PITCOFF: Re-Tnstal.lation of Water Services in peter Road In reply to your letter of thi.s date , I would suggest that if the developer and the Planning Board and the Bui-l-ding Inspector come to an ,agreement regarding the requirements for completion of the water system in the Peter Road area , I will be glad to try to work out a Covenant in order to carry out the terms of such agreement . As far back as December, 1968, the Planning Board informed Mr. Mc: r .•. cus that information regarding utilities in this area would have to be furnished to the Board . In view of this, I think that the Planning Board is definitely involved in this situation, and that whatever arrangement is made will require their approval or consen as well as that of the Building Inspector. --- ALBERT R. Last evening at a Planning Board meeting, the Board discussed the matter of the inadequacy of the street utilities in Peter Road in the vicinity of Lots 78-79-80-81 . Looking back into our records, when these lots were endorsed "Approval Not Required Under Subdiv- ision Control Law" , a plan was shown to us indicating that there was a six inch water main running along the entire length of Peter Road from Chandler Road to Linden Avenue . Apparently this water main has never been installed, and the-re•- fore, the houses on Peter Road are all serviced by running separ�. ce house services out of Linden Avenue or Chandler Road. The house built in the Spring of 1969 is apparently serviced by a 3/4" copper main tied into a stub that is near the corner of Chandler Road and Peter Road. It would appear that all four existing houses on Peter Road d3 not have the proper size water services in accordance with the City Ordinances, and further they are running across lots other than qtc on which the houses are built, and no easements are indica-zed. In our opinion, no further building permits of any kind should be issued along Peter Road until the adequacy of the water main is verified and approved by the City Engineer. In other words, the six- inch main which is shown on the plan must be extended from the stab now at Chandler Road to the water main in Linden Avenue. Further, the matter of the proper services to the four houses on Peter Road should be brought to the attention of the owners so that proper services can be installed for these houses. SAD OSKf p y RAYMOND F. SWEENEY JANUARY 22, 1970. PLANNING BOARD MEETING_ 1 . 1.5. 70 This meeting was held in the Mayor' s office , and was opened promptly at 7: 30 P.M. by Chairman John M. 'Gray, Jr. , with Board Members Gerald T. McCarthy and Raymond Sweeney present . `dr. Ge0r4- . Novak, newly appointed to the Board, and a replacement of our former member, Albert R. Pitcoff, Esq . , who has been appointed as City Solicitor, was introduced to the Wlembers and welcomed by all present . Mr. Hyman Marcus appeared with Mr. Schwarz of Business Enterprises, Inc . , owner of lots #78, 79 , and 80 on Peter Road . Mr. Marcus stated he would absolutely, unqualifiedly, and unreservedly agree to do everything asked in a letter from this Board to the owner, dated January 13, 1970. Mr. .Marcus further stated that "On Eleanor Road , t had an arrangement with former Mayor Francis Collins that he would deduct 50% of the taxes while !:>nd in Peter Road was being developed, and then after rive years he I me in and said he could not do this any more . I it turns out that the Cit ' put the water in Eleanor Road, do I have the right to say to the City Why don' t you finish it?" Mr. Marcus stated he had al- lowed his builder sums of money to install utilities for the houses alr: ady constructed on Peter Road, and he was advised to contact this builder and find out what installations were actually made by him, and the locations of these installations. Mr. Gray stated he would call the Citv Solicitor in the morning and take his advice; he would draw up a Covenant , and Mr. Marcus would furnish a bond. On motion of Mr. Sweeney it was voted to approve and accept the min- utes of the last meeting. Mr. Gerald McCarthy was voted in as Clerk Pro Tem, replacing Albert 2. Pitcoff, former Board member. Mr. Daniel O'Brien, the Building inspector-, had submitted a number of items on which he wanted advice from' this Board as to the proper inter- pretation of rules governing certain parcels of land, as follows: 1. His department had received complaints about blasting on the water ' front side of Lafayette Street by owner Ernest Belleau, and clearing j land at this site . Board members advised Mr. O' Brien that Mr. Belleau must submit a detailed plan first to the Army Engineers and to the Department of Inland Waterways. 2 . The second complaint received by Mr. O' Brien had to do :with owner Thomas Sullivan, removing land and installing gravel to provide a park- ing area for use by Salem Hospital ; on this, the Board advised that this is a violation of the Hatch Act and comes under the jurisdiction cf the Commonwealth of Massachusetts , D:�partment of Natural Resources , ' a.nc is also a violation of the City ZonLng Ordinance with regard to uses permitted in an R-1 , Single family residence area . 3 . Mr. O'Brien' s third request was for advice to be passed on to Mr. I Joseph Belfiore who had sought to have land owned by him on Champlain Road zoned to accommodate multi-family residence units. The Board found that this is an R-C and R-1 district , zoned for single family resi- dences and advised that the owner divide the land into house lots and come in for subdivision approval . 4 . Another request for advice concerned the property known as "Mr. Do- nut" on Bridge Street ; this is an R-2 district , and the Board found th;. as the former use , making and selling donuts , had been discontinued more than twelve months ago, the premises now revert to the restrictions and regulations governing R-2 distticts . 