SALEM HISTORICAL COMMISSION MINUTESr r Salem Historical Commission January 5, 1983 Minutrs of N� rt_ng 4.10 14 Thr Salem Historical Commission met for its regular meeting on Wednesday, January 5, 1983. 7130 p.m., One Salem Green. Members present wrre Mr ssrs. Cook, Guethlen, Lippman, Wolfson, and Zaharis. Also attending were: . Associate Member Russell Slam, Kenneth Boyles, J. McHale, and Beth and Buck 9;a Alexander. The meeting was called to order by Chairman Jacob Wolfson. Local District Operation r, A. 4 First on the agenda was the application of Rev. Raymond Lambert for a free-standing radio tower at 161 Federal Street. This application was returned to the Commission for reconsideration following a request to be heard from abutter J. McHale. The Commission's vote of approval of the three-part motion, abutters amended, taken on November 109 1982, was, by definition, conditional,V. upon abutter notification. Should an abutter request to be heard, then, 1 ,, following that hearing, a new vote must be taken. :Mr. McHale expressed his •' ' objections to the tower in terms of the aesthetics of the impact of a radio tower in an historic district. He also suggested that in presenting the waiver form to him, Father Lambert had provided little information as to the - appearance and size of the proposed tower or antenna boom. In discussion there was some confusion as towhether the boom itself had been'part of the . . ' Commission's approval. At this ,point the Commission voted to take the matter A .;io1 under advisement in deference to another applicant waiting to be heard. '�• ' Next on the agenda, the Commission reconsidered the application of 18 Washington Square West Trust owners of the Hawthorne Inn at IS Wach;n-t..n " Square West for painting the windows above ground floor white to match the white finish storm windows to be installed. Mr. Wolfson explained that this matter was back before the Commission at this time due to a procedural error. The hotel had appeared before-We-Commission-in September to discuss the -- - proposal but had failed to submit a-formal application. Abutter notification rs .) had not, therefore, proceeded as required, and no Certificate was in fact issued. Work on the project had thus begun;and was substantially complete without Certificate. Further, one abutter had voiced concern regarding the historical appropriateness of the job. Mr. Wolfson relayed the views from Bryant Tolles of the Fssex Institute that the, two-tone effect,created by the white windows above the first floor combined with the remaining buff woodwork on the first floor was aesthetically and historically troublesome. Mr. Wolfson also reported that Mr. Tolles felt the original buff tone historically preferable, noting also , the recent' change to buff at the Institute's Gardner-Pingree house nearby, r; _ ._ Kenneth_ Boyles, representing the hotel, explained that they had been unaware, that the review process was not complete in September and proceeded with the job , in good faith. Mr. Boyles was agreeable to the suggestion of repainting the, first floor woodwork white when it is painted in the spring, stone detail to . remain buff. The Commission took a formal vote,on this amended application by . the three-part motion with abutters to include the Fssex Institute and 38 Washington Square South. Approval was unanimous, and Mr. Boyles was thanked Grp` for his cooperation. Clerk will provide for the necessary abutter notification. _ Another application reviewed called for installation of a fence at 12 Deli ; Street, property of Allyn Realty Trust. It was noted that the picket fe with 8" square posts to 4' , painted to match the trim of the house in Prance a tt and Lambert Foam was substantially complete, and the Commission gave careful consideration to the possibility of a fine to the property owner. Communications, Meetings. and Other Business Masonic Temple Building. Mr. Wolfson presented proposed elevations for the Masoic Temple restpration provided for Commission review by the 'Salem -- Redevelopment Authority. The Commission noted improvements .in the storefront details and the apparent complete restoration of other details and voted r unanimous endorsement of the plans. Durkee, Paul Willis, and Jean Lovely f The meeting was called to order by Chairman Jacob Wolfson. 