Be it ordained by the City Council of the City of Salem, as follows:. WHEREAS the City Council of the City of Salem has determined that the Salem Historical Com^.:ission, constituted pursuant to the Historic Districts Ordinance of the City of Salem adopted by the City Council, November 24, 1971, and approved by the Mayor. of the City of Salem November 30, 1971, under the pro- visions of Massachusetts General Laws, Chapter 40C, has conducted an investigation and reported to the Planning Board of the City of Salem and the-3lassa'chusetts Historical Commission on the . Historical and architectural significance of the buildings, struc— tures or sites to be included inihe proposed Federal Street Area Historic District as provided in Massachusetts General Laws ( . Chapter 40C; and . WHEREAS the City Council of the City of Salem has determined that the Salem Historical Commission has held a public hearing sixty days after transmitting its report on the proposed Federal Street Area Historic District to the Planning Board of the City of Salem and to the Massachusetts Historical Commission, pursuant to due notice, all as provided in Massachusetts General Laws Chapter 40C; and WHEREAS the City Council of the City of Salem has determined that the Salem Historical Commission has submitted a final report with its recommendations, a map of the proposed Federal Street Area Historic District and a draft of a proposed ordinance to the City Council; NOW THEREFORE, Be it ordained by the City Council of the City of Salem .as follows: Section I This Ordinance shall be known and may be cited as The Federal Street Area Historic District ordinance under the authority of the Historic Districts Act, Massachusetts General Laws, Chapter 40C • and under the authority of the Historic Districts Ordinance of Salem_ Section IZ There is hereby established under the provisions of the Historic Districts Act, Massachusetts General Lawn, Chapter 40C and under the provisions of the Historic -D--sr-l'icts Ordinance of. Salem, an Historic District to be known as The Federal Street Area Historic District which District shall include all the land and buildings WWrnprising the parcels facing or abutting on Federal Street and other streets as eforth herein with street addresses on Federal Street beginning with and including at the Easterly extreme, 76-763, Federal Street and 87 Federal Street (near the intersection of Federal and North Streets) and extending West along Federal Street ending with and including 144-146 Federal Street and 145 Federal Street (at the intersection of Federal Street and Flint Street). The proposed District is also to include the adjacent streets as follows: South of Federal Street including: street addresses 3 Federal Court through 6 Federal Court, 3 Beckford Street through 22 Beckford Street and 5 Non-roe Street through 10 Monroe Street; North of Federal Street including street addresses 26 Beckford Street through 30-32 Beckford Street, 2 Andover Street through 12 Andover Street, 2 River through Lynn StStreetthrough 18 River Street, 1 Lynn Street t o 13 yn Street, 3 Carpenter Street through 13 Carpenter Street, 2 Gifford Court through 12 Gifford Court, 52 Flint Street through 56 Flint Street and 1 Harrington Court through 6 Harrington Court. The boundaries of said District are established as shown on the attached map entitled "Federal Street Area Historic District Map" which map is made a part of this Ordinance. Section III The establishment of the Federal Street Area Historic District under Section II of this ordinance shall not become effective until the first day of the third month after the effective date of this Ordinance. 4Rection IV All powers and duties set forth in the Historic Districts Ordinance adopted by the City Council on November 24, 1971, shall be incorporated in this Federal Street Area Historic District Ordinance, with the exception that the authority of the Commission shall be limited to exterior architectural features within the Federal` Street Area Historic District which are subject to view from Federal Street and all other streets named and included within the boundaries of the District. Section V This Ordinance shall take effect as provided in the City Charter. Ordinance as amended was adopted for first passage by a roll call vote of 10 yeas 0 nays and 1 absent. In City Council March 25, 1976 Adopted for second and final passage. MASS. 01970 May hr 1 4 ; 1976 Dear Federal Street Area District Resident: The Federal Street Area Historic District has been established under the provisions of the Historic District Act, General Laws , Chapter 40C, by unanimous vote of the Salem City Council on March 25, 1976. Enclosed please find a copy of the Federal Street Area Historic District ordinance, which becomes effective on June' 1976. The Commission's responsibility to the residents- of the Federal Street Area Historic District is to act as a design review board under Massachusetts General Laws, Chapter 40C, Section 6. Section 6 states . . no building or structure within a historic district shall be constructed or altered in any way that affects ex- terior architectural features unless the commission shall have' first issued ( 1) a certificate of appropriateness, (2) a certificate of non- applicability or (3) a certificate of hardship with respect to such construction or alteration. . . ." 1. A certificate of appropriateness : A resident or owner who wants to make a change to the exterior of his building applies to the Commission for permission to make this change . If the change is visible from the street the Commission holds a public hearing on the proposed change before it issues a certificate of appropriateness . 2. A certificate of non-applicability: The Commission decides whether or not the change can be seen from the street and if it cannot, the Commission gives the owner a certificate of non-applicability. 3. A certificate of hardship: If the Commission decides that by not giving a certificate of appropriateness the owner will be caused a hardship, the Commission may issue a certificate of hardship. The law further states that to obtain a certificate from the Salem Historical Commission one must file an application for one of these certificates with the Commission at City Hall. Included must be pertinent information such as plans, elevations, specifications, paint colors, and in the case of demolition or removal, a statement of the proposed condition end appearance of the property thereafter. Application forms may be obtained from the City Clerk' s office or from the Salem Public Library, 370 Essex Street, Salem. No building permit for construction of a building or structure , or for alteration of an exterior architectural feature, and no demo- lition permit for demolition or removal of a building or structure shall be issued by the city until the certificate required has been 2. issued by the Commission. Exemptions to the authority of the Commission are listed in Section 6 of the Salem Ordinance for the Chestnut Street District, adopted in November, 1971, as follows : "The authority of the Commission is not extended to the .review of the following: (1) Temporary structures or signs, subject, however, to such conditions as to duration of use, location, lighting, removal and similar matters as the commission may reasonably specify. (2) Terraces , walks , driveways , sidewalks and similar structures or any one or more of them, provided, that any structure is substantial- ly at grade level. (3) Storm doors, and windows , screens , window air conditioners , lighting fixtures , antennae and similar appurtenances or any one or more of them. (4) The reconstruction, substantially similar in exterior design; of building - structure or exterior architectural feature damaged or destroyed by fire, storm or other disaster, provided such reconstruc- tion is begun within one year thereafter and carried forward with due dilligence." • The Commission members hold their meetings at 7:30 P. m, the first Wednesday of each month at One Salem Green (third floor) . Everyone who is interested in protecting and preserving Salem's architectural and historical treasures is invited to attend.
