SALEM HISTORICAL COMMISSION
ANNUAL REPORT
JULY 1, 2008 - JUNE 30, 2009
The Salem Historical Commission is a volunteer board of Salem residents appointed by the Mayor.
The Commission's mission is to provide regulatory design review within Salem's four designated
local historic districts. The Commission also provides community-wide historic preservation
planning assistance by promoting historic preservation awareness and by commenting on projects
that may impact historic resources.
Certificates Issued
During the year July 1,2008 through June 30,2009,the Salem Historical Commission met 23 times
during which a quorum was present. In its capacity as Historic District Commission for 4 local
districts, the Commission received 112 applications and filed a total of 121 certificates including:
- 50 Certificates of Appropriateness;
- 2 Certificates of Hardship;
- 64 Certificates of Non-Applicability;
- 2 Waivers of the Demolition Delay Ordinance; and
- 3 Denials for.Certificate of Appropriateness.
Certificates issued are provided to the owner of the property, the City Clerk and the Building
Inspector and are kept on file in the Department of Planning and Community Development according
to address. A list of all Certificates issued can be found in the Certified Local Government Annual
Report, which is on file at the Department of Planning and Community Development and the
Massachusetts Historical Commission. Minutes of all meetings are also available at the Department
of Planning and Community Development and on-line on the City's website www.salem.com.
Commission Members
The Commission is regularly comprised of seven (7) regular members and two (2) alternate
members. Michael Reiter was appointed on July 15, 2008 and resigned on September 15, 2008.
Joanne McCrea was appointed on September 9, 2008. As of June 30, 2009, there are one full
member vacancy.
Workshops/Seminars
Hannah Diozzi attended the following:
• November 2008 - Tour and PowerPoint presentation of adaptive reuse of Charles Street
Jail (Boston) as the Liberty Hotel, given by Cambridge Seven Architects in conjunction
with Build Boston
■ `April 2009 - Architectural tours and classroom presentations at University of Virginia and
Monticello, given by Professor James Wooten of the College of William and Mary
■ June 2009 - Private docent tour of Trinity Church in Boston including the newly renovated
undercroft; sponsored by Boston by Foot
Jessica Herbert attended the following:
• February 2, 2009 - Lecture on Preservation Fund Raising for Herbert House Museum,
Hampton, VA
Note: Ms. Herbert also taught the Restoration Workshop on Antique Moldings for Beginnings,
June 17, 2009, Salem, MA
David Hart attended the following:
• Boston Society of Architects Historic Resources Committee, monthly meetings, Boston
Mass.
• September, 2008 - Great Salem Fire Historic Salem Inc., Salem walks, three Sundays
• October, 2008 -Association for Preservation Technology, four day conference, lectures,
field visits, Montreal, Canada
• October, 2008 - Historic Preservation Advisory Group Boston Architectural Center,

• November, 2008 -Boston Society of Architects Build Boston Tradeshow
• Jury for a competition for the design of the Church Street parking lot site for Traditional
Building and American Institute of Building Designers.
Mr. Hart was on the jury for a competition for•the design of the Church Street parking lot site for
Traditional Building and American Institute of Building Designers. Mr. Hart also attended the
workshop "Greening the Older Home:Historic Preservation Meets Energy Conservation"which the
Commission co-sponsored with Historic Salem Inc., Historic New England, and Essex County
Forum in April, 2009.
Grant Awards
A $174,000 Massachusetts Cultural Facilities Fund grant was awarded through the City of
Salem's partner, Gordon College, for the Old Town Hall.
A $75,000 Partners in Preservation Programs grant was awarded through the City of Salem's
partner, Gordon College, for the Old Town Hall.
Other Activities
The Commission provided letters of support for:
• City of Salem application for designation as a Preserve America Community;
• Salem Jail Complex—Massachusetts Historic Rehabilitation Tax Credit application
• The First Church In Salem—Massachusetts Preservation Projects Fund application
• . House of the Seven Gables - Massachusetts Preservation Projects Fund application
• City of Salem application for variance from the Massachusetts Architectural Access Board
for the Witch House Handicap Access

The Commission provide comment letters for:

The Women's Friend Society at 12-14 Hawthorne Blvd. was accepted for listing on the National
Register of Historic Places.