77 _National Regis+.er "of'Historic Places 5-7, 91Summer Street. Diane Pabich was present to discuss with the , Commission her plans to renovate the buildings at 5-7,9 Summer Street, creating an inn at 5-7 Summer and studio efficiency units at 9 Summer. Mrs. Pabich } explained that application for National Register designation is already underway apparently as_part(of the multiple resourse nomination prepared by the Sale t''"' elaMning Department. The Commission commended her for her plans to carefully' restore the facades and offered assistance as needed. The Commission should ti see specific plans when available in conjunction with the Design Review Board as part of the Heritage Plaza-West agreement. Local District Operation The Commission next considered the application of Jean Lovely for an exterior staircase at 3 River Street. Ms. Lovely explained that the staircase }� was required as a fire exit for the second unit which is to be. constructed r in the building. Several other options for providing the necessary egress { were explored, but Ili. Lovely elected to withdraw her application. The �! Commission advised her that it would make itself available for a special , meeting if necessary and thht Ms. Lovely should avoid making any interior t alterations which would be Jcostly to alter should the exterior si-.aircase fail .' to be approved. Abutter Paul Willis of-4 River Street and abutter/member John Carr of 7 River Street both spoke against the application, and Pat Durkee of 2 Andover Street relayed her serious concern about the aesthetics of the 5 proposed staircase. Mr. Carr also referred to the commercial nature of the , project where costs and options in historic districts were known '� the buyer in advance of purchase. Mr. Padjen spoke of the visual intensit, f a high density neighborhood and the delicate balance of its visual aspec s. A motion was approved wthlMr. Lippman abstaining since he had missed much of the discussion, -to inform Ms. Lovely that the concensus of the Commission was in opposition to an exterior staircase and advising her not to proceed with interior arrangements contingent upon such staircase. A letter to that effect'.,, will be sent with copy to the Building Inspector. Polly Mellon next discussed with the Commission the possibility of locating a wheelchair fitness course on the Salem Common. Ms. Mellon explained that v the City had been offered a grant from the Wells Fargo bank to develop three ; exercise courses.. an elder walking coursp., probably to be located at Palmersl--,t ` Cove; a jogging course, probably to be located at Collins Cove; and a wheelchair course. She suggested that due to the proximity of the Phillips School f$f d handicapped housing, the Salem Common seemed a likely location for the wheelb.hair - course. Ms. 1,1e13`on showed the Commission examples of the type of equipment and their arrangement on a hard surface and also explained that it would be� too pq , R' P. 2 S.H.C. 2/2/83 . late to incorporate such a course at the Phillips School site itself. A vote by the Commission expressed opposition to this use and type of . equipment on the Common, Messrs. Carr, Guethlen, Lahikainen, and Wolfson 1=' and Mrs. Wheaton voting in favor of the motion and Mr. Lippman against. In response to a question from Mr. Slam, Ms. 21+13:ori� reported that she would Al check on the question of removal of the old playground equipment from the } Common now that the new tot lot is in place. , Mr. Wolfson presented an order from the City Council declaring the i + Bowditch School as excess property, authorizing the Mayor to sell same, and requiring extensive Commission review of exterior design plans. The Commission felt that a letter should be sent .to residents in the area informing them of +' , the Commission's responsibilities with regard to the Bowditch School and 4 fii inviting their comments, questions, and expressions of concern. The letter will go to property owners on Federal Street from 145 to 161, 17-214aFow1er 7 " + Street, all of North Pine Street, Fssex Street from 384 to 3989 and all of Flint Street. A copy of the -Council order will be enclosed. Additionally, an ad will be placed in the Salem Evening News announcing the date of Commission review of plans for the renovation and inviting residents of the McIntire Historic ]District and other interested citizens to attend and comment on the plans. Historic Salem, Inc. will be approached to provide necessary funds for ` a ; this ad. Clerk will ascertain status of. tb.e design development and dates ` for review, mailing, and ad. !, The Commission next considered the matter of new electric service installed T" + at 2 Broad street where an electrical conduit was located prominently on the facade of the building near the entry. Mr. Wolfson relayed that,the tiuild $g inspector Richard ,MacIntosh had informed the owner that the balding was located ,t in an historic district. A motion was made and passed unanimously to order that the conduit be removed and further that no electrical service visible . t from the street be installed without Commission approval. The letter ordering. removal will further state that if same is not removed in 30 days, the matter will- T14- referred to the_City's legal department for enforcement under Chapter 40C. Copies of the letter will go to City Flectrician John)Condon and Mr. VAclntosh. In the matter of 2 Flint Street and the porch construction there without Certificate, the Commission considered two actions, 'first to send a registered• letter to the property owner to be followed by referral to the CitySolicitor if there is no response and second', the same motion amended to provide for initial phone .contact to request appearance at the March meeting with the letter -.