DECISION ON THE PETITION OF JOHN H. HAMILTON REQUESTING A VARIANCE FOR 36-38
PERKINS STREET
A hearing on this. Petition was held on November 19, 1980 with the follow-
ing Board Members present: Douglas Hopper, Chairman, Messrs. Piemonte and
LaBrecque, and Associate Member Luzinski. Notices of the hearing were sent
to abutters and others and notices of the hearing were published in the Salem
Evening News on November 5 and November 12 in accordance with Massachusetts
General Laws, Chapter 40A.
The Petitioners have requested variances for the two buildings at 36-38
Perkins Street to convert the present first floors of the buildings at this
site from two three-bedroom apartments each to four one-bedroom apartments each.
A variance is required because the building is in an R-3 district where the
proposed use is prohibited without variances from use, density and parking
requirements.
The Board of Appeals, after consideration *of the evidence presented at .
the public hearing and after viewing the"property snakes the following findings
of fact:
1. The property in question is currently vacant and in disrepair having
previously been condemned because of state sanitary code violations.
2. The requested variances are needed in order to make it financially
possible for the building to be rehabilitated.
On the basis of the above findings of fact, and the evidence presented
at the public hearing, the Board of Appeals concludes as follows:
(1) The property is in a state of disrepair and is an eyesore to the
neighborhood. It is therefore in the best interests of the City to have the
building rehabilitated. However, such rehabilitation is impossible without
the granting of the requested variances.
(2) The conditions described above, which affect the land in question,
but not the zoning district generally, cause the following special hardship:
unless the variances are granted, the building will continue to deteriorate
and will have to be torn down.
(3) The conditions described above, which affect the land in question,

(4) The desired variance may be granted without substantial detriment
to the public good because the proposed use of the buildings will substantially

granting the requested relief. A variance is therefore granted to the Petitioner .

3. The variances are conditioned upon the participation of the Salem UDAG

SECTION 122.O STOP-WOR{ ORDER
.122.1 Notice to owner: Upon notice from the building official that
anv work is being prosecuted contrary to the provisions of this code or in
an unsafe or dangerous manner,such nvork shall be immediately stopped.

thing attached thereto or connected therewith is dangerous to life or
limb or that any building in that city or town is unused, uninhabited or

SECTION 124.0 EMERGENCY MEASURES
INA Failure to remove or make structure safe, survey board, survey
report: If"ill owner of such unsafe structure refuses or neglects to
comply with the requirements of such notice within the specified time
limit,and such structure is not made safe or taken down as ordered there—
in, a careful survey of the,premises shall be made by a board consisting;
in a city; of a city encr neer, the head of the fire departmerzt, as such term
is`defined in Section I of Chapter 143 of the Massachusetts General Laws
Annotated, as amended, and one disinterested person to be appointed by
the building official; and, in a town, of a surveyor, the head of the fire
department and one disinterested person to be appointed by the building
official. In the absence of airy of the above officers or individuals, the
mayor or selectmen shall designate one or more officers or other suitable
persons in place of the officers so named as members of said board. A
written report of such survey shall be made, and a cop, thereof sexed
ori such owner.
124.2 Removal of dangerous or abandoned structures: If such survey
report as outlined in Sec:dn.121,I_declares such structure to be dangerous.
or to be unwed, uninhabited or abandoned, and open to the weather,and
if the owner continues such refusal or neglect, the building official shall
cause it to be made safe or taken down or to be made secure; and, if the
public safety so requiressaid building official may at once enter the
structure, the land on which it stands or the abutting land or buildings ,
with such assistance as he may require, and secure the same; and may
remove and evict, under the pertinent provisions of Chapter 239 of the
Massachusetts General Laws Annotated as amended, or otherwise, an `a 4:n_ev

124.3 Remedy of person ordered to remove a dangerous swcture or
make it safe: An owner, aggrieved bv- such order may have the
remedy prescribed by Section 2 of Chapter 139 of the Massachusetts
Ceneral Laws Annotated as amended;provided that any provision of said
Section 2 shall not be construed so as to hinder, delay or prevent the
building official from acting.and proceeding under Section 1-243; and
provided,further,that this section shall not prevent the city o:town from
recovering the forfeiture provided in said Section 104?from the date of
the service of the original notice, unless the order is annulled by the jun-.

1206.1 State Building Code Appeals Board: Whoever is aggrieved by
an interpretation, order, requirement, direction or failure to act under
( this code by any agency or official of the city, town or region, or agent;
or official of the State charged with the administration or enforcement
of this code or any of is-ndes.or regulations, excepting an- specialized
codes,-may-appeal directly-to.the State Building Code AT) ai- Board as

Whoever is aggrieved by an interpretation, order, requirement, direc-

must at all times be properlysecured and barricaded to prevent
unlawful entry, and to eliminate potential fire hazards.
There also must be a regular check of the property to insure
the security of the buildings and to provide for the safety of
the surrounding buildings.

On 5/2/80 the Salem Polic Department was called to your property at 38 Perkins Street,
Salem, Mass. to investigate the possible unauthorized entry of vandals. This was Con-
firmed by the investigating officer along, with evidence of fires being set in one of
the secorW floor apartment's.
This Department -is greatly Concerned with these conditions as they constitute a de-
triment to the health safety and well-being of the occupants and the general public.
Therefore, under the emergency provisions of Chapter Iand II of the State Sanitary
Code of the Commonwealth, the structure which you now own is orHarnd rnndemu d and
to be vacated immediately upon receipt of this notice.
You are also ordered to secure this building immediately. This can be done by board-

29, 1979. We recommend the dwelling unit first floor rear, from exterior is in
bad disrepair.
This and all other units in the dwelling be boarded up, cause they do not meet the
minimum standard for human habitation.
Also, reference to 36 Perkins Street, the side stairway entrance is unsafe for use.

DECISION ON THE PETITION OF JOHN HAMILTON, TRUSTEE, REQUESTING VARIANCES FOR 36-38
P.ERKINS STREET •
A hearing on this Petition was held on December 16, 1981 with the following
Board Members present: Douglas Hopper, Jr., Chairman; Messrs. Piemonte, LaBrecque and
Feeherry. Notices of the hearing were sent to abutters and others and notices
of. the hearing were published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The Petitioner has requested variance's for the property at 36-38 Perkins
Street to divide the property into two separate parcels. Variances are required
because the proposed division of the property will result in the creation of .two
non-conforming lots. The property in question is in an R-3 zone.
The Board of Appeals, after consideration of the evidence presented at the public
hearing and after viewing the property makes the following findings of fact:
1. Presently there are two four unit dwellings on one lot at this site.
2. Petitioner has made a substantial investment in this property under the
terms of a UDAG grant.
3. The proposed division of the property will facilitate the sale of 8 condominium
units to low and moderate income families.
On the basis of the above findings of fact, and the evidence presented at the
public hearing, the Board of. Appeals concludes as follows:
1) The property in question is currently non-conforming and is unique as the
,site of two separate four unit dwellings.
2) The conditions described above especially affect the land in question but do
not generally affect the zoning district in which the property is located.
3) The conditions described above which affect the land in question, but not
the zoning district. generally cause the following special hardship: unless the
requested variances are granted it will be more difficult to market these condominivas
to low and moderate income families.
4) The desired variance may be granted without substantial detriment to the
public good.
Therefore, the Board of Zoning Appeals unanimously voted (4-0) in favor of granting
the requested relief. The Board grants a variance to the petitioner on the following Car=d