MINUTES
July 2, 2008
A meeting of the Salem Historical Commission was held on Wednesday,July 2, 2008 at 120 Washington
Street, Salem, MA. Present were Chairman Diozzi,Ms. Bellin, Ms. Herbert, Ms. Harper and Mr. Hart.
401R Essex Street
David and Mary Schaejbe submitted an application for a Certificate of Appropriateness and a Certificate
of Hardship to replace a slate roof with asphalt at 401R Essex Street.
Ms. Bellin recused herself and joined the audience.
Mr. Schaejbe stated that the back side is leaking on the interior.
Ms. Diozzi asked if the building as a converted garage.
Mr. Schaejbe replied in the affirmative and stated that he has lived there for five years. Prior to that, he
had a business there for 15 years. He stated that he has a roofer there to repair the slate roof 3-4 times in
the last three years,but they cannot find the source of the leak.
Ms. Herbert asked if the slate was salvageable.
Mr. Schaejbe stated that he imagined whoever takes off the slate will reuse it.
Ms. Herbert stated that she did not have a problem with the application because everything about the
building is 1940's, noting that it may be a slate roof because the original owners had extra slate on hand.
She stated that she also felt the current owner has done due diligence to find the leak.
Mr. Hart stated that his experience was that this particular slate is not the best and that it appears to be
Virginia, rather than Vermont slate. He added that it is a utilitarian building.
Ms. Herbert stated that there is nothing obvious that the roof and windows are from the same period.
Ms. Herbert made a motion to approve a Certificate of Appropriateness to replace slate with black or
charcoal grey, 3-tab asphalt,with the option for a low profile ridge vent. Mr. Hart seconded the motion,
all were in favor and the motion so carried.
Ms. Bellin returned.
41 Washington Square
Barbara Pervier, on behalf of the condominium owners at 41 Washington Square, presented an
application for a Certificate of Appropriateness for paint colors in the building archway.
Ms. Pervier stated that they want to make the entrance more lively and interesting and noted that they
may soften the white. She provided several color options and noted that they want to keep the door
black.