-` to be sent only if verbal contact was unsuccessful. Dime limit set for response ,to the letter was 30 days. The amended motion was approved unanimously.`V Organizational and Policy - ' Budget. Mr. Wolfson reported that a budget request for $2400. had been submitted to the Payor for FY84 following, budget meetings last month. He further reported that he and Mrs. Wheaton had met witz Mayor Levesque to state € ;. the. Commission's case and that Historic Salem had responded favorably to a r w Commission request to organize a members campaign td lobby for restoration ofd ' the Commission's budget. Present were mw.mbe'rs Messrs. Carr,Lippman,_Wolfson, and Zaharis and Associate member Oscar Padjen. 'Also attendinR_were Robert Maguire and John Nagle. The meeti#k e was called to order by Chairman Jacob Wolfson. Local—P4-strict_0, ration s The Commission first considered the application of G. Wayne Belleau of 15 Hathorne Street for door installation and replacement at that address. This app ica ion hien returned to the applicant after the meeting of March 30 due to insufficient details. The revised application called for a new door to replace the third window on the east,alley side of the house, the door to be similar to Brosco F-944 on page 191 of the Commission's y. B-80 Brosco book. The application also called For a replacement of the front door and sidelights with a door similar to F 2130, page 168 and sidelights M-3925, page 115 of the same Brosco boo�k.'FJA motion was made to approve the back door, advising the owner of potential building code problems resulting from the lack of a stoop and door to close to the property line and to defer a vote on the front door until explicit drawings are presented showing sizes, fitting, stoop details, and front elevation of the existing doorway. The motion was approved by a vote of 3 in favor, 4 ' • . one abstention, Messrs. Cook, Lippman, and Wolfson in favor, Mr. Zaharis abstaining. • Communications, Meetings.and Other Business,.,. 256 Lafayette Street Condominiums. Robert Maguire was present to present an alternative design scheme for his property at 2561Lafayette Street. This plan, discusserbriefly at the meeting of March 300 and now develoMd further with the assistance of his architect David Jaquith, would call for relocating the existing carriage house to the center front ofithsite lath 14 new units constructed to the rear. The new units are expected to have similar roof lines and most with split entiries, emulating the style of the carriage house a® but with somewhat less detail due to cost. Mr. Maguire explained that he intends to provide two parking spaces per unit, including two in the existing. :® garage. Mr. Maguire asked that the Commission wte to support the proposal so informing the Board of Appeals. Any continuing reservations could-be stated in that letter of support. Mike Petroskowitz of 260 Lafayette Street spoke of his interest in a deeper set-back for the carriage' &use and his concern for density and parking problems. Bob Muzzy of 3 Laurel Street expressed conern for density level and traffic on Laurel Street. The Commission decided to defer any decision until architecturally complete drawings are presented. Members present were Messrs. Carr, Clarke, Guethlen, Lippman, Cook, Wolfson, Ms. Harris and Mrs. Wheaton. Also attending were Associate Members Russell Slam 4 and Oscar Padjen, new Administrative Assistant Nancy Killam, William Quinn? Louis Mangifesti, Russell Weston, Edward Carberg, Mr. & Mrs. Roy Pucko, Local District Operation 13 Beckford Street. William Quinn, representing owner, returned to present new plans for the entry at 13 Beckford Street, in response to the Commission's view that the entry proposed at the July meeting appeared Federal in feeling and that brick steps were problematic. New plans called i for double door with wooden steps. Mr. Quinn also presented plans for the right side elevation showing new doorway and a blocked window on the second 1a floor. Mr. Padjen recommended large granite steps. A suggestion was made that interior arrangement be modified to allow second floor window to remain. The motion was approved by a 3-part motion as presented except that the second floor, right side, 3 windows remain. The transoms were defined to .» be clear glass. Commission specified that the electrical and telephone connections to be on left and the meter to be in basement. If this is not possible, then must get approval from Commission. Recommendation that wooden steps on plan be large granite blocks, unanimous. Color as per graymoor, 329 Essex Street with all trim to