of the City of Salem has determined that the Salem
Historical Commission has held a public hearing sixty days after transmitting
its report on the proposed Washington Square Historic District to the Planning
Board of the City of Salem and to the t'lassachusetts Historical Commission,
pursuant to due notice, all as provided in Massachusetts General Laws
Chapter 40C; and
Whereas the City Council of the City of Salem has determined that the
Salem Historical commission has submitted a final report with its recommendations,
a map of the proposed Washington Square Historic District and a draft of a
Proposed ordinance to the City Council ;
Now , therefore, Be it ordained by the City Council of the City of Salem as
follows:
Section
This Ordinance shall be known and may be cited as The Washington Square
Historic District Ordinance under the authority of the Historic Districts
Act , tlassachusetts General Laws , Chapter 40C and under the authority of the
Historic Districts Ordinance of Salem.

Section IV
All powers and duties set forth in the Historic Districts Ordinance
adopted by the City Council on flovenber 24, 1971, shall be incorporated
in this TdasQin5zton Square Historic District Ordinance, with the exception
that •the authority of the Commission shall be limited to exterior acchitecCual
features within the Washington. Square Historic District which are subject
to view from all streets named and included within the boundaries of
the District.
Section V
This Ordinance shall take effect as provided in the City Charter.

Dear Washington Square Historic District Resident:
The Washington Square Historic District has been established
under the provisions of the Historic District Act, Massachusetts
General Laws, Chapter 40 C, by unanimous vote of the Salem City
Council on September 22, 1977• Enclosed please find a copy of
the Washington Square Historic District Ordinance, which becomes
effective on December 19 1977•
The Commission's responsibility to the residents of the
Washington Square Historic District is to act as a design review
board under the General Laws, Chapter 40 C, Section 6. Section
6 states ".. .no building or structure within an historic district
shall be constructed or altered in any way that affects exterior
architectural features unless the commission shall first have
issued a certificate of appropriateness, a certificate of non-
applicability or a certificate of hardship with respect to such
construction or alteration." These three certificates differ
as follows:
A certificate of appropriateness: In the usual case, a resident
or owner who wants to make a change to the exterior of his building
applibs to the Commission for a certificate of appropriateness`. The
Commission determines if the proposed changes are visible from the
street and whether a public hearing is indicated. The Commission
can waive public hearing providing abutters are properly notified.
After reviewing the application and public hearing or notification
of abutters, the Commission, may issue the certificate.
A certificate of non-applicability: If the Commission determines
that a proposed change cannot be seen from the street, the Commission
gives the owner a certificate of non-applicability.
A certificate of hardship: If the Commission decides that by
not giving a certificate of appropriateness, the owner will be caused
a hardship, the Commission may issue a certificate of hardship.
The law further states that to obtain a certificate from the
Commission, one must file an application . Included must be pertinent
information such as plans, elevations, specifications, paint colors, and
in the case of demolition or removal, a statement of the proposed
condition and appearance of the property thereafter. A sample application
form and filing procedures are included for your information.
No building permit for construction of a building or structure
or for alteration of an exterior architectural feature and no
demolition permit for demolition or removal of a building or structure
shall be issued by the city until the certificate required has been
issued by the Commission.
Exemptions to the authority of the Commission are listed
in Section 6 of the Salem Historical Commission Ordinance, adopted
in November, 1971, as follows:
"The authority of the Commission is not extended to the review
of the followings
(1) Temporary structures or signs, subject, however, to such
conditions as to duration of use, location, lighting,
removal and similar matters as the commission may
reasonably specify.
(2) Terraces, walks, driveways, sidewalks and similar
structures or any one or more of them, provided, that
any structure is substantially at grade level.
(3) Storm doors, and windows, screens, window air conditioners,
lighting fixtures, antennae and similar appurtenances
or any one or more of them.
(4) The reconstruction, substantially similar in exterior
design, of building, structure or exterior architectural
feature damaged or destroyed by fire, storm or other
diaster, provided such reconstruction is begun within
one year thereafter and carried forward with due diligence."
The Commission's regular monthly meetings are the first Wednesday_
of each month, One Salem Green, 7:30 p.m. Everyone who is interested
in protecting and preserving Salem's architectural and historical
treasures is urged and invited to attend.
The Historical Commission wishes to thank you, the residents

in establishing this, Salem's fourth, local district.