Ms. Bellin stated that the blues may look better with the brick than the greens.
Ms. Herbert suggested the stair treads be black rather than brown. She suggested using Historic Morning
Dew for the archway.
Ms. Herbert made a motion to paint the interior of the archway in either Citadel Blue,Vinal Haven or
Historic Morning Dew and the painting of the stairs in Stealth Jet. Ms. Bellin seconded the motion, all
were in favor and the motion so carried.
183 Rear Federal Street #2
John and Monica Zisa presented an application for a Certificate of Appropriateness for the replacement
of windows as has already been undertaken.
Mr. Zisa stated that they replaced seven windows, 3 in front, 3 on side and one in rear.
Ms. Herbert believed that only the front 3 are visible.
Ms. Diozzi asked how much of the second floor he owned, if it was all the way across.
Mr. Zisa stated that it was half way.
Ms. Diozzi asked how many units are in the building.
Mr. Zisa stated that there are 3.
Ms. Guy stated that the Commission needs to review the application as though the work has not been
done.
Mr. Zisa stated that they have a 2 '/z year old that stands on the baseboards and leans against them and it
is scary. He stated that they caulked them over the window and in the summer put in towels around the
air conditioning. He stated that their unit spans the second and third floors.
Ms. Bellin noted that the ones installed are not red.
Mr. Zisa stated that he installed vinyl windows behind the existing aluminum storms.
Mr. Zisa stated that they were heating the outdoors.
Ms. Diozzi stated that the muntins are on the inside and that from the street, behind the aluminum
storms, they are not noticeable. She stated that from inside the property it is clear they are vinyl. She
stated that she was concerned if the storms are taken off that the vinyl windows will be visible.
Mr. Zisa stated that when the building was converted in the 80s, some liberties were taken. The electrical
meters are on the front of the house and his unit has skylights.
Ms. Guy asked if there is a condominium association.
Mr. Zisa replied in the affirmative and stated that they are present.
Ms. Diozzi stated that the issue is not always with windows being replaced,but the type of windows being
replaced with. She stated that the Commission's guidelines includes certain types of replacement windows
that are allowed. She noted that muntins and mullions should be dimensional on the outside of the glass,
not inside has the applicant has installed.
Ms-Herbert asked if the other owners are planning on doing windows.
Mr. Zisa stated that he did not know and that they don't have an open, positive relationship. He stated
that their condominium documents say that each owner are responsible for window replacement.
Ms. Herbert stated that usually windows and doors are part of the common area.
Mr. Zisa stated that their documents are very specific that it is from the exterior of the outside pane of
glass of the window in. He noted that the difference in cost is $300 versus $600-900 per window, so that
it is also an economic situation. He noted it is set off the street.
Ms. Herbert asked if the windows on the rest of the building are the original wood windows.
Mr. Zisa stated that he did not believe they were the original to the house.
Julianne Guiffre, 183 Rear Federal St. U1, stated that she was surprised when the windows were installed,
noting that they were never notified. She stated she was home alone with her son and woke up and found
strange men in her yard,with no name on the truck,which was off-putting.
Kim Armstrong, 183 Rear Federal St. U3, stated that she has a problem with the color change of the cross
bars from red,which is on the rest of the house, to white. She felt that if it wasn't for the color change, it
wouldn't be noticeable.
Ivan Armstrong, 183 Rear Federal St. U3, stated that he more neutral on the application. He noted that he
has been restoring the windows on his unit by hand from the inside because he did not think vinyl would
get approved, after reading the Commission's guidelines. He stated that he would assume if the vinyl
windows get approved, that down the road, the Commission would approve similar windows for the rest
of the house.
Ms. Diozzi asked the name of the condo association.
Mr. Zisa stated that it is the Willis Tuttle Condominiums.
Mr. Armstrong agreed that the documents say it is the owners responsibility for windows, although it does
not state which outer glass (i.e. storms). He stated that they also say that condo approval is needed and
that all permits have to come from the condo association.
Ms. Armstrong stated that the unit owners are responsible for monetary costs, but the associationis
responsible for ensuring all work done to the building is permitted,allowed and up to code.
Ms. Guy stated that it is irrelevant what the condo documents state and it would be up to them to decide
who is responsible. She stated that the Commission should decide which windows are visible and which
are not. She stated that the ones that are not could be approved and that the Commission would need to
deliberate on those that are visible.
Ms. Herbert stated that she would like to go by the building and preferred to continue the application.
Mr. Hart was in agreement.
Ms. Herbert suggested that the contractor provide an estimate for true divided light wood windows with
non-insulated glass.
James Shields stated that he is the contractor and that all the windows were replaced in the 80s. He stated
that they are Brosco 6 over 6 single glaze windows,which would probably be $300 each.
Ms. Herbert stated that if continued for two meetings,it would give the others to get estimates if any
others want to replace windows and for owners to try to sort this out.
Mr. Hart asked if a building permit was required.
Mr. Shields replied in the affirmative,noting that it was an oversight he didn't obtain one.
Ms. Herbert stated that she understood the need to put good insulated windows in, as the oil prices go up.
She stated that when you have an historic house that has a condominium association, she would want
there to be a uniform look and for the condo owners to be in agreement. She stated that the idea is too
keep the house as historic as possible.
Ms. Herbert made a motion to continue to the August 6, 2008 meeting. Ms. Bellin seconded the motion,
all were in favor and the motion so carried.
Mr. Shields stated that he will also provide an estimate for simulated divided light windows. Mr. Shields
stated that he installed Harvey windows. He will get a quote for Brosco for single glaze and Marvin for
simulated divided lights.
Ms. Guy noted that there have been three simulated divided light windows that have been approved,
including the Pella Architect Series,JB Sash Proper Bostonian and a LePage. She stated that the
Commission has not seen the Marvin or Harvey.
27 East Collins Street—Discussion
Ms. Guy provided a copy of the work write-up and photographs for 27 East Collins Street which is going
through the City's Housing Rehabilitation Loan Program funded with federal funds. She stated that the
property is located in a National Register District and therefore she is seeking comment from the
Commission. The consultant that prepared the NR application stated that the property was a contributing
structure to the district, but Ms. Guy stated that she tended to disagree, noting that it was built in 1949
and is a cape style with vinyl siding and an asphalt roof. This is a city loan to a low to moderate income
homeowner, an elderly man. Ms. Guy asked if the Commission had comment on the work being done.
Mr. Hart stated that he had problems with the architectural shingles,noting that they jump out. He noted
that they are replacing all the windows in vinyl.
Ms. Herbert questioned the painting of vinyl siding.
Ms. Harper asked if the Commission could take hardship into consideration in its comments.
Ms. Guy replied in the affirmative. The project is before the Commission for comment because federal
funding is being used. She noted that if the Commission disagrees with any part of the work write up and
the homeowner does not agree to the change, she will have to forward the information to Massachusetts
Historical Commission,which could delay the project up to 90 days.
Ms. Bellin asked if someone else bought the house and wanted to use their own money,would it not
come before the Commission for comment.
Ms. Guy replied in the affirmative,noting that because he lives on the corner of the National Register
district,it needs to come before the Commission for comment.
Ms. Harper stated that she preferred not to comment. Ms. Belli in Ms. Diozzi and Ms. Herbert were in
agreement.
Mr. Hart stated that he had a problem with the architectural shingles.
Ms. Guy stated that she would see about getting that changed on the work write-up.
Ms. Herbert stated that it may look better with architectural shingles because the house is so modern and
boring. She stated that it would add texture.
Mr. Hart made a motion that Ms. Guy explore the possibility of changing the work write up from
architectural to 3-tab. Ms. Herbert seconded the motion. Mr. Hart, Ms. Diozzi, Ms. Herbert and Ms.
Bellin voted in favor. Ms. Harper voted in opposition. The motion so carried.
Other Business
Ms. Guy stated that MHC has awarded the City a$50,000 MPPF grant for the Witch House for the
replacement of the wood shingle roof system, chimney restoration and interior and exterior universal
accessibility improvements. Ms. Guy stated that the City also received received a letter from
Massachusetts Historical Commission (MHC) dated 6/16/08 finding no adverse effect for roof and
chimney repairs.
Ms. Guy stated that she mailed a copy of a letter dated 6/19/08 from DCAM to MHC concerning
comments on the Church Relocation Specifications.
Ms. Belhn made a motion to approve the minutes of July 18, 2007. Ms. Herbert seconded the motion, all
were in favor and the motion so carried.