be white, motion approved by 3-part motion. Black on stained wood door, unanimous. Commission will notify. abutters. t 311 Essex Street. Louis Mangifesti explained that the garage on site y had been demolished due to a confusion about the Historical Commission's procedures, and was present to present plans for fence construction. Motion to radify demolition of garage, so voted. Brown stained existing picket fence form will be used, 5' in height, flat across (not scalloped as existtng) , without a cap. An iron gate, if possible, will be used. A concern was expressed by the Commission about the impact of the fence returningi perpendicular to the sidewalk would not be in keeping with the sophisticated appearance of the building and created a "corral" effect. 3-part motion to 4 approve fence at rear of parking area (not returning to sidewalk) , conditional on gate as fence with single scallop 2 - 3' in height. Approved: Mesurs. Clarke, Wolfson, Carr, Lippman, Mrs. Wheaton and Ms. Harris. Opposed: Mr. Cook. 155 Federal Street. The removal of the slate roof was in process when the Commission spoke with the Building Inspector who stopped the job. - Bob Allison, the contractor working can the job, pas present to represent the owner, Ray Buso. The right side, 157 Federal Street, is still slate., The left sid% which is the property in question, had a slate roof with a painted cover of black asphalt. The intention was to weave asphalt shingles into slate on -0157, which would make #157 1z" bigher than #155. ,A discussion of the possibility of using a divider strip followed. Clerk will drop off form to homeowner, r' c 12 Kosciosko Street, Mrs. Jenifa Rybicki, owner of 12 Kosciosko Street, 3 accompanied by Mr. Roy Pucko were present to discuss the possibility of using vinyl siding. , They are having to paint the house every 3 years and hope to use vinyl siding. The Commission presented two alternatives: 1.) strip the wood and put up new wood and stain orr2.) burn or sand the existing clapboards and stain. The cost comparison to vinyl siding is approximately equal for replacement clapboards with additional cost for staining. The Commission pointed out the disadvantages of vinyl siding: the vinyl will fade and dent and can mask or prompt deterioration inside. A suggestion was made that perhaps the reason they are having such paint peeling problem is a moisture problem either from within or from roofing problem. A stain allows moisture through the wood so peeling problem doesn't reoccur. If there is a moisture problem existing now, siding may make this problem wore,-,,serious. The owner will consider the issues and return to the Commission with formal application, as necessary. Communications, Meetings and Other Business Edward Carbert was present to discuss the position of City Historian as proposed by the City Council. At a future date the Commission will c meet with the City Council Committee on Legal Affairs and Ordinances on the possibility of creating such a position. The position is to be an -honorary position proposed by the Mayor and Councilor Nowak, 11Mr,.Carberg ` sf eesthe-position as one of promoting the history of Salem. Local Districts - continued USA TODAY. Discussion followed regarding the installation of news- paper sales vending machines in Salem's historic districts, Mr. Wolfson ' .. + reported thea the City of Malden were going to remove the machines and USA TODAY sought a restraining order. A preliminary injunction was obtained on the grounds of constitutional right to establish boxes for freedom of speech and would be irreprobally harmed if Malden removed these machines. The boxes are currently located in historic districts at the Witch House, W,4, -A,;/ q+ ,&tn McIntire Historic District; and Hawthorne Hotel, Washington Square Historic District. A motion to write a letter to USA TODAY was approved unanimously. This letter to include the fact that boxes were installed at 2 locations in historic districts, are subject to fine of up to $500 per day, and expect an application filed for October meeting. A copy of this letter to go to Richard Stafford. - Derby Street District Expansion. Jay Brown, a homeowner on Hodges Court, has expressed interest in expanding the Derby Street Historic a District and had been expected to attend meeting. The owners had spoken to Mr. Wolfson regarding the Commission's view of vinyl siding. i Mr. Cook knows the owners and he and Don Hunt to go to family and explain the issues, Messrs. Clarke and Cook and possibly Mr. Wolfson could meet with family. Mr. Wolfson will set up time for the three Commission members and Don Hunt to speak with owners. ' Local Districts, continued Report on contact with City Electrician. The Commission wrote to John Condon, City Electrician, requesting a joint meeting. Mr. Condon replied that no meeting was necessary but if maps of the historic districts were made available