Dear Ms. DeFrancesco;
This letter is to inform you of the continued illegal tenancy at 20 Perkins Street,
by one Evelyn DclaCruz. This property was found in violation of Building Code (780
CMR, State Building Code) and City Ordinance due to this use of an Unihabitable Space
as a non-allowed 51h unit. First, this is a 4 unit structure, and the 5`h unit would be
considered an illegal change of use as no permit was ever granted to construct this space,
and no relief from Zoning was granted for another unit. Secondly, this space does not
meet the minimum codes regarding Light, Ventilation, Egress, Ceiling Height, and Fire
Protection. This department has been exceeding lenient in it's prosecution of these
violations due to the allegedly sensitive nature that brought about this tenancy. While we
are mindful of the need to not uproot this tenant without a good plan that protects her
wellbeing, this City has been unfairly held in a position of liability for the past year
awaiting some action in this matter.
It is my understanding that this letter is the last step in facilitating this move of
Ms. Delacruz to a legal dwelling unit. Any help that your department can do in expedite
this process would be of great assistance. If I can be of further assistance please feel free

The above listed property has been found to be in violation of the following State Codes
and/or City Ordinances:
780 CMR, State Building Code, Sections 118.1118.2 118.3, regarding illegal
work, notice of violation, and prosecution of said violation. These sections
cover the illegality of these basement units, the written notification thereof,
which according to our records was made by the previous Building
Commissioner on 11/17/1999, and the prosecution of your failure to address
this previous Cease and Desist Order. Such violation carries a penalty of$1000
per day with each day constituting a separate violation.
It is Ordered that you Cease and Desist the illegal use of this basement space as
rental units, as these are not habitable spaces, nor are they allowed due to the
zoning regulations that require no more than four units for this property.
It is further Ordered that you not only vacate these illegal basement units, but
then they must be completely dismantled, with such work requiring proper
permitting prior to the commencement of any work.
Said violations must begin to be corrected, repaired, and/or brought into compliance
within 2 days of your receipt of this notice. Failure to do so may result in further actions
being brought against you, up to aTid including the filing of complaints at District Court.

In accordance with the Salem Fire Prevention Regulation#2, an inspection of the
property at 20 Perkins St occupied by (Apartments) was conducted by Lt Erin Griffin,
Salem Fire Department,on Thursday September 8,2005. This inspection was done
in response to a report given to this office by Deputy Chief Brian Harrington. Deputy
Harrington and his crew responded to the above address on 9/7/05 on the report of a fire.
Deputy Harrington reported several hard wire and battery detectors were dismantled
and/or missing.
As the property owner you are responsible for the upkeep of the fire alarm system.
Upon my inspection, in addition to the dismantled fire alarm system, I noticed large
amounts of clutter and storage in the common areas. Storage is prohibited in all common
hallways. Once again as the property owner it is your responsibility to enforce this code.
As the property owner you are required to furnish this office with a 24 hour contact name
and number for emergency purposes. Answering machines aren't sufficient.
A copy of the Salem Fire Prevention Regulation is enclosed for your reference.
You are hereby ORDERED to make a good faith effort to correct the violations listed
above. All items listed above shall be completed forthwith. A re-inspection date will be
scheduled for September 15,2005.
If you fail to comply with this notice before the re-inspection date, you may be liable for
the penalties provided for by law for such violations.

REGULATIONS GOVERNING THE CONTROL OF CONDITIONS LIKELY TO
CAUSE FIRE AND THE RESETTING OF FIRE ALARMS
UNDER THE PROVISIONS OF CHAPTER 148, SECTION 5, MASSACHUSETTS GENERAL LAWS AND
527 CMR REGULATION SECTION 106. 2, AND THE SALEM FIRE CODE SECTION F-105.0, THE
FOLLOWING REGULATIONS SHALL BE APPLICABLE.
1 . Any material, device or piece or pile of equipment which the fire official
shall find in any building, room, or upon any premises, which creates a dan-7