September 3, 2008
A meeting of the Salem Historical Commission was held on Wednesday, September 3, 2008 at 120
Washington Street, Salem, MA. Present were Chairman Diozzi, Ms. Herbert,Ms. Bellin, Ms. Harper, Mr.
Reiter, Mr. Hart and Mr. Desrocher.
Salem Common Tot Lot
In continuation of a prior meeting, Sarah Wheeler-Gaddipad, on behalf of Parent's United's Tot Lot
Committee,presented an application for a Certificate of Appropriateness for replacement of the 25 year
old tot lot structures. Also present were Jen Santo and John Ninneman.
Ms. Guy noted that Mr. Reiter cannot vote on this application because he was not present at all prior
discussions of this application.
Ms. Santo stated that the framing is metal and that the slides and a few other details are plastic. They
proposed to use a combination of wood chips and rubber surfacing. They prefer the color Terracotta for
the rubber surfacing,which is similar in color to the wood chips.
Ms. Herbert stated that she liked the Terracotta.
Ms. Diozzi stated that she liked the three color scheme of green (plastic) and brown and tan metal.
Ms. Guy suggested that the towers be in tan and most of the rest of the metal be brown.
Mr. Desrocher made a motion to approve surfacing of tot lot to be wood chips and/or Terracotta rubber.

to be brown metal. The two play structures'metal components are to include tan towers (6) with
remaining metal pieces to be brown wherever possible and practicable.