to him he would notify the Commission of any exterior electrical work proposed. Problem of Getting Early Notice. The Commission Suggested that Mr. McIntosh give us early notice of any interior renovations that may lead to new exterior service. A suggestion was made for the Commission to put a sign up at the Eity Electrician's office for electricians who } come in to apply for new electrical services. . If Mr. Bramble's installation is still there, Mr. Carr will call Mrs. Wheaton and Mrs. Wheaton will therefore call Mr. Bramble. w i Derby Street Lighthouse. Mr. Wolfson reported for the Commission's interest that on the 17th of September there will be a work day at Derby Wharf Lighthouse. •- Building at corner of Derby & Bentley Street, Mr, Wolfson read a letter from the Friends of Salem Maritime to Building Inspector Richard McIntosh. Mr.- McIntosh has filed court action against owners to secure the building. The Commission will write a letter to Salem Maritime in ;y support of this action and send a copy to Mr. McIntosh. Organizational and Policy - Chair Mr. Wolfson expressed that hea was not interested in being chairman for another term and nominated Mrs. Wheaton, The motion was seconded and approved unanimously. Mr. Wolfson nominated Ms. Harris for the position " of Vice-Chairman, approved unanimously, Administrative Organization. Nancy Killam was introduced as the new administrative assistant. Members present were Mrs, Wheaton, Ms. Harris T, Messrs. Clarke and Wolfson. Also present R. aO'scar Padjen, associate member, Ray Buso, Martha Jarnis and Richard LeBel. �t Local District Operation } 155 Federal Street. At our last meeting, the Commission discussed the +^� roof color of GAF Charcoal Blend as being the most historically appropriate color to use. Mr. Buso and Ms. Jarnis prefer a Platnum Blend which they feel conform to other houses in the neighborhood. The back of the roof (gable part) has already been completed in Platnum Blend. The contractor did not obtain a building permit before starting job. A suggestion was made by the Commission that the contractor take the roof that he has just completed and remove the shingles and start over with GAF Charcoal Blend, The owners questioned whether contractor will bear the burden of expense to change the roof that has been completdd. Owners to investigate this possibility. Ms. Jarnis expressed the fact that she wished she had been aware of the Commission's rules and regulations. Mrs. Wheaton told of the Commission's plan to send out brochures to new home owners in Salem's historic districts. Mrs. Wheaton asked for any motions. Ms. Jarnis expressed her feeling that the color of a roof is a matter of opinion. • Ms. Harris reminddd Ms. Jarnis that the Historical Commission is required to follow guidelines according the National Guidelines as to what is historieally appropriate. The owners again stated that they wanted to use Platnum B&end shingles. The Commission stated that this color would not be historically appropriate. A motion was made to take the matter under advisement, approved unatimously. Approval was given to the clapboarding of dormer with painting as to the body of the house. " 106 Derby Street. Richard LeBel, owner, was present to discuss his . plans for restoration of the property. Discussion followed as to what would be most historically appropriate for femevation of this building J ` and property. The following is a description of the work proposed: 1, Triangular Pediment over door V 'x 6" 2. Increase Facia - width 3/4" x 6" 3. Increase Corner Board - width 3/4" x 6" 4. Add Molding around windows &doors 5. Pediment 2" from door using band molding lk" for windows & 1 3/4" for door casing 6. Add window boxes with wooden knee brackets - width of window 7. Porch rail for top and bottom rail - square balaster stock 4" Post capped with beaded board 8. Yellow pea stone gravel 9. Use Cap Stockade Fence for back lot line 10. Allow for landscaping along fence from house to street Color of house to be decided at a later date as well as the roof. Mr. LeBel to apply to the Commission as necessary: The 3-part motion was approved unanimously to allow for the changes as described above. The Commission had ^originally approved a dark green color. t Discussion followed as to what steps should be taken. Ms. Harris felt } a letter should be written to the owners stating that we have received a number of complaints and that'we appreciate that they came to us for ' "t approval but the color painted now is not the approved color. Mrs. Wheaton doelanot agree. Ms. Harris suggested that a general letter be sent to all historic district '::hmreowners. Mrs. Wheaton stated that the Commission needs to establish better phaseology in dealing with historical appropriateness and also needs ,samples of historically appropriate material in the office. Mrs. Wheaton has asked for guidelines from the National Trust office to use as reference. A mass mailing was suggested for February and March to all historic district homeowners. 