5. Mr. O' Brien' s last question had to do with land on Peter Road, former- ly owned and developed by Mr. Hyman Marcus . The land has been conveyed to Business Enterprises, Inc . , who propose to build. a dwelling on each of three single lots but. have inherited a situation whereby existing water services are in violation of the City Ordinances and requirements . The Board is controlling this situation, having firmly advised the owner and the former owner that unless and until a Covenant is drawn between the owner and the City, agreeing to all Planning Board requirements with re- lation to this particular area and conditions for remedying the existing installations in absolute compliance with this Board ' s stipulations as outlined in several communications to the owner, also, a bond must be furnished the City, the Building Inspector was advised that no permit may issue for building on these lots in question until the work has been com- pleted and has the approval of the City Engineer. A number of requests for information, one from the Peabody Construction Company, and from the Missouri House of Representatives and from various students which were received by the Board will be answered as quickly as possible . Copies of maps of the City, dated 1700 and 1780, having been obtained from the Essex Institute were viewed by the Members who found th�,se very interesting and informative . More copies will be obtained to suppler eack member with a copy of each. This concluded the business brought to this meeting, and it was voted to adjourn at 9: 45 P.M. SWEENEY PUBLIC HEARING - - - DECEMBER 15. 1969 Definitive Plan of Loring Hills Associates, Tr. , 568 Loring Avenue , Salem. Date: Nov. 5, 19699 Subdivision "Loring Hills" #3230. All Board Members were present at this hearing with Gerald T. McCarthy Act- ing Chairman. The Chairman called the meeting to order and requested Acting Clerk Pro Tem Mr. Pitcoff to read the legal notice which was read into the record . Mr. McCarthy .stated the meeting would be held in the usual manner, those in favor of this proposed subdivision would be heard first, those opposed, if any, would be heard afterwards. Counselor John Serafini , representing the applicant, presented the case; "The entire area is approximately one hundred (100) acres of land which we have is zoned R-31 and a portion of the front on Loring Avenue is zoned for business; the R-3 calls for Multi-family residential district . In order to begin our project we are going to take an area of approxi- mately 3. 2 Acres of land which is represented by Lot #1 on this partic- ular plan, access to this will be over this roadway going in off Loring Avenue; and these plans if you wish, could be looked at, they are here for your convenience. In order to begin, it is necessary to divide the land in accordance with Subdivision regulations. This is a projected portion of this particular area . I don' t at . the moment know what their questions or what questions may be in the minds of some of the people interested, but we will be able to answer all questions. All that is involved is this three acre piece in order that we may beginh . Chairman McCarthy: "Thank you very much" , and then asked if any others present wished to be heard in favor of this subdivision plan. A Mr. Kimball spoke, saying he represented five persons in favor, himself and his wife, his brother, his, nephew, all residing on Cedar Avenue, and also his mother presently residing at 562 Loring Avenue; he con- cluded by stating "These people are all for it" . The Chairman asked if anyone else wished to be recorded in favor. There was no response from the spectators. The Chairman then asked if there were anyone present who wished to speak in opposition to this proposed subdivision, and no one present. ind.icat.<:3 " any desire to speak. Mr. Gray, Chairman of the Board then spoke: "Mr. Chairman, I have talkru with Mr. Serafini about this.; . two men representing an engineering firm in Boston, Edwards and Kelsey, Inc. , came to my house, and introduced themselves; they have been appointed as engineers for the layout of this I-95 spur, and the reason- they came to see me was to find out what we 2 iht' .t of the I-95 connectors, and I explained that the Planning Board essentially in agreement with the corridor of the I-95 spur going to , ,air. Square and the 'connection to Beverly; we were withholding any com- x.ent on the interchanges to existing City streets, pending development of the preliminary working drawings; one suggestion that both Mayor Col- lins and the Board were in favor of, was to have a connection at Highland Avenue so that traffic on the Vinnin Square section spur could enter and exit in either direction onto Highland Avenue. They stated they had been instructed by the Massachusetts Department of Public Works to work with the City on land owned, particularly in the interchange areas, one of which will affect this particular parcel ; so I called John Serafini and gave him the names of the engineers, and requested that they be given a duplicate set of these prints so they would know, and tie in and formu- late their work accordingly. Mr. Serafini is going to do this; this is dust for the record" . Mr. McCarthy then asked if any other Board Member would like to make any remarks. The Board appeared satisfied that all aspects had been well covered. Stating that since all persons in favor had been heard and since no per- sons wished to speak in opposition, Mr. McCarthy then declared the hear- ing c'1osed. Mr. Pitcoff suggested that the observers need not be sent away, they would be welcome to stay as long as they wished. This finalized the business of the Public Hearing. REGULAR PLANNING BOARD MEETING Motion was made and seconded to dispense with reading of the mAinutes of the last meeting. A voluminous copy of business transacted between the D.P.W. and the North Shore Gas Company was the first order of business. Mr. Gray explained w4hat had gone before on this, referring to his