Ms. Gaddipati stated that if they can afford it, they will come back with a design.
Ms. Harper seconded the motion, all were in favor and the motion so carried. Mr. Reiter abstained from
voting.
Ms. Gaddipati stated that they intend to use flush bricks as a border along the perimeter and/or as part of
the path to the tot lot. Bricks can be engraved as a fundraising tool. She stated that there would probably
be no more than 2 bricks deep along the perimeter. She stated that the benches will be the same as those
the city currently uses on the Common and that they may have plaques as a fundraising tool. She stated
that they would like to add picnic benches,but did not have a photograph.
Ms. Guy asked if there were any_picnic benches currently on the Common.
Mr. Ninneman stated that there is currently one concrete picnic bench.
Ms. Guy stated that adding picnic benches would be essentially introducing a new element to the
Common and that the Commission would need to see a proposal
Ms. Bellin made a motion to approve the border of site and/or pathway to the site to be in flush red brick
(2 deep around border) with some or all of the brick to be engraved with sponsor's message and that any
benches installed match city standard benches currently used on the Salem Common. Ms. Herbert
seconded the motion, all were in favor and the motion so carried. Mr. Reiter abstained from voting.
17 North Street
In continuation of a previous meeting, through architect David Jaquith, the Elks Association of BPOE
submitted an application for a Certificate of Appropriateness to renovate the existing 2 story front of the
building and add a new rear addition on the existing footprint in order to convert the building to
condominiums. The applicant was not present.
Ms. Herbert made a motion to continue the application to the meeting of September 17, 2008. Ms. Bellin
seconded the motion, all were in favor and the motion so carried.
4 Federal Court
Michael Digris and Michele Washburn presented an application for a Certificate of Appropriateness to
replace their current 3-tab roof with high end, asphalt shingle that is neither 3-tab, not architectural.
Mr. Digris stated that they are proposing to use GAF/ELK Grand Slate,which has a lifetime warrantee
and is warranteed to 110 mph winds. He provided a sample and stated that they prefer the Bristol Gray
color.
Mr. Hart stated that he could tolerate slate or something that looks like slate or wood shingle or
something that looks like wood shingle.
Mr. Desrocher stated that he felt the proposed looks like 3-tab.
Ms. Guy stated that when asphalt shingles were initially approved by the Commission,it was not to try to
replicate the look of slate or wood, but rather to have a modern material that is financially affordable and
that would be unnoticeable on the roof. She stated that this situation is similar to double glaze windows
that were not previously approved,with the Commission waiting until technology came up with an
acceptable modern window. She added that aluminum gutters are not an historic material, but that the
Commission compromised,provided that they were heavy gage.
Ms. Bellin stated that she felt the Welsh Gray was closer to charcoal grey.
Ms. Washburn stated that the Bristol Grey is closer to what is currently on their roof.
Ms. Herbert stated that the Welsh Grey looks a little bluish in the photo.
Ms. Bellin noted that the Welsh Grey has specks of blue in the sample,while the Bristol has specks of
brown.
Ms. Herbert made a motion to approve the roof replacement with GAF/Elk Grand Slate asphalt in
Bristol Gray. Ms. Harper seconded the motion.
Mr. Hart noted that he has looked a the Secretary of the Interior's Standards, as well as two Preservation
Briefs put out by the National Park Service. He stated that it is an experiment, but that he feels the
application has come up with a shingle that kind of mimics a slate roof. He stated that he will vote in
favor of the proposal.
The motion was voted upon, all were in favor and the motion so carried.
10 Chestnut Street
Marshall Strauss and Elaine Gerdine submitted an application for a Certificate of Non-applicability to
repair crown molding as needed around the building exterior, repair gutters & downspouts, repair column
on dining room porch and repair trim at the bottom of the front porch.
Mr. Strauss stated that the existing downspouts are metal, that all the visible gutters are wood and the one
non-visible gutter is metal.
Mr. Hart noted that wood gutters are harder to maintain.
Ms. Herbert made a motion to approve the application as submitted. Mr. Desrocher seconded the
motion, all were in favor and the motion so carried.
Other Business
Ms. Guy stated that she reviewed the courthouse and North/Bridge Street interchange drawings that the
Commission reviewed in the past and determined that the two controller units were on the plans provided
to the Commission that were dated October, 2006.
There being no further business, Ms. Bellin made a motion to adjourn. Mr. Desrocher seconded the