343 Essex Street, continued. A motion to send a letter to the owners was approved, unanimously. 155 Federal Street, continued. The Commission recommended that owners not try to match slate roof. It is difficult for asphalt to look like slate. A suggestion was made that the lighter the shingle changes the look to modern and the darker color shingle is more appropriate since it minimizes the impact. An ideal color would be slate, wooden or metal shingle, depending on the period of the house. Since this is economically unfeasible, . an alternative would be asphalt/fiberglass or asphalt shingles. The 'Commission made a tentative list of shingles colors which would be historicahly appropropriate, as follows: Bird Fiberglass - Charcoal Brown, Moire Black, Black Celotex Fiberglass/Asphalt .- Ebony Black, Burnt Brown Celotex Asphalt - Ebony Black, Burnt Brown, Chocolate Brown GAF Blends - Rustic Brown, Charcoal, Walnut Brown, Black Samples of these shingles to be left in the Commission's office. A suggestion was made to research existing roof color blends on houses and make a list of those houses which are appropriate. 155 Federal Street, continued. A motion was made to deny the applicapion for platnum blend roof color with the exception of approving the application for clapboarding the dormer and painting the existing color of the house. The application will be approved if the owners change the color of the roof to the appropriate color of Charcoal Blend. The back side of the roof, which has already been completed, may be left as is since it is not in public view. Approved unanimously. Owners Mr. Buso and Ms. Jarnis were present to report that a two-tone roof , back part already completed with Platinum Blend and front to be Charcoal Blend, as approved at the last meeting by the Commission, was not acceptable to themselves or neighbors. The owners stated that they wished to continue with the Platinum Blend color. The owners stated that to change to charcoal Blend color would be wasteful, as the roof is almost half completed in Platinum Blend color and that they could get into a lawsuit with the contractor. The owners felt that advan- tages of using the lighter color include lack of waste, no lawsuit with contractor and able to continue with same contractor. Mrs. Wheaton asked about whya permit had not been obtained before starting the p g job. The owners replied that the contractor had informed them that he would take care - of obtaining the permit. The owner stated that they felt they were at a . disadvantage because they were not aware of the historic district and approval process. Mr. Wolfson asked about the status of the roof color of the other half of the house. The owners stated that the people are waiting to hear of the Commission's decision and will do all one color. The owners now stated that they had changed their minds '4 and it would be a financial hardship. The Commission had previously heard the application`.` of Mr. Lagonakis, owner of 13 Beckford Street, The owner now wished to amend the application concerning the windows. The owner wishes to use replacement windows with aluminum sashes instead of wooden sash as is existing now. Windows to be same size as existing. The circular arch window to be of design. The Commission then discussed the possibility of using double glazed ;.'' wooden windows. The owners felt that this would be very expensive and would !;O. take a great deal of time to have these custom made wooden windows. , Chairman Wheaton pointed out the fact that the Secretary of Interior's Guidelines state that an attempt be made to retain original materials, which in this case would be the wooden windows. Ms. Vogt stated that a contractor, Shea Roofing, looked at the gutters and told her they needed to be replaced. The Commission stated that the gutters are an intricate part of the design of the house and would need to know exactly what would be done to the existing gutters: Ms. Vogt stated that she is getting water damage to her home and needs to do something soon. Mr. Allison stated that there are several roofs on the street that are the same color that the owners want. Ms. Harris pointed out that this area has been an historic district for only 7 years r so that all roof colors were not approved by SHC. Mr. Allisoia stated that zy;s he is aware of his liability. He admits that he applied for a building . ' permit and started the job without approval. He says he has been doing this,',' ' _` for 6 years with no problems. Mrs. Wheaton asked if the Commission was interested in changing their vote since the contractor has been acting in good faith although not legally. A Certificate of Hardship to be issued to allow owners to continue with roof color of Platinum Blend. 86 Federal Street.