conversation with a repres- entative of the company. It was mentioned that the tanks referred to,have i'ready been installed, which brought up the question of whether the ,Bui�d- ing Inspector-had issued a permit for such installations. Mr. Sadoski sug- gested this be sent to the .City Solicitor for his opinion. I� A memo from the Building Inspector, Mr. Daniel J. O'Brien, Jr. , was read;/ this was with regard to applications for permits submitted to him for the construction of three dwellings on Peter Road. A copy of a plan submit- ted with these applications was shown to the Board Members. Mr. Gray stated that he w s of the , opinion that when this Board had given approva;. to this plan or' gi ally, ' water main was shown looped from Linden Avenue- t,- , Chandler Roa . Td this is what the Board approved the plan on; the Board concurre There are two things involved here: We have 'been giveae a plan which owed a water main looping that entire area; it has only been discover d recently that there are three houses opposite the `lots mentioned, 78 :79-80, and the question is where do they get their water? Mr. Sweeney stated he was amazed at the 3/4" line shown but he was not surprised. Mr. Gray stated that the City Water Department has been prob- ing for about a week trying to find this so-called water main loop and that ' s when they discovered the 3/4" service; no one seems to know if -3- t ; s goes across the street and services these houses. Apparently these a :. ee lots do not havea sufficient water service in front of the lots, / -:d according to the City Engineer and our own rules the mains must be ,extended by someone, and that should not be the City. Mr. Pitcoff stated that Peter Road is not an accepted street and it is paved. The Board agreed that building permits shall be withheld until a determin ation can be made as to whether or not the facilities are adequate and it / is the interpretation of this Board that the owner of those lots is re- U/ sponsible for installing these services. The property owner should have a determination from his engineer or from whomever he acquired the lots as to where the main is. The Board feels it is approximately 250' from the house Mr. Poitras built. The Planning Board advises Mr. O'Brien that any building permits shall be withheld until the water main is looped, and he is advised by the City Engineer that all of the services are adequate for the purposes they will be used for. 4 communication from Mayor-elect Sam 'Loll stating he and—Mrs. Zoll accepted the invitation of this Board to attend its annual dinner meeting to be held r,;: December 18e, was read to the members. Counselor Serafini presented a request for a waiver from the subdivision regulations for his client, Loring Hills Associates`.limiting deadend streets to 500 feet; the proposed roadway_..19-55Tf feet , and it is expected nfA that the turnaround will be eliminated when further areas are developed. Mr. Serafini stated .this is the only waiver they will request. "With regard to this request, Mr. Gray moved that the Board grant a waivea^ of the 500 foot limitation and increase it to 5501 feet, and that the co - de-sac will be constructed as a temporary cul-de-sac on the road bring extended in the future years; motion seconded -by Mr. Sadoski, all i,: favi;:, and, so voted approved. . Mr. Albert Pitcoff refrained from voting or this motion. , i:r. Gray made a second motlon with regard to the definitive plan o2 a road- way on which the Public Hearing was held at the beginning of this meeting; "Subject to the statutory time limitation, and with the proviso that we re- ceive a corrected letter from the Board of Health signifying their approval of this plan, I move that we approve this definitive plan, dated November 5, 1969, of Loring Hills Associates" . As far back as December, 1968, the Planning Board informed Mr. Maz- cus that information regarding utilities in this area would have to be furnished to the Board. In view of this, I think. that the Planning Board is definitely involved in this situation, and that whatever arrangement is made will require their approval or consent , as well as that of the Building Inspector. The addition of two gates off the existing tee at the inter- section of Chandler Rd. and Eleanor Rd. and three gates(one on each end of tee) at the proposed Eleanor Rd. to Linden Ave. water main extention. Last evening at a Planning Board meeting, the Board discussed the matter of the inadequacy of the street utilities in Peter Road in the vicinity of Lots 78-79-80-81. Looking back into our records, when these lots were endorsed "Approval Not Required Under Subdiv- ision Control Law" , a plan was shown to us indicatingi that there was a six inch water main running along the entire length of Peter Road from Chandler Road to Linden Avenue. Apparently this water main has never been installed, and there- fore, the houses on Peter Road are all serviced by running separate house services out of Linden Avenue or Chandler Road. The house built in the Spring of 1969 is apparently serviced by a 3/4" copper main tied into a stub that is near the corner of Chandler Road and Peter Road. It would appear that all four existing houses on Peter Road do not have the proper size water services in accordance with the City Ordinances, and further they are running across lots other than lots on which the houses are built, and no easements are indicated. In our opinion, no further building permits of any kind should be issued along Peter Road until the adequacy of the water main is verified and approved by the City Engineer. In other words, the six inch main which is shown on the plan must be extended from the stub now at Chandler Road to the water main in Linden Avenue. Further, the matter of the proper services to the four houses on Peter Road should be brought to the attention of the owners" so that proper services can be installed for these houses.