November 5; 2008
A meeting of the Salem Historical Commission was held on Wednesday, November 5, 2008 at 120
Washington Street, Salem, MA. Present were Vice Chairman Herbert, Ms. Bellin, Ms. Harper, Ms.
McCrea and Mr. Hart.
310 Essex Street
The City of Salem submitted an application for a Certificate of Appropriateness for roof replacement,
including a new rear gutter and new downspouts. The existing shakes will be replaced with red cedar
shingles. Three new downspouts will be located on the rear of the building and shall be 5" square Spanish
cedar wood with copper liners. The rear gutter will be a V shape and made of Spanish cedar wood
pitched to drain to downspouts. The bid documents includes two bid alternates for the chimney.
Alternate #1 is to rebuild the top 6 courses of brick to match the existing and cap it with a new bluestone
cap. It also includes replacement of any deeply spalled brick throughout the chimney. Alternate #2 is
rebuilding the full chimney and provide a new bluestone cap. Representing the City was Kirsten Kinzer
from the Department of Planning& Community Development and William Finch, consultant.
Ms. Kinser stated that she is the Project Manager and that the estimate for the alternate to fully rebuild the
chimney exceeds available funding. They have two grants from the project—one from Massachusetts
Historical Commission (MHC) and one from Essex Heritage Commission. MHC has reviewed the
project and found no adverse effect.
Mr. Finch that the major change is shakes to conventional cedar,which are much closer in appearance to
18th century shingles. The shakes were initially installed in 1944-5.
Mr. Hart stated that the new red cedar will be far more appropriate than cedar shakes.
Mr. Finch stated that the chimney to be altered was probably built using brick from an old chimney or
from salvaged brick. Water is running down both the inside and outside and the flashing is gone. He
stated that the question is whether to use water-struck brick or to find 18,h century brick in better
condition than the current brick. They will repoint the entire chimney under Alternate #1.
Ms. Herbert asked how many courses was the entire chimney.
Mr. Hart stated that at 12'8",it was approximately 40 courses on the back side. Mr. Hart asked if the
chimney was rebuilt in 1945.
Mr. Finch replied in the affirmative.
Mr. Hart concluded that it is not original material.
Mr. Finch stated that if they use good brick to rebuild it,it will have a more modern look.
Ms. Kinzer provided photographs of the interior damage. She stated that the City is going out to bid in
approximately 1 month and that they will have bids in approximately 2 months.
Mr. Finch stated that the two valleys are also a source of a major series of leaks. He stated that they
probably have the original copper flashing that has been tarred over a few times. He stated that some of
the new flashing will be grey/black EPDM membrane flashing which will be visible.
Mr. Hart stated that he had no problem with the roof. He noted that the drawings show some flashing at
16 oz and some at 20 oz. He encouraged 20 oz throughout.
Mr. Finch stated that 16 oz is the valley flashing which will last until the next roof replacement. The
stated that the chimney base flashing will be lead coated copper.
Mr. Hart stated that since the brick chimney was almost certainly rebuilt, he had no problem with either
repair or rebuild.
Ms. Herbert suggested that Historic Salem, Inc. (HSI) might be able to help raise funds for the cost
difference between repairing and rebuilding.
Mr. Finch stated that the chimney is structurally sound, but that water absorption was a different issue.
He noted that there will be some upcoming additional needs in the future, such as windows.
Ms. Herbert suggested that raising funds for the chimney might wet people's appetite to be involved in
the future restoration efforts. She stated that she would be happy to talk to HSI representatives.
Mr. Finch stated that HSI was created to save this house in the fust place.
Ms. Bellin stated that she preferred to see the whole chimney rebuilt.
Ms. Harper asked if there was any sealer that could be put on the bricks.
Mr. Finch stated that they could put on water repellant, but he was not sure of the long-term effect on the
brick. He stated that it would have to be reapplied every few years to be effective. He noted that it was
not proposed for this project.
Mr. Hart was in agreement, and stated that he preferred to deal with the masonry mechanically, rather
than chemically.
Mr. Finch stated that it the Commission wants to keep the chimney"olde", then it should be repaired and
repointed and that if the Commission wants to see a better quality brick, the City will need to use newer
brick.
Mr. Hart stated that he would not advocate looking for rustic looking brick. He stated that he was okay
with it looking more uniform.
Ms. Herbert stated that she was concerned that the roof will look good, but the chimney will look just
okay if repaired
Mr. Hart made a motion to approve the application as submitted. Ms. Bellin seconded the motion, all
were in favor and the motion so carried.
25 Beckford Street
David Trainor presented an application for a Certificate of Appropriateness to install heavy gauge
seamless gutter on the Beckford Street side of the house and the rear of the house. Also present was his
wife,Betsy Keefe.
Mr. Hart recused himself from deliberating or voting on this application and sat in the audience.
Mr. Trainor stated that the sidewalk is listing in to the house from the rain and the bricks are getting loose.
On the back side, they have a lower gutter because it is two-tiered. They want to put in an upper gutter
because they are getting a lot of water damage from it pooling as it comes down from the second tier,
resulting in the need to replace a lot of clapboards and part of the roof on the lower section above the
kitchen. Therefore, they will be doing the Beckford Street side and the rear in heavy gauge aluminum in
white to match the trim of the house. The currently have an aluminum gutter on their half of the rear
(River St. side) and have a wood gutter on the lower section of the West side where the porch is.
There was no public comment.
Ms. Herbert asked if they explored wood gutters.
Mr. Trainor stated that it is a lot more expensive and a lot more maintenance. He noted that most of his
neighbors have aluminum.
Ms. Bellin asked if the downspouts will be square.
Mr. Trainor stated that he will put the downspout on the rear of the house, so it won't be seen on the
Beckford Street side.
Ms. Bellin made a motion to approve the application as submitted, painted white to match the trim and
downspouts installed in the rear. Ms. McCrea seconded the motion, all were in favor and the motion so
carried.
Mr. Hart returned to the Commission.
20 Fowler Street
Avalito and Franziska Garcia submitted an application for a Certificate of Appropriateness to install a
chimney cap.
Ms. Bellin recused herself from deliberating or voting on this application and sat in the audience.
Mr. Garcia provided a flyer on The Chimney Top caps, available in stainless steel or copper.
Mr. Hart stated that the chimney is not visible from Fowler St., but is visible from North Pine It,
Ms. Herbert preferred stainless with a matte finish.
Mr. Garcia noted that rain comes straight down the chimney into the house. They have 3 flues in the
chimney.
Ms. McCrea made a motion to approve a stainless steel chimney cap in matte finish. Mr. Hart seconded
the motion, all were in favor and the motion so carried.
Ms. Bellin rejoined the Commission.

39-41 Washington Square North, Unit 1
In response to a notice of violation,Douglas McNeish, 39-41 Washington Square North Condominium,
presented an application for a Certificate of Appropriateness to install an air conditioning condenser on a
flat roof with appurtenant tubing for refrigerant supply extending from the soffit about 6' down to the
condenser, as well as electrical supply 6' extending from the soffit to the condenser as has already been
installed. The condenser is 23 '/z"wide by 31 '/z" deep by 26 Y2" high. It is sitting on a rubber mounting
pad approximately 4" high.
Mr. McNeish stated that he installed the unit mistakenly believing that it was not visible and did not
require approval.
Ms. Herbert stated that with the leaves off the trees,it is much more visible.
Mr. McNeish stated that he is responding to the Commission's notice of violation. He wanted a/c on 2
floors of his unit. He noted that his unit is on the corner of Route 1A and that he could not sleep with
the windows open in summer. He installed the equipment on the roof above his unit and at that time of
year, the unit was not visible.
Ms. Bellin asked when it was installed.
Mr. McNeish stated that it was about a month ago.
Nikolaus Sucher, 39-41 Washington Sq., Unit 2, stated that he and his wife have been overseas and when
they returned they saw the condenser on the roof outside their bedroom window and wondered what
happened. Consequently, there has been a condo association meeting and a site visit. A memo has been
send to Mr. McNeish, a copy of which Mr. Sucher provided to the Commission. He stated that the
condo rules only allow removable window a/c's between Memorial Day and Labor Day.
Ms. Herbert read the condominium association's letter to Mr. Sucher into the record,which required that
the a/c condenser and related attachments be removed and the damage caused be fixed. The letter also
requests that alternate remedies be reviewed by the condo association prior to further discussion with the
Salem Historical Commission.
Ms. Herbert noted that Mr. McNeish had already applied before receiving the condo association's letter.
Ms. Guy stated that he responded to the Historical Commission's violation letter and that he could not
just withdraw the application based on the Condo Association's letter.
Francoise McCoy, 23 Winter Street, stated that she has full view of the back of this building and the flat
roof She stated that it is one more thing added to this roof and that she is not in favor. She was
concerned that other unit owners will want to add additional machines.
Mr. McNeish stated that the alternative is to have several window units throughout the building.
Ms. Herbert stated that the Commission has had situations in the past where the condo owners do things
and then ask for permission afterward. She stated that she felt it would be very useful if all the condo
owners of this building had a HVAC professional look at the entire building and determine the best
locations for equipment. She noted that the Commission has approved condensers in the past,but
typically they are screened,whether with fencing,parapet roofing or ground vegetation. She stated that
she felt they needed a master plan for a/c for the future if others want them.
Ms. Bellin asked how long they have lived at the unit and how many floors they are on.
Mr. McNeish stated that they purchased in August and that he is on 3 floors.
Ms. Bellin asked if there was anyone below him.
Mr. McNeish replied in the negative.

Ms. Herbert stated that that the Suchers have the wing on the two floors on Winter Street, then they have
stairs up to a master bedroom, over Mr. McNeish's three floor.
Mr. McNeish stated that the a/c unit cannot be put on the ground,because the feed cannot go that high
up. He stated that he might be able to move it further out on the roof.
Ms. Herbert stated that,if approved, the Commission would want some kind of screening.
Mr. Hart stated that the owners should consider potential vibration, noise and visual screening. He stated
that it was not unprecedented that condensers sit on roof.
Ms. Herbert stated that there needs to be a plan, that all the condo owners can get together on, that meets
the condo owner needs and the historic provisions. She noted that adding a/c done properly has a
positive effect on a unit's value,which could benefit the other owners, as well, and that the unit owners
who may not want a/c now, may want it when they go to see the unit down the road.
Ms. Guy suggested that the Commission either allow the applicant to withdraw with agreement that he
will apply with a resolution to the violation within a specific amount of time or vote to deny the
application without prejudice and requite removal within 6 months,which would give all the owners time
to come up with a plan.
Ms. Bellin preferred the denial, so that the violation remains and it has to be dealt with within 6 months.
She stated that it doesn't hurt to send a strong message for owners who put something in before coming
to the Commission. She noted that if the application came before the Commission prior to installation,
she did not believe she would have voted for the unit in that location.
Mt. Hart stated that the Commission would be concerned about the visual aspect wherever it is located.
Mr. McNeish if a manner of disguising it would be considered.

Ms. Guy replied in the affirmative, noted that a widow's walk is one example.
Ms. Harper stated that she would also want to know if the tubing and conduit could be painted the color
of the bricks.
Mr. McNeish noted that there is a lot of other hardware sitting on that roof and did not know if it was all
functional.
Ms. Guy suggested that the association apply to remove those items that are not functional. She stated
that if this application came before installation, the Commission would have asked what other alternative
locations were considered and why those locations were dismissed and would have considered the
abutters comments before making a decision. She stated that, to be approved, they would likely require a
screening design be submitted.
Ms. Bellin wondered if a larger unit,which serviced more than one condo could be on the ground.
Mr. Hart stated that, as an architect, such a situation could be fraught with difficulties, and that individual
units is the way to go.
Ms. Bellin noted that window air conditioners are not within the Commission jurisdiction, no matter how
many are installed.
Ms. Herbert asked if the condenser was only for the top floor.
Mr. McNeish stated that it is for 2 of the 3 floors, serving the bedrooms.
Mr. Hart made a motion to deny the application without prejudice and to require removal of all
equipment and that the altered area be returned to original condition within 6 months. Ms. Bellin
seconded the motion, all were in favor and the motion so carried.

Ms. Bellin made a motion to approve the minutes of July 2, 2008. Ms. Harper seconded the motion, all
were in favor and the motion so carried.

Ms. Guy stated that she received a copy of letter from the Salem Conservation Commission to Kxistina
Wacomestevick of 18 Kosciusko Street informing her that work proposed is not within their jurisdiction,
but is within a historic district. Ms. Guy noted that the owners have since applied to the Commission
under Non-Applicability.
Ms. Guy provided a DVD from MHC on local historical commissions and asked the members to circulate
it among themselves.

OPEN MEETING LAW COMPLIANCE STATEMENT
l. All meetings of the CLGC have been open to the public.
2. A notice of the date,time and place of every meeting of the CLGC has been filed with the
Clerk of the city or town in which the CLGC acts and a copy of such notice has been posted
in the office of the Clerk on the principal bulletin board of each city or town at least 48 hours
prior to the time of each meeting,excluding Sundays and legal holidays.
3. A record of every meeting, including executive sessions has been maintained by the CLGC,
including the date,time, place, members present and actions taken at each meeting.
4. All executive sessions, if any,have been held in compliance with M.G.L. C. 39, Section 23B.
5. No chance meeting or social meeting has been used to circumvent the spirit or requirements
of the Open Meeting Law or to discuss or act upon a matter over which the CLGC has
supervision,control,jurisdiction,or advisory power.
